    Introduction [Top of Page] Historical perspective: On 29 May 1991, ISAIAS Afworki, secretary general of the People's Front for Democracy and Justice (PFDJ), which then served as the country's legislative body, announced the formation of the Provisional Government in Eritrea (PGE) in preparation for the 23-25 April 1993 referendum on independence for the Autonomous Region of Eritrea; the referendum resulted in a landslide vote for independence, which was proclaimed on 27 April 1993.     Eritrea - Government
    Eritrea became independent on May 24, 1993 under the control of the Eritrean People's Liberation Front, led by Issaias Aferwerki, which has since renamed itself the People's Front for Democracy and Justice. Membership of the United Nations was granted in August 1993. In 1997 the Government established a temporary Constituent Assembly; and on May 23 adopted the Constitution, authorising political pluralism and instituting a presidential regime, with a President elected for a maximum of two five year terms. The President would appoint a Prime Minister and judges of the Supreme Court. A transitional National Assembly was empowered to act as the legislature until such time as legislative elections can be held.

    GOVERNMENT AND POLITICAL CONDITIONS
    Eritrea's Government faced formidable challenges following independence. Beginning with no constitution, no judicial system, and an education system in shambles, it wasrequired to build institutions of government from scratch.
    On May 19, 1993, the PGE issued a proclamation regarding the reorganization of the government. The government was reorganized, and after a national, freely contested election, the National Assembly, which chose Isaias as President of the PGE, was expanded to include both EPLF and non-EPLF members. The EPLF established itself as a political party, the People's Front for Democracy and Justice (PFDJ). The PGE declared that during a 4-year transition period, and sooner if possible, it would draft and ratify a constitution, prepare a law on political parties, prepare a press law, and carry out elections for a constitutional government.
    In March 1994, the PGE created a constitutional commission charged with drafting a constitution flexible enough to meet the current needs of a population suffering from 30 years of civil war as well as those of the future, when prospective stability and prosperity would change the political landscape. Commission members traveled throughout the country and to Eritrean communities abroad holding meetings to explain constitutional options to the people and to solicit their input. A new constitution was ratified in 1997 but has not been implemented, and general elections have not been held. The government had announced thatNational Assembly elections would take place in December 2001, but thosewere postponed and new elections have not been rescheduled.

The present government includes legislative, executive, and judicial bodies. The legislature, the National Assembly, includes 75 members of the PFDJ and 75 additional popularly elected members. The National Assembly is the highest legal power in the government until the establishment of a democratic, constitutional government. The legislature sets the internal and external policies of the government, regulates implementation of those policies, approves the budget, and elects the president of the country. The president nominates individuals to head the various ministries, authorities, commissions, and offices, and the National Assembly ratifies those nominations. The cabinet is the country's executive branch. It is composed of 17 ministers and chaired by the president. It implements policies, regulations, and laws and is accountable to the National Assembly. The ministries are agriculture; defense; education; energy and mines; finance; fisheries; foreign affairs; health; information; labor and human welfare; land, water, and environment; local governments; justice; public works; trade and industry; transportation and communication; and tourism.

    Head of government: President Issaias Afwerki President Issaias Afwerki. President Issaias Afwerki and his cabinet of 16 ministers, regional governors and other officials form the 24-member State Council, the executive branch of the Eritrean government, chaired by the president. An unicameral 150-member National Assembly which comprises 75 Central Committee members of the ruling PFDJ, together with 75 others (representatives elected by the general population, of whom at least 11 must be women, and 15 members representing Eritreans living abroad) form the legislative branch of the democratic government of Eritrea. The National Assembly establishes the domestic and foreign policies of the government, regulates the State Council's execution of these policies and approves the country's budget. The National Assembly elects the president directly. The judiciary consists of courts at national (Supreme Court), regional (10 provincial courts), and village levels (29 district courts). Special Sharia courts subjugate to the Muslim population, following Islamic Sharia law in family cases.
