Small Claims Procedure
If you have a claim or dispute with another person or company for $10,000.00 or less, and have asked the person or company for the money and they refuse to pay part or all of it, you can sue them in small claims court which is called the General Sessions Court. You don't have to be a United States citizen to file a claim in small claims court, but you do have to be at least 18 years old, and if you are younger, you must have a guardian, parent, relative, or adult friend to sue on your behalf. To file a claim in small claims court, you must first visit the office of the clerk of your local General Sessions Court. The clerk will give you certain papers you must fill out and file, along with a small fee. Generally, the small claims action must be filed where the person you are suing lives, where the firm does business, where the contract was signed, or where the accident took place. You should also know the full name and present address of the person or company to be named as defendants before filing your claim with the court. You will need to know exactly how much money you are claiming, the reason why you are claiming the money, and the date and place the dispute arose. If your claim involves a tenant as a defendant, you may make a small claims court claim for unpaid rent and you may also seek eviction. However, there are certain legal requirements which must be met by you prior to filing the action for eviction.

Voting by members, procedure, general or special court-martial instructions, contentexceptionsjudge to rule on all questions of law. 40.165. 1. Voting by members of a general or special court-martial on the findings and on the sentence shall be by secret written ballot. The junior member of the court shall in each case count the votes. The count shall be checked by the president, who shall forthwith announce the result of the ballot to the members of the court. 2. The military judge and, except for questions of challenge, the presiding officer of a court-martial without a military judge shall rule upon all questions of law and all interlocutory questions arising during the proceedings. Any such ruling made by the military judge upon any question of law or any interlocutory question other than the factual issue of mental responsibility of the accused, or by the presiding officer of a court-martial without a military judge upon any question of law other than a motion for a finding of not guilty, constitutes the ruling of the court. 3. Before a vote is taken on the findings, the military judge shall in the presence of the accused and counsel, instruct the members of the court as to the elements of the offense and charge them:

Short Title [
These rules may be cited as the Tax Court of Canada Rules (General Procedure).
Definitions [
"Act" means the Tax Court of Canada Act Loi "assessment" includes a determination, a redetermination, a reassessment, and an additional assessment; ( cotisation "counsel" means every person who by virtue of subsection 17.1(2) of the Act, may practise in the Court; ( avocat "counsel of record" means the person who by virtue of sections 30 to 34 is the counsel of record for a party; ( avocat inscrit au dossier "Court" means the Tax Court of Canada; ( Cour "fax" means to transmit a facsimile of printed matter electronically or a document so transmitted; ( "Hague Convention on Service Abroad" means the Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters signed at the Hague on November 15, 1965; (

    Introduction to arbitration Advantages of arbitration Among the available dispute resolution alternatives to the courts, arbitration is by far the most commonly used internationally. The reasons for this are clear: Final, binding decisions While several mechanisms can help parties reach an amicable settlement - for example through mediation under the ICC ADR Rules - all of them depend, ultimately, on the goodwill and cooperation of the parties. A final and enforceable decision can generally be obtained only by recourse to the courts or by arbitration. Because arbitral awards are not subject to appeal, they are much more likely to be final than the judgements of courts of first instance. Although arbitral awards may be subject to being challenged (usually in either the country where the arbitral award is rendered or where enforcement is sought), the grounds of challenge available against arbitral awards are limited. International recognition of arbitral awards Arbitral awards enjoy much greater international recognition than judgements of national courts. Over 130 countries have signed the 1958 United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards, known as the "New York Convention". The Convention facilitates enforcement of awards in all contracting states. There are several other multilateral and bilateral arbitration conventions that may also help enforcement.
