Faculty with full or part-time appointments in the Division have conducted research in end-of-life care issues, ethical decision-making, privacy and confidentiality, legal and ethical issues in HIV/AIDS policy development, AIDS and public health, public health law reform, the history of the Farm Services Administration health services, and human rights, among other topics. Listed below are recent research projects.
Advance Care Planning
This pilot study introduces second-year medical students and their community-based physician preceptors to an efficient and effective method for approaching advance care planning (ACP) for patients in the primary care office setting. Students and physicians speak with their patients about advanced care planning and explain the use of a proxy and living will. The program focuses on dissemination of advanced directives and advance care planning to patients in Connecticut via medical students and their primary care physician preceptors. Russia's New Drug Law in Effect: No Jail for Drug Users, Greater Penalties for Drug Traffickers As of today, Russian drug users and people in possession of small amounts of illegal drugs no longer face any jail time. Under previous Russian law, smoking marijuana or being caught with as little as one-tenth of a gram of it could bring a three-year prison sentence. But in a bald reversal of the Putin government's hard line against drug users enunciated only two years ago, the Russian Duma approved the changes in November, President Putin signed them into law in December, and they go into effect today.
In February 2002, the Putin government announced a tough, three-year strategy to crack down on drug sellers and users alike. When he presented the package to the Duma, then Interior Minister Boris Gryzlov called for a "total ban on illegal acts related to drugs" and tougher enforcement of the drug laws. "This is prompted by the drug situation that has arisen in our country over the past decade," Gryzlov said. "The development of legislation is lagging behind the rapidly deteriorating situation." At least give the Russians credit for being fast learners. The legislation Gryzlov dreamed of has been tossed in the dust heap of history, and this relatively progressive new law has instead emerged.

April 28, 2004 Connecticut State Supreme Court Justice Joette Katz . Connecticut State Supreme Court Justice Joette Katz will address the graduates at the School of Law commencement ceremony at 10 a.m. on Sunday, May 9, on the university quadrangle. Approximately 180 students are expected to graduate. "We are very honored that Justice Katz will be our commencement speaker," said Brad Saxton, dean of the School of Law. "She has been and continues to be an extraordinary public servant, and she is a terrific role model for our students. Justice Katz has also been a wonderful friend to our law school, and we are very pleased that she was willing to accept an honorary degree from the law school and address our graduating students and our other guests at our commencement ceremonies." Katz is a native of Brooklyn N.Y. She graduated from Brandeis University with a B.A. in 1974 and from the University of Connecticut School of Law in 1977.

Criminal Sodomy Statutes in Effect in 1868
Justice White noted, incorrectly, in Bowers v. Hardwick that sodomy was a crime in all 13 colonies at the time of the adoption of the Bill of Rights, and included errors in his history of the laws in existence at the time of the adoption of the 14th Amendment in 1868. The other historical error is that the sodomy laws in existence in 1868 did not, with two possible exceptions (Connecticut and Tennessee), recognize oral sex as a crime. Oral sex is what Hardwick performed to trigger his arrest. He lists the wrong laws for Arkansas Florida Kansas Maine ... Rhode Island , and Vermont , and omits sodomy laws in existence for the District of Columbia Idaho North Dakota and South Dakota (then known together as the Dakota Territory), and Wyoming , as well as a common-law reception statute in New Mexico Thanks to George Painter for these corrections. New Jersey Statutes 2C:51-1: Basis of disqualification or disability
Any legal disqualification or disability because of someone’s conviction of an offense or sentence on such conviction must be:
  • Necessarily incident to execution of the sentence of the court;
  • Provided by the Constitution or the Criminal Code;
  • Provided by a statute other than the Criminal Code, when the offense is defined by that statute; or
  • Provided by the judgment, order or regulation of a court, agency or official exercising a jurisdiction conferred by law, or by the statute defining such jurisdiction, when the offense, conviction, or sentence is reasonably related to the individual’s competence to exercise the right or privilege of which he is deprived.

Proof of a conviction as relevant evidence:
  • Upon the trial or determination of any issue; or
  • For the purpose of impeaching the convicted person as a witness is not a disqualification or disability for the purpose of this law.
