    Posts: 72 What's an IEP? (and other special needs) My husband and I are being considered for the adoption of two siblings in Colorado (we're from Indiana, which I've heard has a tough person in charge of ICPC!).
    Anyway, their profile is a little vague, so I was hoping someone could define the medical terms in "plain English" for us:
    1. "The children's developmental challenges are met with an Individualized Education Plan." (What does this mean? Would they be behind academically, or is it physical/developmental?)
    2. They "...have difficulty focusing on one activity at a time" and "take medication and receive therapeutic services." (For what? Adhd? Something else?)
    3. They also "receive weekly physical, speech, and occupational therapies to help them with coordination, muscle tone, and speech impediments."

    Last Updated: 8.23.03 SPECIAL EDUCATION Individuals with Disabilities Education Act of 1990 (IDEA) is a federal law which guarantees all students with disabilities between the ages of 3 through 21 the right to a free appropriate public education designed to meet their individual needs. It also offers protection for the rights of students with disabilities and their parents/guardians or educational surrogate parents. The Indiana Special Education rules, known as Article 7, Rules 3-16, provide the legislative and department of education guidelines for implementing special education programs in Indiana, effective January 8, 1992. Article 7 regulates special education programs and related services provided by the public schools as well as the state operated and state supported programs. Greater Lafayette Area Special Services, better known as GLASS, is a special education cooperative sponsored by Lafayette School Corporation, Tippecanoe School Corporation, and West Lafayette Community School Corporation. General educators and special educators work together to implement the responsibilities of public schools defined in Article 7. Parents are also involved in every step of planning educational services for a student with a disability.

    By Phil Stinson, Esq. Parents of children with special needs are often confronted with problems relating to the delivery of nursing services while their child is at school. On rare occasions, without the provision of such services, it is impossible for a student to attend school on a regular basis. This situation can be highly disruptive to family operations, as parents struggle to juggle the impossible burden of work obligations, while, at the same time, taking the time to personally provide the services for the child. On March 3, 1999, the U.S. Supreme Court addressed this issue in Cedar Rapids Community School District v. Garrett F. The Garrett F. Court did not address how the 1997 Amendments to the IDEA impact on the issue of providing school nursing services for children with special needs (because the issue before the Court dealt with facts and law prior to the enactment of the revisions to the special education laws in 1997). In 1997, Congress amended the IDEA to clarify that public educational agencies (local school districts) are the payors of last resort whenever another public agency has a funding responsibility to an exceptional child.     Subchapter III. Persons With Disabilities
    § 3120. Right to receive public education. The State shall provide, in the school districts of the State, or in other state institutions and agencies or in special programs and private agencies as established or approved by the Department with the approval of the State Board, that each disabled person as defined in this chapter shall receive a free and appropriate public education designed to meet his or her needs. The Department of Education shall be the agency responsible for the implementation of this required provision. (61 Del. Laws, c. 190, § 7; 71 Del. Laws, c. 180, §§ 148, 148A.) § 3121. Special classes and facilities. § 3122. Identification and reporting of disabled person. § 3123. Supportive services and residential programs. (a) Any school district administering a program for autistic children may provide from its own personnel or contract with another state agency or a private service provider if necessary for appropriate supportive services, including, but not limited to, respite care, physical, art and music education, psychological services, language and speech therapy, physical and occupational therapy. The supportive services to be provided shall be based upon a program for each child as approved by the Department of Education; provided, that the State Board may review any objection to the Department's decision. The school district designated by the Department with State Board approval as the administering agency for a statewide program for autistic pupils shall annually submit in its budget a request for funds for such services.
