Introduction The due process provisions of the Individuals with Disabilities Education Act (IDEA) guarantee the right of any party to a hearing to be "accompanied and advised by counsel and by individuals with special knowledge or training with respect to the problems of children with disabilities" [34 CFR §300.509(a)(1)]. This phrase has been the focus of litigation in which charges of unauthorized practice of law were brought against advocates who represented families of children with disabilities in Delaware. Project FORUM at the National Association of State Directors of Special Education (NASDSE), under its Cooperative Agreement #H326F000001 with the U. S. Department of Education Office of Special Education Programs (OSEP), worked with Perry Zirkel, University Professor of Education and Law at Lehigh University in Bethlehem, PA, to examine this issue through a survey of state directors of special education.

Delaware Association of School Administrators The Unfunded Costs of Federal Mandates
In 1975, Congress passed a law that required programs and services for children with disabilities. Fifteen years late, in 1990, this Act became known as the Individuals with Disabilities Education Act (IDEA). This law mandates all children, ages birth to 21, receive a free appropriate public education in the least restrictive environment. At that time, Congress promised the states that they would provide 40 % of the costs to meet the mandates required in this law. Even with the $1 billion increase proposed by President Bush, Congress is would still be providing only 19.5 % for every child enrolled in IDEA. Who has paid the difference for this federal shortfall for Delaware students who are identified under IDEA for the past 29 years? In our state it has fallen on the taxpayers of Delaware. If Congress and President Bush maintain annual increases at this level, full funding at 40% would not be achieved until 2035. Students should not have to wait an additional 30 years for Congress to keep its 29-year-old promise. In 2002, Congress passed President Bush's education initiative, No Child Left Behind (NCLB). This extension of the Elementary and Secondary Education Act is the most sweeping nationalization of school policy in the nation's history. The law's basic objectives were simple and the concept of providing the best education for ALL children and helping them reach high standards is a noble goal that must be fulfilled. Unfortunately the regulations promulgated by the U. S. Department of Education have been so restrictive and confusing, that states are just starting to grasp the real costs of these federal mandates.

Paraeducator Technology
The No Child Left Behind Legislation of the Bush administration has had far reaching ramifications. One of those ramifications centers on the need for a highly qualified paraprofessional (i.e. teacher's assistant, instructional assistants, paraeducator) in every classroom. The actual regulations of the law stipulate that every paraeducator who provides instructional support in a Title 1 classroom and who is hired after January 2002 must have:
1. completed two years of study at an institution of higher education OR
2. obtained an associate's (or higher) degree OR
3. met a rigorous standard of quality and been able to demonstrate through a formal state or local academic assessment, knowledge of and the ability to assist in reading, writing and mathematics. The regulations also stipulate that any paraeducator hired before January 2002 working in a school supported with Title 1 funds must meet these requirements by January 2006. At the present time, these requirements only apply to paraeducators in Title 1 schools. However, there are many indications that when the IDEA federal legislation is reauthorized, the paraeducators that work with special education students will also be required to meet the standards of NCLB

The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis.   • Conservation Districts, counties, municipalities, and State agencies may seek delegation of four program elements relating to the implementation of the statewide sediment and stormwater program. Delegation may be granted by the Secretary for review and approval of sediment and stormwater management plans, inspection during construction, subsequent maintenance inspection, and education and training. Program elements that are delegated shall be implemented according to Chapter 40 and these regulations.
  • The Secretary, or his designee, shall grant delegation of one or more program elements to any Conservation District, county, municipality, or State agency seeking delegation that is found capable of providing compliance with Chapter 40 and these regulations. The final decision regarding delegation shall be made only after an opportunity has been provided for public review and comment. Initial consideration regarding delegation of program elements shall be given to the Conservation Districts. The Conservation Districts, having unique capabilities and area wide responsibilities are in ideal positions to coordinate and implement local sediment and stormwater programs.
  • Requests for delegation of more than one program element may be accomplished by the submission of one request for all the elements requested. A concern by the Department over one element will not jeopardize delegation of other requested program elements.
