Title Action Taken In response to this growing problem and to the failure of our prior efforts to fight it, a committee made up of members of the Federal Enforcement Section was set up to find one or more proactive ways to eliminate the problem once and for all. The Problem The sale of counterfeit goods, an activity very often geared towards a young, uninformed clientele, has become a worldwide problem. Multinational companies specializing in the manufacture and sale of clothing or other products are not only suffering astronomical losses, but are also seeing their reputation tarnished. The sale of counterfeit items has flourished in the NCR, where conditions are very favourable to this activity. The trend towards brand-name clothing by manufacturers such as Nike, Fila, and Adidas is becoming more and more apparent, especially among young people. The Objectives After a few meetings, the members of the committee set concrete, measurable objectives. First objective : To invite representatives of the main companies being defrauded and the owners of the three local flea markets (Stittsville, Masson, and St-Laurent) to sit down with us so that we could make them aware of this growing problem and involve them in finding the most appropriate and acceptable solutions for everyone concerned. This was the most crucial step, because we had to interest and involve all the stakeholders in our project so that the problem was not merely ours, but theirs as well.

Detectives along with private investigators from National Trademark Investigations confiscated a total of 130,532 counterfeit Ragdoll Productions, Telletubbies, and Warner Brothers Tweety Bird items. This operation resulted in a total of 3 felony arrests. Three Korean-Americans were arrested in connection with this operation. " Major Brand Counterfeiting Ring Broken" Los Angeles: On September 10, 2003, investigators from the Los Angeles Police Department, assisted by the United States Custom Service, served search warrants at five locations in the downtown area. The service of the warrants resulted in the arrest of five individuals for counterfeit sales. In excess of $9.7 million dollars of counterfeit merchandise, including, but not limited to, Makita, DeWalt, Black and Decker, Sony, Canon, Rolex and pirated DVD’s were recovered. Representatives from the mentioned companies were in attendance to provide positive identification of counterfeit items. The investigation began when detectives from Organized Crime and Vice Division (OCVD) received complaints from the above companies. An undercover investigation in association with Investigative Consultants was initiated resulting in the purchase of numerous items of counterfeit merchandise. Power tools were not only relabeled but "UL" stickers (Underwriter’s Laboratory) were also placed on the tools indicating they had been inspected and certified as being safe to operate. Some of the items were also marked with "Home Depot" UPC price stickers. It appears that most of the "Look Alike" tools had been imported from China and then relabeled to be sold.

On 2003-12-11, the Royal Canadian Mounted Police, Toronto North Federal Enforcement Section executed a search warrant in Newmarket, Ontario. The RCMP acted upon information received that counterfeit merchandise was being sold to the public throughout the holiday season. Consumers are often unaware that they are purchasing counterfeit merchandise, as more and more knock-offs are making their way into reputable businesses.
"If the deal seems too good to be true, it usually is" stated Sgt. K.R. FLOYD, Sgt. in charge of RCMP's Toronto North Federal Enforcement Section. Two Arrested In Biggest Fake Merchandise Seizure In City's History
(New York-WABC, January 4, 2002) Millions of dollars of fake luxury-label items, like Fendi, Fubu and Hilfiger, were headed for the streets of New York City, until police smashed a major counterfeit operation in Queens Friday. They rounded up two suspects in what is believed to be one of the largest seizures of counterfeit luxury goods in the city's history. Lauren Glassberg reports from the Richmond Hill section of Queens with the story. Police were still unloading the merchandise from the Queens warehouse early Friday evening. They say they discovered the location after checking out a burglary tip. When they went to check out the tip they didn't find a burglary, instead they found a treasure trove of fakes.

They followed up their investigation with a nationwide survey to see how well informed shoppers are and if they were taking the necessary precautions to protect themselves from purchasing bogus merchandise. Their findings were surprising. Few shoppers knew what they needed to do to safeguard their hard-earned money and ensure that they were not being tricked by over zealous merchants.

