CONNECTICUT Statutes of Limitations Statutory Cap on Attorneys' Fees Contributory or Comparative Negligence Periodic Payments ... Arbitration
Statutes of Limitations A medical malpractice action must be brought within two years from the date when the injury is first sustained or discovered or in the exercise of reasonable care should have been discovered, except that no such action may be brought more than three years from the date of the act or omission complained of. Conn. Gen. Stat. Ann. § 52-584 (West 1991). A wrongful death action must be brought within two years from the date of death, except that no such action may be brought more than five years from the date of the act or omission complained of. Conn. Gen. Stat. Ann. § 52-555 (West 1991). Connecticut's statutes of limitations do not provide an exception for a claimant's incompetence, including minority or insanity. Lopez v. United Nurseries, Inc. , 3 Conn. App. 602, 490 A.2d 1027 (1985). Contributory or Comparative Negligence Connecticut has adopted the doctrine of modified comparative negligence. Conn. Gen. Stat. Ann. § 52-572h(b) (West 1991). Under this doctrine, a claimant's action is barred if his negligence exceeds the combined negligence of all defendants. Otherwise, the claimant's recovery is diminished in proportion to his degree of negligence. Id Joint and Several Liability Connecticut has adopted a modified form of several liability. Conn. Gen. Stat. Ann. § 52-572h(c) (West 1991). Under this plan, joint tortfeasors are generally only severally liable; however, a claimant may seek relief from the court within one year from the entry of final judgment if any portion thereof has not been satisfied. Conn. Gen. Stat. Ann. § 52-572h(g) (West 1991). Upon such a showing, the court must re-allocate liability for the unsatisfied portion of the judgment based upon the other joint tortfeasors' relative degrees of fault.

    Love Makes a Family Responds to Attorney General Blumenthal's Letter to Governor Romney "This legal quagmire has been created by the disgraceful use of an outdated 1913 law which has never been applied in Massachusetts. This law was specifically created to prohibit the recognition of interracial marriages in Massachusetts. It was a discriminatory law in 1913 and it remains a discriminatory law today." Connecticut residents support the right of same-sex couples to marry. A March 2004 UConn poll showed that 49% of Connecticut voters support the right of same-sex couples to marry, compared to 46% who oppose. In a poll commissioned by Love Makes a Family released in November 2003, 58% of the voters said same sex-couples should have the right to enter into civil marriage.
