Related Links Attorney General Mike Cox Announces Relief on Energy Bills March 12, 2004 LANSING – Consumers Energy customers will avoid rate hikes ranging from $25 to $200 per year for the average payer if an administrative law judge’s recommendation is adopted by the Michigan Public Service Commission, Attorney General Mike Cox announced today. Cox said two cases involving Consumers Energy Company in litigation at the Michigan Public Service Commission would, if approved by the commission, avoid a $138 million per year rate increase and also credit ratepayers by $11 million this year. “With natural gas prices at all-time highs, these savings are important for working families and individuals who find it hard to pay the winter heating bills and still make ends meet," Cox said. In the first case, an administrative law judge issued a proposed decision, recommending dismissal of a Consumers Energy requested increase of $138 million per year for natural gas service. In agreeing with Cox, the judge found that the request should be dismissed because evidence fails to adequately support the increase; that the Commission could not adequately protect customers if Consumers Energy’s actual costs do not increase by 199% as the Company projected; and that the evidence shows Consumers Energy is already earning in excess of its MPSC-authorized income level. “I applaud the judge’s proposal that Consumers Energy was not entitled to its rate hike,” Cox said. “We will be filing papers with the MPSC urging the commission to affirm the ALJ's finding and rejecting the rate increase.”
