General Legislative Provisions
This first part of the review examines statutory provisions that have implications for, but do not necessarily address directly, students with disabilities or special education. Various provisions in state statutes grant charter schools varying levels of authority to govern themselves and to make decisions regarding the operation of the schools, including decisions related to personnel, curriculum, and expenditures. The extent of a charter school's operational autonomy will have an impact on how special education programs are implemented in these schools. As described in the following paragraphs, statutory provisions that give higher levels of autonomy include ones that allow or require charter schools to (1) operate independent from local school districts, (2) make their own personnel decisions, (3) be exempt from state and district education laws and regulations, (4) assume liability for their actions, and (5) receive their funding directly from the state. fax: (302) 892-3253 History: Marbrook Elementary School opened in September of 1966. The school's design includes 2 large hexagons with 28 classrooms. A third, smaller hexagon houses the gymnasium. Marbrook is one of fourteen elementary schools in Red Clay. The student population is made up of Kindergarten, 1st, 2nd, 3rd, 4th, and 5th graders. Currently, the school also includes 4th and 5th graders in the District's Bilingual Program serving students throughout New Castle County. Marbrook graduates may go on to: Stanton, A.I. duPont, H.B. duPont, and Cab Calloway Middle Schools for 6th, 7th, and 8th grades.. Mission Statement: Marbrook Elementary School adheres to the philosophy that each child has intrinsic worth. Marbrook children will develop the values of honesty, integrity and responsibility in an environment that fosters curiosity, tolerance, cooperation, and positive self-esteem. In a series of meetings, the Sussex County Planning and Zoning Commission has tweaked the recommendations it is forwarding to County Council for the update of the county's Comprehensive Land Use Plan. Council will hold a public hearing on the plan update on Tuesday, Oct. 1, 2002, at 6 p.m. in the CHEER Center in Georgetown. Council must finalize the update of its 1997 CLUP in October. The latest proposal removes wording allowing a maximum density of two units per acre in the ESDA and replaces it with wording that allows density up to the maximum allowable density of the underlying zoning district. That means developers could still obtain higher densities through upzonings in the ESDA, most of which is currently AR-1 with a maximum density of two units per acre.
