Abstract
This issue of NEWS DIGEST focuses on one very important and often complicated issue that parents confront when they have a son or daughter with any type of disability: How to plan their estate to best provide for their child's future security. Parents may ask themselves: "What will our son or daughter do when we are no longer here to provide help when it's needed? Where and how will our child live? Will he or she have enough money to sustain a decent quality of life?" Other questions parents may ask themselves focus on the estate planning process itself: "How do I know what I am planning is going to work? Do I have enough money to hire a lawyer and write a will? Do I even have anything to leave my children?" These are very difficult questions for parents to consider and difficult ones to answer. When a child has a disability be it mild, moderate, or severe parents have concerns about that child's future. This NEWS DIGEST is directed towards addressing these concerns. The information provided in this document is relevant both to families whose child is already independent or is expected to be so, and to families whose child will need moderate or extensive support or supervision throughout life.

Estate Planning
Estate planning is a process whereby a person's objectives for management and disposition of his property are analyzed and action is taken to accomplish those objectives. Here are some of the areas that estate planning addresses: Who should get my money and property when I'm gone? The needs of one's spouse, children and others must be weighed against one another. This can be particularly difficult if there are children by prior marriages or a property settlement agreement with a current or former spouse. Is there enough money to provide for my family? Particularly the young people, the adequacy of one's life insurance program should be reviewed. Who will manage the estate? This is a critical problem if there are handicapped or minor beneficiaries. Who should be guardian of minors or handicapped beneficiaries?
Are there tax-saving opportunities?

Your Durable Power of Attorney

Guardianship and Conservatorship

Why Plan Your Estate? The knowledge that we will eventually die is one of the things that seems to distinguish humans from other living beings. At the same time, no one likes to dwell on the prospect of his or her own death. But if you postpone planning for your demise until it is too late, you run the risk that your intended beneficiaries those you love the most may not receive what you would want them to receive whether due to extra administration costs, unnecessary taxes or squabbling among your heirs. TOP Your Durable Power of Attorney For most people, the durable power of attorney is the most important estate planning instrument availableeven more useful than a will. A power of attorney allows a person you appoint your "attorney-in-fact" to act in your place for financial purposes when and if you ever become incapacitated.

Family Issues in Estate Planning
Jean W. Bauer
Estate planning is important for individuals who wish to exert some control over how their property is distributed before and after death. Family issues are often ignored in the estate planning process and sibling rivalries can intensify if there is a lack of planning and little communication among family members about property transfer. Studies have shown that over 20% of intergenerational transfers add to sibling rivalries. In order to avoid negative outcomes of estate planning (family members not speaking to one another, lawsuits, or strained relationships), families need to consider the human factors.
Where To Begin the Discussion
The first rule in estate planning is that the owner has the right to decide what is done with the property. It is important to clarify the legal aspects of ownership. Once it is clear who owns what, communication can help transfer the property smoothly either before or after death. Problems develop when the owner does not accept the right of ownership, and with it the responsibility of property transfer. Many persons either die without a will, called intestate , or without having discussed the arrangements with the affected family members. In the case of joint ownership, all owners need to communicate their desires with each other.

Pet animals play an extremely significant role in the lives of many individuals. People own pets for a variety of reasons – they love animals, they enjoy engaging in physical activity with the animal such as playing ball or going for walks, and they enjoy the giving and receiving of attention and unconditional love. Research indicates that pet ownership positively impacts the owner’s life by lowering blood pressure, reducing stress and depression, lowering the risk of heart disease, shortening the recovery time after a hospitalization, and improving concentration and mental attitude. See A Dog’s Life (or Cat’s) Could Benefit Your Own , San Antonio Express-News, May 18, 1998, at 1B (explaining how some insurance companies lower life insurance rates for older owners of pets).
