General Tommy Franks worries the Constitution might not survive a WMD attack

November 27, 2003 Issue If worst comes to worst, those of us concerned that our civil liberties have been threatened since the knee-jerk passage of the US Patriot Act after Septemeber11, 2001 and the onset of the Iraq war-sequel, might find our usual opponents in officialdom actually agreeing with us. John O. Edwards, writing for the right-leaning website NewsMax.com , cites an interview with Gen. Tommy Franks, published in the December issue of Cigar Aficionado magazine, wherein the General expressed his belief that "if the United States is hit with a weapon of mass destruction ... the Constitution will likely be discarded in favor of a military form of government." Franks, the former commander of the military's Central Command and the man responsible for leading the US military operation to "liberate" Iraq is the first government official to predict that a breakdown of our form of republican government is contingent upon a major terrorist attack against the US or our allies. Although Franks wasn't able to pinpoint when a "casualty-producing" attack may occur, he said that such an event could cause "our population to question our own Constitution and to begin to militarize our country ... which ... then begins to unravel the fabric of our Constitution."

IRAQ: Kurds, Shiites criticise US-imposed constitution
Doug Lorimer While Washington is scrambling to keep Spain from withdrawing its contingent of 1300 troops from Iraq, it is threatened by a serious rift with another NATO ally, Turkey. Turkey is objecting to the interim constitution that the US has imposed on Iraq. Under the interim constitution, Iraqi Kurdistan, consisting of three provinces in the country's north where 4.3 million Kurds live, will become an autonomous region within an Iraqi federal republic. The Turkish government has repeatedly opposed any moves that might enhance self-rule in Iraqi Kurdistan. Turkey's 15.4 million Kurds would be encouraged to seek self-rule as a step toward an independent and unified Kurdistan.

Democratic Constitution Making Briefly . . .
  • We live in an era of constitution making. Writing a constitution is part of many peace processes. New nations and radically new regimes that seek democratic credentials make writing a constitution a priority. In a changing world, constitutional practice is also changing. Twenty-first century constitutionalism is redefining the long tradition of expert constitution making and bringing it into the sphere of democratic participation.
    How the constitution is made, as well as what it says, matters. Process has become equally as important as the content of the final document for the legitimacy of a new constitution.
    A right to public participation in democratic governance exists in international law. This right packs a moral punch but it lacks legal teeth and effective enforcement. Does this right extend from everyday governance to the process of constitution making? The United Nations Committee on Human Rights has recognized a specific right to participate in constitution making.
    Genuine public participation requires social inclusion, personal security, and freedom of speech and assembly. A strong civil society, civic education, and good channels of communication between all levels of society facilitate this process. Only a considerable commitment of time and resources will make genuine public participation possible.

Ohio Legislation and Documents
Bill Analyses and Status Report of Legislation are both publications of the Legislative Service Commission ( LSC ) and are available as part of this web site. A Bill Analysis is detailed narrative description of each bill that is scheduled for a hearing in committee, and is updated as the bill moves through the legislative process. LSC also tracks the status of each bill introduced during the General Assembly. The Status Report of Legislation is published weekly during periods in which the General Assembly is in session. The report lists all bills and resolutions introduced in the General Assembly as of the date of issue and their progress through the legislative process as of the end of the preceding week. It lists the dates on which any legislative action was taken on each bill or resolution. LSC performs a fiscal analysis of each bill and prepares a Fiscal Note based on this analysis. Fiscal notes estimate the effects of proposed legislation on state and local government revenues and expenditures. Local impact statements, which are included in fiscal notes, are required for bills that could result in a net additional cost to school districts, counties, municipalities, or townships. The only official publication of the activities of the Senate and House are the Journals of each chamber. The
