CAFTA Must Include Strong Protection for Workers' Rights (New York, December 4, 2003) Workers' human rights in El Salvador are systematically violated by employers while the government disregards or even facilitates the abuses, Human Rights Watch said in a report released today. From December 8-12, El Salvador will be participating in the final round of negotiations for the U.S.-Central America Free Trade Agreement (CAFTA), a proposed trade pact with profound implications for labor rights.     On February 20, 2004, President George W. Bush notified Congress of his intent to sign the U.S.-Central America Free Trade Agreement (CAFTA)-an accord that the United States recently negotiated with Costa Rica, El Salvador, Guatemala, Honduras, and Nicaragua. According to U.S. law, the president must wait ninety days from the date of notification before signing the agreement and can send it to Congress for a vote any time thereafter.

President, vice president, and Council of Ministers (cabinet) comprise executive branch. President directly elected for five-year term and may not be reelected; also serves as constitutional commander in chief of armed forces. Unicameral, sixty-member Legislative Assembly constitutes legislative branch. Judicial branch headed by Supreme Court of Justice; below Supreme Court are chambers of second instance, courts of first instance, and justice of the peace courts. Magistrates appointed by Legislative Assembly to fixed terms. Governors of departments (states) appointed by president; mayors and municipal council members directly elected. Military exerts political influence, particularly on issues relating to national security, but active-duty military personnel constitutionally prohibited from seeking office. Politics: Long characterized by military rule supporting dominance of economic elite, in late 1980s political system still adapting to demands for free elections, representative democracy, and more open public discourse. Civil conflict between government forces and Marxist guerrillas greatly exacerbated political polarization rooted in historical dichotomy between wealthy elite and impoverished and excluded majority. In late 1980s, the two major political parties were the moderate, center-left Christian Democratic Party (Partido Democrata CristianoPDC) and the right-wing Nationalist Republican Alliance (Alianza Republicana NacionalistaArena). As of late 1988, PDC held presidency, but Arena had one-seat majority in Legislative Assembly.

    Government The government of El Salvador is republican, representative and democratically elected. It is divided into three branches: the Executive, the Legislative Assembly, and the Supreme Court. The President is elected by popular vote for a period of five years, a term starting and expiring on June 1st. The President may not serve a consecutive second term. The President appoints the members of his Cabinet and his Ambassadors abroad. The Chief Justice of the Supreme Court is appointed by the Legislative Branch, while the other justices are elected by all approved and practicing lawyers of the country.     Workers' human rights in El Salvador are systematically violated by employers while the government disregards or even facilitates the abuses, Human Rights Watch said in a report released today. From December 8-12, El Salvador will be participating in the final round of negotiations for the U.S.-Central America Free Trade Agreement (CAFTA), a proposed trade pact with profound implications for labor rights. The 110-page report, Deliberate Indifference: El Salvador's Failure to Protect Workers' Rights , documents serious violations of workers' human rights and examines the role of the government. It features case studies in the private and public sectors, in manufacturing and service industries, and concludes that workers face an uphill battle to exercise their rights, regardless of the sector. Three of the highlighted companies supplied internationally known, U.S.-based apparel corporations. Human Rights Watch found that employers delay salary payments, fail to pay overtime due, deny mandatory bonuses and vacation payments, and pocket workers' social security contributions, preventing them from receiving free public health care. Most pervasively, employers use myriad tactics to violate workers' right to freedom of association.
