      Oregon's Death with Dignity Act
      On October 27, 1997 physician-assisted suicide became a legal medical option for terminally ill Oregonians. The Oregon Death with Dignity Act requires that the Oregon Health Services (OHS) monitor compliance with the law, collect information about the patients and physicians who participate in legal physician-assisted suicide, and publish an annual statistical report. The Oregon Death with Dignity Act, a citizens' initiative, was first passed by Oregon voters in November 1994 by a margin of 51% in favor and 49% opposed. Immediate implementation of the Act was delayed by a legal injunction. After multiple legal proceedings, including a petition that was denied by the United States Supreme Court, the Ninth Circuit Court of Appeals lifted the injunction on October 27, 1997 and physician-assisted suicide then became a legal option for terminally ill patients in Oregon. In November 1997, Measure 51 (authorized by Oregon House Bill 2954) was placed on the general election ballot and asked Oregon voters to repeal the Death with Dignity Act. Voters chose to retain the Act by a margin of 60% to 40%.

    DEATH WITH DIGNITY PREVAILS! On Wednesday, May 26, 2004, the Ninth Circuit Court of Appeals issued a resounding rebuke of John Ashcroft - characterizingg his attack on the Death with Dignity law as "unlawful and unenforceable." Though Death with Dignity has won this second round against a fervent opponent, an appeal is very likely. Death with Dignity may end up before the Supreme Court before this is all over. Since it isn't over until this attorney general sings, we continue to say, BACK OFF! Attorney General John Ashcroft, in pursuing the DWD law, has ignored the will of Oregonians, the position of respected editorial boards, the fears of healthcare providers, the increased national interest in similar end-of-life care reform, AND a 2002 decision by a U.S. District Court judge. Consider this:
    • Ashcroft has been told unequivocally, that his move to overturn Oregon's law would "stifle an ongoing, earnest and profound debate" concerning physician-hastened death; For 6 straight years, statistics compiled by an independent state agency have demonstrated responsible, modest, use of the law; Polls, both national and local, continue to demonstrate overwhelming support for Oregon-style laws;

    Truly respecting death and its inevitability brings, paradoxically, a relaxing of the fear of death, along with a heightened sense of the importance of life and of what we choose to do with the time we have. The fact that any particular person is going to die or has already died is no ones fault it is a necessary part of being alive. Excessive fear of death distorts lives, and seems to be responsible for many of the more bizarre and inhumane excesses of our American medical system. In our search for sustainable, effective, respectful health care practices, ideas that could contribute to a sane and compassionate integrated health care system, we've found nothing as simple, basic, workable and cost effective as coming to terms with death and the process of dying something we can do as individuals, as families, as communities and as a culture. The issues we need to face to prepare for our own death, or that of someone we love, are mostly the same, whatever we believe about what, if anything, will follow this life. Whether you believe you will live again in another body, with another personality and history and so on, or that your life will continue in one or another of the heavens or hells described by various religions, or that when you die, that's it whatever you believe about what happens next death itself is relatively simple.
