Notice Regulations Amending the Canadian Wheat Board Regulations Statutory Authority Canadian Wheat Board Act Sponsoring Department and Sponsoring Agency Department of Public Works and Government Services and Canadian Wheat Board REGULATORY IMPACT ANALYSIS STATEMENT Description The draft Regulations would amend the definition of "miscellaneous crops" in section 2 of the Canadian Wheat Board Regulations . Under the existing Regulations, "miscellaneous crops" means crops seeded on the land referred to in an application, except grain and perennial forage. The amendment would change the definition of "miscellaneous crops" to mean crops seeded on the land referred to in an application, except wheat, oats, barley, rye, flaxseed, rapeseed, canola and perennial forage. The amendment will become effective on the date on which the Regulations are registered. Alternatives The amendment to the definition of "miscellaneous crops" is suggested by the Standing Joint Committee for the Scrutiny of Regulations because it is of the opinion that the term "grain" in the current Regulations is inconsistent with the ordinary use of the word. The Committee argues that crops such as corn and triticale would be included in "grain" within the ordinary sense of the word, and therefore would be excluded from the "miscellaneous crops" category. However, this would be contrary to the intent of the definition of "miscellaneous crops" in the Regulations, which is intended to include all crops other than wheat, oats, barley, rye, flaxseed, rapeseed, canola and perennial forage as miscellaneous crops. | |
