Corey, General Counsel Connecticut Credit Union Association 110 South Turnpike Road Wallingford, Connecticut  06492 Re:  Preemption of Connecticut Open-End Mortgage Law. Dear Mr. Corey: You have asked whether the Federal Credit Union Act (Act) and NCUA’s lending regulation preempt a Connecticut law that bars financial institutions from permitting borrowers to use credit cards to access a home equity line of credit (HELOC).  C ONN . G EN . S TAT . A NN . §49-2(c)(9)(C).  Our opinion is that, because the effect of this state law is to regulate the conditions of loans, lines of credit or credit cards, it is preempted, and the State of Connecticut may not require federal credit unions (FCUs) to comply with it. The Connecticut law permits advances under a mortgage for a “consumer revolving loan,” commonly known as a HELOC.  The issue is that the Connecticut law defines a consumer revolving loan as: [A] loan . . . which . . . does not authorize access to the loan proceeds by credit card or any similar instrument or device, whether known as a credit card, credit plate, or by any other name, issued with or without a fee by an issuer for the use of the cardholder in obtaining money, goods, services, or anything else of value on credit . . . .

Gordon There is a crisis in access to legal services in this country. According to the American Bar Association, each year 38 million low- and moderate-income Americans are closed out of the civil justice system because they cannot afford to hire a lawyer. In large part, this is due to the refusal of the bar to allow competition from any source, whether it is non-lawyers or out-of-state lawyers. Fortunately, the Connecticut legislature has taken a step toward solving this problem. Unfortunately, its solution only benefits 188 people-Governor John Rowland and the 187 members of the General Assembly-while leaving the other 3.5 million residents of the state subject to the existing protectionist regime. On March 10, the General Assembly unanimously passed an emergency bill allowing out-of-state counsel to work for the governor and the legislature on impeachment matters. It is ironic that the legislature used an "emergency" bill to provide for its own legal needs, but fails to recognize the real emergency inherent in the lack of access to the law for the average person. Restrictions on who can provide legal services need to be lifted across the board, not just for the impeachment investigation. No doubt the General Assembly and the governor have good reasons for employing out-of-state counsel. In the case of impeachment, it is likely that the attorneys best qualified to handle the issue are not from Connecticut. However, this is also true of attorneys in the fields of estate planning, divorce, corporate law, civil rights, employment or any other specialty. Consumers of legal services have a right to the service provider they feel is best for them. The legislature and governor are justifiably entitled to use attorneys from New York and Washington if they feel it best meets their needs. They should also be allowed to use the advice of a Yale University political science professor. So, too, should a resident of Greenwich be permitted to have a New York attorney, or even a non-lawyer, draft her will if that person would better serve her for reasons of quality, price or convenience.

[discussion began September 27, 1999] Beginning in October, police in Connecticut will be permitted to seize firearms from any person they have probable cause to believe poses "a risk of imminent personal injury to himself or herself or to other individuals." The statute authorizing this weapons seizure - the first of its kind in the U.S., and one of the toughest gun-seizure laws in force - was passed by the Connecticut legislature in June 1999 in the wake of a March 1998 murder-suicide by Matthew Beck, a 35-year old accountant who killed four people in the headquarters offices of the Connecticut Lottery before killing himself.
