Mud/Musk Turtle Group
General Description
This group includes ten species with legal protection in at least one state and one Federally threatened species (flattened musk turtle). The collective range for these 10 environmentally sensitive species is widespread throughout the central, southeastern, and Atlantic coastal regions of the United States. Mud and musk turtles are found in almost any quiet water within their range to include swamps, wetlands, sinkholes, rivers, creeks, ponds, lakes, reservoirs, etc. Mud and musk turtles are placed in a separate group because of morphological and behavioral differences as well as the diversity of aquatic systems inhabited. Diet varies somewhat geographically but consists primarily of aquatic invertebrates. Habitat destruction is mainly attributed to declines in mud and musk turtle populations.     The Columbia River Compact The Columbia River Compact is charged by congressional and statutory authority to adopt seasons and rules for Columbia River commercial fisheries. In recent years, the Compact has consisted of the Oregon and Washington agency directors, or their delegates, acting on behalf of the Oregon Fish and Wildlife Commission (OFWC) and the Washington Fish and Wildlife Commission (WFWC). In addition, the Columbia River treaty tribes have authority to regulate treaty Indian fisheries. When addressing commercial seasons for salmon, steelhead, and sturgeon, the Compact must consider the effect of the commercial fishery on escapement, treaty rights, and sport fisheries, as well as the impact on species listed under the Endangered Species Act (ESA). Although the Compact has no authority to adopt sport fishing seasons or rules, it is an inherent responsibility of the Compact to address the allocation of limited resources among users. This responsibility has become increasingly demanding in recent years. The Compact can be expected to be more conservative than in the past when considering fisheries that will impact listed salmon and steelhead.     • SUMMARY MOST RECENT DEVELOPMENTS BACKGROUND AND ANALYSIS SUMMARY The 107 th Congress may consider whether to reauthorize and amend the Endangered Species Act of 1973 (ESA). Major issues in recent years have focused on whether to incorporate further protection for property owners and reduce regulatory impacts, or whether to increase the protection afforded listed species. The ESA has been one of the more contentious environmental laws. This may stem from the strict substantive provisions of this law, which also can affect the use of non-federal lands. Under the ESA, certain species of plants and animals (both vertebrate and invertebrate) are listed as either "endangered" or "threatened" according to assessments of the risk of their extinction. Once a species is listed, powerful legal tools are available to aid the recovery of the species and the protection of its habitat. The ESA is administered by the Fish and Wildlife Service (FWS) for terrestrial and freshwater species and some marine mammals, and by the National Marine Fisheries Service (NMFS) for marine and anadromous species. The U.S. Geological Survey's Biological Resources Division conducts research on species for which the FWS has management authority.
