Superintendent, District of Columbia Public Schools INTRODUCTION According to Title VI of the Civil Rights Act of 1964, "No person in the United States shall, on the ground of race, color, ornatlonal origin, be excluded from participation in, be denied the benefits of; or be subjected to discrimination under any program or activity receiving federal financial asslstance." Related Federal Regulations state, "School systems are responsible for assuring that students of a particular race, color, or national origin are not denied the opportunity to obtain the education generally obtained by other students in the system" (33 Federal Register, 4956). This law has been specifically interpreted as applying to school children classified as non- or limited-English proficient (NEP/LEP) by reason of having an other-than-English home language background. Such a condition is held to preclude the student from an equal learning opportunity in an all-English-medium classroom ( Lau vs. Nichols

Sam Gilliam Prints Available
The Children's Law Center is very pleased to make available a small number of fine art prints by the internationally recognized artist Sam Gilliam, made in collaboration with master printmaker Lou Stovall, both D. C. residents.  The silkscreen print, entitled ARS, is approximately 29" H by 20" W.  The print is offered for $1000, of which one half may be treated as a charitable gift.  It is unframed and is accompanied by documentation concerning its creation.  For more information about the print or for a picture of the print please contact Tricia Branson at 202.467.4900 ext. 521 or email tbranson@childrenslawcenter.org

An Analysis of The District of Columbia: Education Tax Credit Initiative
by E. G. West E. G. West is a professor of economics at Carleton University in Ottawa, Canada and the author of numerous works on the economics of education. Among his books are Non-Public School Aid: The Law, Economics and Politics of American Education; The Political Economy of American Public School Legislation; Education and the State: A Study in Political Economy; and The Economics of Education Tax Credits. Executive Summary On October 13, 1981, the District of Columbia Court of Appeals ordered the city's elections board to place an educational tax credit initiative on the November 3rd ballot. This action cleared the way for a referendum that could establish the first such program in any American city. For the first time in the twentieth century all families would be given the effective freedom to choose schools for their children. This is a privilege that has been enjoyed before only by those families that can afford to "pay twice" for schooling, once through their conventional tax payments, and once through the direct tuition charge at a private school.
