RSS Feeds OUR AFFILIATES Friday, May 14, 2004 Supreme Court: Health board can't order water systems to fluoridate By REBECCA COOK THE ASSOCIATED PRESS OLYMPIA A health board cannot order all the water systems within its jurisdiction to fluoridate their water, the state Supreme Court ruled yesterday. The Tacoma-Pierce County Board of Health adopted the fluoridation rule in October 2002, saying it would save millions of dollars in medical costs and prevent dental problems in children. A group of residents, cities and private water companies challenged the rule in court. They argued that the health board had overreached its authority, that the fluoridation order amounted to an illegal tax, and that it would force unwanted medical treatment on some citizens. The Supreme Court ruled that state law specifically gives water districts not local health boards the authority to decide whether to fluoridate their water.

  • Locate your local District Court by searching through the phonebook or online. Be certain to look for the state district court, as opposed to a United States District Court. State district courts are where most people have their cases heard by a judge and/or jury when they are involved in a dispute. State district courts handle (have initial jurisdiction over) misdemeanors where punishment does not exceed one year, including arraignment, setting and acceptance of bail, trial and sentencing. State district courts also conduct preliminary examinations in felony cases. State district court personnel are accustomed to facilitating visits from the schools and are approachable.     Contents of Curriculum Unit 84.02.08:
    To Guide Entry
    This unit is intended for students in grades 8-12. There are three major objectives I wish to accomplish with the writing of this unit. They are: 1) to acquaint students with the Athenian court system 2) to give students an overview of the American court system 3) to have students realize that regardless of a court’s shortcomings and problems that these legal institutions are necessary to maintain a peaceful society. The Athenian courts discussed in this unit existed in the second half of the fifth century B.C. and the first half of the fourth century B.C. It should be stated that this is a controversial period in the sense that many facts of this era are still in dispute among historians. I have thus attempted to state only facts about courts in this period that can be substantiated.
    THE ATHENIAN COURT SYSTEM
    In order to study the ancient Athenian court system it is essential to examine the two legal codes, the Draconian and the Solonian Codes of Law, which had a great influence on the courts in Athens. For the decisions handed down by these courts were based, at least in theory, on these written laws. It must be stated at this point that all the laws attributed to Dracon and Solon were not necessarily written by these individuals. Any laws that were written during the period of time in which the Athenian society was under the influence of the laws of either Dracon or Solon were attributed to them, whether or not they had actually written them.

  • The judge of each division will make his own trial or other settings and will furnish counsel and the clerk of the concerned court with a notice, list or calendar of settings. All settings made by the court shall be binding upon all parties and attorneys properly noticed. No setting shall be vacated except upon good cause shown by written motion.

  • The judges of divisions one, two, three, four, five and six are primarily responsible for all cases in San Juan County. The judge of division two is primarily responsible for all cases in McKinley County. In the event of recusal or excusal in division two the case will be assigned to one of the remaining judges of the district by random selection. In the event of recusal or excusal in the other divisions, the case will be assigned by random selection to one of the judges sitting in San Juan County until all of such judges are exhausted by recusal or excusal, and only then assigned to division two. Cases assigned to a particular judge will not be heard by another judge without consent of the judge to whom the case is assigned, except in case of an emergency and when the judge to whom it has been assigned is not available.

    USA AND JAPAN Issue No. 25. Winter 1998 The Judicial Systems of Japan and the US Fireworks sparked the closing ceremonies at the 1988 Olympic Games in Calgary, Alberta Japan's judicial system is quite different from that of the United States. Article 76 of Japan's Constitution states: "The whole judi-cial power is vested in a Supreme Court and in such inferior courts as are established by law." Japan thus has a unitary court system. The entire judicial system for civil, criminal and administrative matters is within the jurisdiction of a single court hierarchy (Fig. 1); there are no separate federal, state, county and munici-pal systems as in the United States.
    The Saiko Saibansho or Supreme Court of Japan is headed by a chief justice appointed by the emperor after designation by the cabi-net, and 14 cabinet-appointed justices. It decides matters of law. The Supreme Court sits either as a full court (daihotei) or in divisions (shohotei). The full court is composed of 15 judges who hear constitutional cases for which there are no precedents as well as those deemed by a division to be significant. Three divisions composed of five justices each receive and hear all other cases. Similar to the US Supreme Court, Japan's Saiko Saibansho is the court of last resort "with power to deter-mine the constitutionality of any law, order, regulation or official act," in the words of the Constitution. All cases heard are appeals, how-ever, as the court does not possess original jurisdiction like its US equivalent.

    Powhatan's General District Court
    Virginia's Court System Powhatan Correctional Center Courthouse Powhatan’s graceful Greek revival courthouse, restored to its 19 th century elegance, houses a three court complex, the Office of county clerk and the sheriff. The County circuit Court, part of the 11 th Judicial Circuit of Virginia, is presided over by a Judge. This court hears criminal cases and cases on appeal from the General District and Juvenile courts. All cases brought before the Judge are heard in the remodeled circuit court room. A separate court room, the General District court hears cases involving misdemeanors, traffic offenses and civil suits in which damages sought are under $15,000. Extradition hearings are also conducted in this court as well as preliminary hearings in felony cases. Judge of the General District Court also presides over General District courts in Amelia, Nottoway, and Dinwiddie counties. General District Court meets at 9:30 a.m. each Monday.

    High Court Hears Same-Sex Marriage Cases
    Attorneys, media representatives, and members of the public watched oral arguments in two same-sex marriage cases, Lockyer v. City and County of San Francisco and Lewis v. Alfaro , argued before the California Supreme Court on May 25. Due to high interest in the cases, the high court permitted live broadcast of the hearing and provided a live feed to viewers in the auditorium of the Milton Marks Conference Center in the Hiram W.