According to Miles, Curtis Nathanial Yon of 119 Alcester Road in Goose Creek was arrested on Thursday in an undercover sting operation led by an investigator from the Secretary of State’s Office and assisted by the Berkeley County Sheriff’s Office and the Goose Creek Police Department. “I would like to commend the sheriff’s office, particularly Detective Mark Mason, and the Goose Creek Police Department’s Detective Sergeant William Kelley for their fine work in this operation,” said Secretary Miles. “Their professionalism and cooperation in this undercover buy enabled us to make one of the largest trademark violation busts in this state.” Secretary of State Jim Miles, whose office regulates trademark protection and enforcement, added that the sale of counterfeit goods hurts the manufacturer who provides quality goods and legitimate jobs in South Carolina and around the country. Among the merchandise seized were fake clothing items, watches, and accessories bearing the counterfeit likeness of brand names such as Polo, Tommy Hilfiger, Guess, Nike, Oakley, Rolex, Fubu, and Ray Ban. “The consumer wants to know that he is getting the quality associated with the brand name,” said Miles. “These counterfeit dealers are cheating our citizens two ways—by selling them fake merchandise and taking away jobs that a legitimate manufacturer and retailer tries to provide.”

Product counterfeiting operations continue to multiply as more criminals take advantage of high tax-free profits, the low risk of being caught, and minimal penalties if convicted. International organized-crime syndicates with deep pockets are now financing high-tech manufacturing networks engaging in counterfeiting and gray market crimes. Unfortunately, law enforcement officials lack the time, equipment and expertise to track down and stop counterfeiting schemers effectively.
Go to just about any street corner in any major city in the world. Chances are good that you’ll find an individual willing to sell you the latest designer product for a fraction of the retail price. Most times it’s obvious. After all, we know that the $25.00 Rolex watch or the pair of $10.00 Nike sneakers are probably counterfeit products, but in some cases the fraud is not so easy to detect. Why is counterfeiting so rampant? A few of the reasons include:

Globe-News Staff Writer Amarillo police seized four van loads of counterfeit merchandise Saturday during a raid at T-Anchor Flea Market, 1401 Ross St. No arrests were made, and no charges have been filed in the ongoing investigation, Sgt. Gerald Bailey of the Amarillo Police Department said. Two private investigators from Dallas initiated the raid after being hired by several companies to track down counterfeit merchandise being sold in the Amarillo area, said Lt. Perry Gilmore, supervisor of the APD theft squad. The private investigators checked various locations for counterfeits and then asked APD to assist in seizing the merchandise, Gilmore said. T-Anchor Flea Market was the only location where a significant amount of counterfeit merchandise was seized Saturday, he said. Gilmore said police now are sorting the merchandise, and it may be two or three weeks before investigators can determine the value of the seized goods or seek charges in the case. Investigators will ask for a court order, he said, to determine how to dispose of the merchandise.

The recordation with Customs of trademarks and tradenames registered with the U.S. Patent and Trademark Office gives the owner protection against the unauthorized importation of merchandise bearing those trademarks or trade names. "Counterfeit" merchandise is generally defined as merchandise that bears containing a false trademark which is identical or substantially indistinguishable from a registered trademark. A "confusingly similar" trademark resembles the genuine trademark so as to be likely to cause the public to associate the copy with the genuine mark. How Do You Get Customs To Enforce Your Company's Intellectual Property Rights?
As soon as the application is received and approved by Customs, the information is distributed nationwide to over 20,000 Customs officers located at the 301 ports of entry in the United States. The information, including a computerized three dimensional picture of the IPR, sets forth the terms and conditions of appropriate import of the IPR. After recordation, whenever documentation is presented to Customs at a port of entry regarding the import of the foreign merchandise, a Customs officer or Customs computer has the information needed to identify any suspicious goods, and physically examine them. Upon examination by an Inspector of the Trade Enforcement Team (TET), Customs may detain merchandise it believes may be counterfeit, for up to 30 days and issue the importer a detention notice. If the importer does not prove it is authorized by the IPR holder to import the merchandise, the cargo is seized. A Notice of Seizure is issued stating the reasons for the seizure, and setting forth the procedures to challenge the action. Customs' seizure rights extend to counterfeit merchandise merely transmitting the United States en route to third countries, or remaining under Customs bond in a Customs warehouse or foreign trade zone.
