U.S. Customs Cracks Down on Software Counterfeiting in Georgia Microsoft Also Launches Statewide Software Integrity Campaign to Protect Consumers ATLANTA Aug. 16, 2000 - Microsoft Corp. and the U.S. Customs Service today announced recent criminal actions taken against two Georgia-based businesses for the alleged distribution of counterfeit Microsoft software. To impede the distribution and flow of counterfeit software in the local Georgia market, Microsoft also launched its "Software Integrity Campaign." After executing search warrants at Compunet Systems of Griffin, Ga., and Tierra Computer Inc. of Doraville, Ga., U.S. Customs officials uncovered large quantities of counterfeit Microsoft software, including Office 2000 Professional Edition and the Windows "We appreciate the swift and professional work of the U.S. Customs Service in Atlanta, which led to uncovering these illegal actions," said Nick Psyhogeos, corporate attorney for Microsoft. "These dedicated law enforcement officials have taken effective steps toward stemming the growing tide of software piracy here in Georgia."

Looking for counterfeit goods, sheriff's deputies go bargain hunting.
Digging through piles of nondescript hats, T-shirts and sweatshirts at T-N-T Sports Wear, I soon struck shopper's gold. It came in the form of a baby-blue knit cap bearing that famous Ralph Lauren insignia, the tiny polo player so beloved by Yuppies. Only $2.50a steal of a deal. At least it would have been, except for one nagging problem. The tiny pony stitched into the cap was either an unusually well-endowed stallion or a mutant. Which leads us to our first tip for shopping the discount stores that cluster near Harry Hines Boulevard: Horses have four legs, not five.
Here's another: caveat emptor.
Just weeks after Dallas County sheriff's deputies raided the first of two neighborhood shops on January 22 on suspicion of dealing in counterfeit merchandise, the Dallas Observer visited several stores in the Northwest Dallas bargain-hunter's Mecca to see how large a dent the officers had made in the sale of ersatz goods. Deputies had confiscated $500,000 worth of allegedly counterfeit designer purses and apparel at Purse Mart and Royal Sports Wear, but was that enough to slow the trade in counterfeit and near-counterfeit goods elsewhere? Not a chance.

Nixon initiates legal action to stop sale of merchandise bearing fake Mark McGwire autographs
St. Louis Missouri Attorney General Jay Nixon today filed petitions with the St. Louis City Circuit Court asking for two temporary restraining orders to stop several businesses and individuals from selling baseball bats and other memorabilia bearing forged signatures of St. Louis Cardinals star Mark McGwire. "We believe these businesses are exploiting the immense popularity of Mark McGwire by peddling caps, bats, balls and other baseball merchandise purportedly signed by him, but which actually were not," Nixon said. "Not only did these actions defraud the fans and businesses that purchased the items, they also try to take advantage of Mr. McGwire, who does not sell his autograph or items with his autograph." One of the petitions is seeking a TRO against Events Made E Z Inc., of Boca Raton, Fla.; Edward Zuckerman, of Boca Raton; East Coast Collectibles Inc., of Doylestown, Pa.; Harris Pharmacy Inc., doing business as Sports Cards Etc., of Doylestown; and Harris Bogdnoff, of Doylestown.

Lancashire County Council's Trading Standards Department is preparing for an influx of counterfeit traders at the three Commonwealth Games cycling events to be held at the popular and picturesque area of Rivington, in the South of the County. The cycling events to be held in the area are free to watch and the organisers are anticipating a large number of spectators. Teams of Trading Standards Officers from Lancashire will attend the three events scheduled to take place at Rivington on 27th July, 29th July and 3rd August. Anyone caught selling unauthorised merchandise will have the goods seized with offenders facing fines and/or a maximum of 10 years imprisonment. Merchandising for the Commonwealth Games has been strictly controlled by Manchester City Council who have Trade Mark rights to a large range of products, which will be sold at the various events taking place throughout the North West. The official merchandise has a range of security devices incorporated to assist in the detection of fakes. County Councillor Tim Ormrod, Cabinet Member for Public Protection and Rural Affairs said:

Wal-Mart Stores achieved a milestone Friday in the use of radio frequency identification tags as cases and pallets marked with the product-tracking devices arrived at seven of the retailers' stories in the Dallas area. The tagged merchandise from eight consumer product manufacturers arrived at midnight from Wal-Mart's Sanger, Texas, regional distribution center. A total of 21 products were delivered in tagged cases and pallets out of the more than 100,000 products carried in a typical Wal-Mart "supercenter." While the number may seem small, the debut ushered in a new era in product tracking for the world's largest retailer, which operates 160 distribution centers and more than 3,000 stores. Last June, Wal-Mart told its 100 largest suppliers that it expected a certain percentage of cases and pallets affixed with RFID tags to arrive at Dallas-area stores starting in January 2005. Since then, 37 additional suppliers have joined the initiative.

The International AntiCounterfeiting Coalition ("IACC") strongly endorses H.R. 2511, the Anticounterfeiting Consumer Protection Act of 1995, and we urge the Subcommittee to act on this important legislation as quickly as possible. The IACC is a non- profit trade association comprised of more than 160 members that works to improve the protection of intellectual property rights and the safety of consumers from the threats posed by counterfeit products. When most Americans think of counterfeit activity, they picture a one or two person operation that sells fake sunglasses and watches on city street corners. In reality, counterfeiting is an international, multi-billion dollar crime dominated by organized crime syndicates. Legitimate businesses lose almost $200 billion in revenue each year. Their reputations are damaged by counterfeiting, and their employees lose jobs due to the decline in sales of legitimate goods. Counterfeit activity is growing at a rapid pace, because under current law, the penalties for counterfeiting are inadequate and rarely enforced. Because of the high profits and low risk involved, it has not taken long for organized crime to become significantly involved in counterfeiting operations. Organizations often use the easy money from counterfeiting to finance other high profile criminal activities.

As the early morning clouds break, Joe Hedrick and Chris Williams huddle in a motor coach, surrounded by colorful trailers selling souvenirs from popular NASCAR drivers in a lot across from Lowe's Motor Speedway. Almost four months have passed since racing icon Dale Earnhardt was killed at Daytona, and the two business friends are busy fending off bootleggers, folks quick to make a buck pushing unauthorized Earnhardt stuff. Hedrick is director of licensing for Dale Earnhardt, Inc. (DEI). Williams oversees track sales for Action Performance Companies, which holds trademark and merchandising rights to more than 20 of NASCAR's leading drivers including Earnhardt, Rusty Wallace and Jeff Gordon. Hustling counterfeit T-shirts and reports of trademark infringement aren't new to NASCAR, where drivers have their individual line of goods much like a NFL franchise or college athletic program. But it's been off the charts since Earnhardt's death, with anything bearing his name or the black No. 3 in huge demand and often at inflated prices.

The indictment is the result of six month investigation conducted by agents of the United States Immigration and Customs Enforcement (ICE), which began in August 2003 after the random examination of a shipping container consigned to XYZ Trading Corporation was found to contain counterfeit merchandise. The random inspection was conducted by inspectors of the Bureau of Customs and Border Protection (BCBP).
According to records of the Texas Secretary of State, Zheng Xiao Yi is the incorporator, registered agent and director of XYZ Trading Corp. created on March 1, 2002. XYZ Trading Corporation is located at 7018 Harwin Drive, Houston, Texas. Each count alleged in the indictment carries a maximum penalty of 10 years imprisonment and a $2 million fine, upon conviction.
