U.S. GOVERNMENT INTEGRITY SYSTEMS AND ETHICS

Today, the United States government at the federal (national) level has a highly developed structure of laws and regulations designed to prevent, detect and remedy conduct by government agencies and officials that is not in the public interest. The overarching purpose of this legal framework is to promote institutional integrity as well as the personal integrity of each federal employee. In this essay, Jane S. Ley, deputy director for government relations and special projects, U.S. Office of Government Ethics , explores the major components of the system and how it has evolved over time. Many of the basic components of the legal framework supporting government integrity in the United States arose from events involving great national tension our Revolutionary and Civil Wars, and presidential assassinations and resignations. Refinements of the basic components have historically occurred and will likely continue to occur in response to scandals and political crises. The bedrock foundation of all U.S. federal government self-regulation is the U.S. Constitution. In the late 18th century, after the Revolutionary War, the drafters of the Constitution were greatly influenced by their perception that the European systems of government with which they were most familiar were corrupt. The Founders felt that concentrating too much power in the hands of any one governing body was dangerous. The United States Constitution begins with the phrase "We the People..." signifying from the very outset that the U.S. government is established by and for the people and must be accountable to its citizens. That is why government employees are often referred to in the United States as "public servants" and, when acting on behalf of the collective will, as "public trustees."

SPRINGFIELD, Illinois (AP) Illinois, a state that both laments and seems to revel in its colorful history of government graft, is trying to clean up its image with a major overhaul of weak ethics laws. Powerful inspectors will investigate allegations of corruption. Lawmakers won't be able to accept free golf and tennis outings from lobbyists. The governor's influential but unpaid advisers will have to disclose their financial interests. The overhaul, largely a response to a scandal that helped drive the last governor into retirement, will lift Illinois off the ethical bottom, experts said Friday. "It's a major step for Illinois, but a lot of states are already there," said Robert Stern, president of the Center for Governmental Studies. "It's overdue." Cynthia Canary, executive director of the Illinois Campaign for Political Reform, said Illinois could turn out to be a national leader in some areas, including Internet disclosure of lobbyist expenses and officials' financial interests.

The investigative journalism and the "watchdog" role developed by the American press in the 1960s and early 1970s gave way to increased attention to "journalism ethics." During the Vietnam War, the press played a major role in accelerating the U.S. exit from an unpopular war. During the Watergate investigation, two persistent reporters from the Washington Post , Bob Woodward and Carl Bernstein, succeeded in uncovering facts that led to the resignation of President Nixon. There was, however, also a feeling that the press sometimes went too far, crossing the fine line between the public's right to know and both the right of individuals to privacy and the obligation of the government to protect national security. In many cases, the courts have decided when and if the press has overstepped its rights. In 1971, the government tried to stop the New York Times from publishing a secret study of the Vietnam War known as the Pentagon Papers, claiming that publication would damage national security. But the U.S. Supreme Court ruled that since the government could not demonstrate the extent of the damage to national security, the newspapers should be free to publish the information.

The United States Office of Government Ethics (OGE) is a separate agency within the executive branch of the U.S. Federal Government which is responsible for directing executive branch policies relating to the prevention of conflicts of interest on the part of Federal executive branch officers and employees. Primary duties include establishing the executive branch standards of conduct; issuing rules and regulations interpreting the criminal conflict of interest restrictions; establishing the framework for the public and confidential financial disclosure systems for executive branch employees; developing training and education programs for use by executive branch ethics officials and employees; and setting the requirements for, supporting, and reviewing individual agency ethics programs to ensure they are functioning properly. The Director of OGE is appointed by the President after confirmation by the U.S. Senate . The Director of OGE serves a five-year term, thereby overlapping presidential terms, and is subject to no term limit. The rest of the OGE employees are career civil servants.
