  • FRAUD from the NHTSA: Police report that of all accidents are "alcohol related", but after pedestrians, passengers, bicyclists, and other nondrivers who are the reason for an accident being classified as "alcohol involved" are removed, only of all accidents involved a driver with a bac greater than .10%. A German study confirms the "Grand Rapids Study": if all drivers had a safety record equivalent to drivers with a bac = 0.04 ('The Gold Standard'), the US would have 17,670 fewer traffic fatalities each year. While MADD publicly proclaims that they "saved 67,000 lives since our program began", the loss to society due to their program exceeds the benefit by 135 times. Outlawing women drivers would save 11 times as many lives than if MADD's campaign could be 100% successful. The accident rate of sober women drivers is equivalent to that of men drivers with a BAC between 0.12 and 0.14. Fatalities classified by NHTSA as "alcohol involved" decreased 7,452 over a decade, but non-alcohol-related fatalities increased 3,029.

    Each year, alcohol-related crashes in the United States cost about $51 billion (Blincoe et al. 2002).
    Most drinking and driving episodes go undetected. In 2001, more than 1.4 million drivers were arrested for driving under the influence of alcohol or narcotics (FBI 2001). That’s slightly more than 1 percent of the 120 million self-reported episodes of alcohol–impaired driving among U.S. adults each year (Dellinger et al. 1999).

    CDC recommends primary enforcement safety belt laws as an effective way to increase the use of safety belts—the best protection against serious injury or death in a crash.
    PRESS CONTACT:
    Office of Communications CDC, National Center for Injury Prevention and Control Motor vehicle crashes are the leading cause of death among persons aged one to 34 years in the United States. Safety belt use ranges from 52% to 92% in the 50 states and District of Columbia (DC). This study examined safety belt use in the United States and found that belt use averaged 85% in states with primary enforcement safety belt laws compared with 74% in states with secondary laws. Primary laws allow police officers to ticket motorists solely for being unbelted. Safety belts are the best protection against serious injury or death in a crash. CDC recommends primary enforcement safety belt laws as an effective strategy to increase belt use. Currently, 20 states and DC have primary laws in place.

Drunk driving is a significant contemporary public health problem that sho uld receive the attention of health care practitioners, including physician assistants (PAs). More than half of all traffic fatalities are a result of alcohol-related crashes. Despite the recognition of the relation between alcohol consumption and traffic fatalities resulting from drunk driving, health practitioners have not led the call for effective methods of prevention. In fact, much of the credit for the reduction in the total number of alcohol-related traffic deaths " from 25,170 in 1982 to 23,351 in 1988 - can be given to the efforts of groups such as Mothers Against Drunk Driving (MADD).
    (2) What is particularly distressing is the realization cited by the 1988 Surgeon General"s Workshop on Drunk Driving, that "in most jurisdictions, fewer than one in 1,000 [drunk drivers] are apprehended [for driving while intoxicated]. Unless something is done to deter offenders who have not been arrested, they will continue to drive impaired and will be involved in approximately 18,000 alcohol-related fatalities each year."

    Zero tolerance for alcohol usage by drivers under the age of 21 years.
    A driver under 21 years old is guilty of DUI if his alcohol concentration is 0.02 grams or more. Lower alcohol level to commit a per se DUI.
    Mandatory jail time for all DUI violators.
    All DUI violators, upon conviction, spend time in jail. An offender who has not had a conviction arising from a DUI arrest during the previous five (5) years shall spend a minimum of twenty- four (24)hours in jail.       You asked for a brief summary of (1) the changes made in Connecticut's drunk driving laws by 2002 legislation and (2) the administrative per se license suspension process. You also wanted to know the current sanctions that apply to convictions for drunk driving, manslaughter in the second degree with a motor vehicle, and assault in the second degree with a motor vehicle. 2002 CHANGES TO DRUNK DRIVING LAWS It is against the law to drive a motor vehicle (1) while under the influence of alcohol, drugs, or both or (2) with an "elevated blood alcohol content" (BAC). The former offense may be prosecuted with or without any direct evidence of a person's BAC. For the latter, under the prior law, someone over age 21 was considered to be driving with an elevated BAC if he was found to have a . 10% BAC for a first offense or a . 07% BAC if he had a previous conviction for drunk driving. Someone under age 21 is considered to be driving with an elevated BAC at . 02% or more.
