The recent decision of the Sri Lankan government to re-introduce the death sentence adds to the already very bad human rights record of the country. The argument that the increased crime rate requires the reintroduction of the death sentence does not stand up to examination. There are fundamental failures in the criminal investigations and prosecution system in Sri Lanka that allow criminals to remain free, however serious their crimes. The hangman can become a substitute for proper criminal investigators and competent prosecutors. The present situation of increased crimes must blamed on the criminal investigation authorities and on the prosecuting department, which in Sri Lanka is the Attorney General’s department. However, the relationship between these two departments themselves is inherently defective. As it exists now, criminal investigation is entirely the function of the police and if they fail to investigate, the prosecutors can wash their hands by saying that there is no evidence with which to prosecute

Iraq Contracting Rep. Waxman and other members are seeking information on the Iraqi contracting process. Rep. Waxman and other members of Congress have been seeking information on contracts entered into by the Administration for reconstruction and development work in Iraq, including several billion dollar contracts with a subsidiary of Halliburton Corporation. Many questions have been raised about the Iraq contracting process, including questions on the seemingly inflated prices charged by Halliburton to import gasoline from Kuwait into Iraq and Halliburton's admission of kickbacks to company officials. In light of these and other concerns, the Defense Department Inspector General has referred the Halliburton fuel contract to the Department's Defense Criminal Investigative Service for possible criminal investigation. Rep. Waxman has called on Chairman Davis to initiate a congressional investigation into waste, fraud, and abuse in the Iraq contracting process.

January 19, 2004: 8:29 AM EST By Mark Gongloff , CNN/Money Staff Writer NEW YORK (CNN/Money) - The Pentagon has asked its criminal unit to investigate allegations that Halliburton Co., the oil field services company once run by Vice President Dick Cheney, overcharged the U.S. government for fuel delivered to Iraq, three U.S. lawmakers said Friday. On Friday, Sen. Joseph Lieberman, D-Conn., Sen. Henry Waxman, D-Calif., and Rep. John Dingell, D-Mich., said the Defense Department's inspector general had referred the matter to its Criminal Investigative Services unit. According to the congressmen, the inspector general, Joseph Schmitz, decided the matter warranted a criminal investigation. "Your staff ... indicate[d] that the nature of the referral involved matters most appropriately investigated by experienced criminal investigators, rather than civil auditors," the congressmen said in a letter to the inspector general that summarized a Thursday briefing by Schmitz's staff.

$3.37 Billion in Fines Reduced to $10 Million in Tax-Deductible Donations Consumer advocates today asked California Attorney General Bill Lockyer to investigate charges that Insurance Commissioner Chuck Quackenbush shielded State Farm and two other insurance companies from $3.37 billion of dollars in fines the largest ever assessed against insurance companies in the United States in exchange for $10.75 million in contributions to non-profit organizations and to his own political committees.
In a formal request issued today, the Foundation for Taxpayer and Consumer Rights stated that Mr. Quackenbush appears to have violated a number of state laws. It urged the Attorney General to seize documents and interview all relevant California Department of Insurance (CDI) staff to determine whether the misconduct involved criminal wrongdoing.
FTCR's action is the latest in the "Insurancegate" scandal which began last week with a Los Angeles Times report that insurers had made donations which ultimately repaid Quackenbush family political loans. Yesterday's

WASHINGTON - Commissioner Charles 0. Rossotti today announced a sevenpoint plan to improve the Internal Revenue Service's Criminal Investigation Division (CID). "This is part of my long-term commitment to effect fundamental change at the IRS to ensure fairness of treatment and give the American people the quality service they deserve," Rossotti said. The seven-point action plan is part of an ongoing assessment of IRS activities that Rossotti began when he assumed office in November 1997. In February, Rossotti appointed former Comptroller General Charles Bowsher to head an independent review of the IRS Inspection Service. In March, he created a special program to implement the hundreds of recommendations to improve the IRS's treatment of taxpayers and the service it provides them. In recent months, concerns have been raised about the activities of CID. "The Criminal Investigation Division of the IRS plays a pivotal role in fighting tax evasion, and it is critical that its operations be beyond reproach," Rossotti said. "We must address these concerns in a thorough, fair and objective fashion." "I fully support Commissioner Rossotti's efforts to take aggressive actions to improve the Criminal Investigation Division at the IRS," said Treasury Secretary Robert E. Rubin. "These steps will increase accountability and openness at the IRS and are a part of our continuing commitment to delivering to the American people the IRS they deserve an agency that respects taxpayer rights while collecting the revenue due." U.S. launches criminal investigation into records in BSE case The U.S. government has begun a criminal investigation into whether records may have been falsified in the country's first and only case of mad cow disease, the Agriculture Department's inspector general said Wednesday. In a separate investigation, the General Accounting Office is checking the feed industry's compliance with a Food and Drug Administration's rule aimed at keeping the infectious protein blamed for the disease out of cattle feed. The criminal investigation is moving alongside a non-criminal review of the Agriculture Department's response to the mad cow case, the department's inspector general, Phyllis Fong, told a House of Representatives subcommittee. Ms. Fong said the criminal investigation focuses on whether the infected Holstein cow truly was a "downer" animal unable to stand or walk when it was slaughtered Dec. 9 in Moses Lake, Wash. The department initially said the cow was a downer, and that was why it was tested for bovine spongiform encephalopathy, or BSE. Downers have a higher risk of the brain-wasting disease.

(SACRAMENTO) – Attorney General Bill Lockyer today announced closure of the California Department of Justice investigation into energy consultants who arranged long-term electricity contracts for the state Department of Water Resources, finding no evidence of criminal conflict-of-interest violations in the contracts they made.
"After an exhaustive review of documents and extensive interviews, no evidence was found that the energy consultants or department employees arranging the power contracts for California were serving two masters in violation of Government Code section 1090," Lockyer said. "If there had been evidence found, I would not have hesitated to file criminal charges for violations of the conflict-of-interest rules for government contracting."
The investigation was launched after receiving complaints that energy consultants hired by the state in response to last year's energy crisis had violated Government Code section 1090 because of prohibited financial interests in the energy contracts that they arranged. The Attorney General's criminal investigation focused on potential criminal violations of Government Code section 1090 for which he is the primary enforcement officer. Allegations of conflicts of interest under the Political Reform Act were referred earlier for review to the Fair Political Practices Commission, which has primary enforcement responsibility under the Act.
