    One of the best-known responsibilities of the Department of Natural Resources is the regulation of wild animals through the Division of Fish and Wildlife. With a few limited exceptions, the responsibility includes all wild animals.
    A "wild animal" is one that lives in the wild or is not domesticated. Both native species and species brought into Indiana from other states or countries are subject to regulation. An "animal" is defined by statute to include "all mammals, birds, reptiles, amphibians, fish, crustaceans, and mollusks."

    ENDANGERED SPECIES ACT OF 1973
    Overview. The Endangered Species Act provides broad protection for species of fish, wildlife and plants that are listed as threatened or endangered in the U.S. or elsewhere. Provisions are made for listing species, as well as for recovery plans and the designation of critical habitat for listed species. The Act outlines procedures for federal agencies to follow when taking actions that may jeopardize listed species, and contains exceptions and exemptions. The Endangered Species Act also is the enabling legislation for the Convention on International Trade in Endangered Species of Wild Fauna and Flora, commonly known as CITES . Criminal and civil penalties are provided for violations of the Act and the Convention. Congress found that various species of fish, wildlife and plants in the U.S. have been rendered extinct and others depleted to the point of being in danger of or threatened with extinction. Congress declared that: depleted species are of aesthetic, ecological, educational, historical, recreational and scientific value; the U.S. has pledged to conserve various species facing extinction pursuant to several international treaties and agreements; encouraging states and other interested parties, through federal financial assistance and a system of incentives, to develop conservation programs meeting national and international standards is a key to meeting international commitments and to safeguarding the nation's heritage in fish, wildlife and plants.

Be it enacted by the People of the State of Illinois, represented in the General Assembly: Section 5. The Illinois Endangered Species Protection Act is amended by adding Section 5.5 and changing Section 11 as follows: (520 ILCS 10/5.5 new) Sec. 5.5. Incidental taking. (a) The Department may authorize, under prescribed terms and conditions, any taking otherwise prohibited by Section 3 if that taking is incidental to, and not the purpose of, the carrying out of an otherwise lawful activity. No taking under this Section shall be authorized by the Department unless the applicant submits to the Department a conservation plan.     Threatened Species and Threatened Ecological Communities
    Australia is home to more than one million species, many of which are found nowhere else in the world. About 85 per cent of flowering plants, 84 per cent of mammals, more than 45 per cent of birds, and 89 per cent of inshore, temperate-zone fish are endemic - that is they are only found in Australia. Changes to the landscape and native habitat as a result of human activity has put many of these unique species at risk. Over the last two hundred years many species of plants and animals have become extinct. For the other species of plants and animals whose survival is threatened a range of management and conservation measures are in place. The Australian Government is working in partnership with state, territory and local governments, non-government organisations, tertiary institutions and community groups to ensure the protection of our native species. The Australian Government mechanism for national environment protection and biodiversity conservation is the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). The EPBC Act provides for:
