Conflict Management Programs in Institutions of Higher Education
Dear Colleagues, What is happening on college campuses throughout the continent? What types of conflict management programs exist on college and university campuses? Are they all mediation programs, or judicial programs? What exists on campuses? That was the underlying purpose of the survey that was the source of the information in this report. Prior to writing and editing Conflict Management in Higher Education , a New Directions in Higher Education volume for Jossey-Bass (Winter 1995), Dr. William Warters and I surveyed campuses throughout North America.. An appendix of that volume lists programs, contact people and some information. This report is an extension of that survey, providing additional information which could not be included in there. We used the Internet, conferences, mailing lists and other avenues to get the survey to as many individuals and institutions as possible. What you read here is the result of those surveys, based on the information provided by the respondents. New Conflict Management programs begin almost every month as people on campuses realize the value of alternative forms of dispute resolution. And so it is impossible to have a complete list of the programs now in existence. This is the list of those who initially responded to the questionnaire. After taking the information from the questionnaire, Matthew Brophy, a student working with me, sent the entry to everyone to confirm the information.

Injection drug users, their sex partners, and their children are at high risk for acquiring HIV infection and other bloodborne diseases. The risk for disease transmission in the United States is partly the result of restricted access to sterile injection equipment. A. Supreme Court cases: License Tax Cases , 72 U.S. (5 Wall.) 462 (1866): Several states criminally punished transactions in liquors and lotteries, probably either with or without license. Congress then enacted certain internal revenue acts which licensed liquor sales and lotteries. Defendants, conducting illegal state businesses in these fields, did not obtain federal licenses and were indicted; they defended saying Congress can't legalize by license an illegal state activity. Court held that the licenses did not permit conduct of business, but were merely taxes:
"But very different considerations apply to the internal commerce or domestic trade of the states. Over this commerce and trade Congress has no power of regulation nor any direct control. This power belongs exclusively to the states. No interference by Congress with the business of citizens transacted within a state is warranted by the Constitution, except such as is strictly incidental to the exercise of powers clearly granted to the legislature. The power to authorize a business within a state is plainly repugnant to the exclusive power of the state over the same subject. ... Congress cannot authorize a trade or business within a state in order to tax it," 72 U.S., at 470-71.
"But it is not necessary to regard these laws as giving such authority. So far as they relate to trade within state limits, they give none and can give none," 72 U.S. at 471.

I. Opening remarks and introductions
The Honorable James A. Endicott, Jr., convened the meeting at 9:15 a.m. There was a quorum of Statewide Health Coordinating Council (SHCC) members present. In order to comply with the Texas Open Meetings Act, a SHCC meeting was called to order.There was not, however, an intent to conduct SHCC business. Judge Endicott welcomed Council and work group members, then provided background information for the workgroup. On November 9, 2000, representatives from state agencies and institutions of higher education met to discuss how to better coordinate telemedicine/telehealth issues in Texas. At this meeting, a decision was made to create a Texas Unified Telemedicine/Telehealth State Plan. There are three objectives for this plan:
  • Ensure that benefits of telemedicine/telehealth technologies are maximized in Texas Ensure that the State does not waste resources Identify and secure needed resources
Judge Endicott also reviewed the assumptions that will guide plan development:
  • There is a need in Texas for a telemedicine/telehealth plan The SHCC is an appropriate body to develop that plan The eight elements identified at the November 9 meeting are the key elements of the plan
