I took a medical ethics based approach to this panel. One of my follow panalists, Lisa Silverthorne Pruvis, took a practical, legal based approach (how would you deal with property rights and inheritance with clones). Larry Niven brought up a very good point regarding the production of brainless clones as a source of transplant organs. His question was, would the creation of brainless clone (say though pharmaceutical or genetic intervention) result in a non-human or a seriously mistreated human. I do not have an answer to this question. In my opinion, the real question here is weather we should be ruled by hope or fear. Nearly every technology can be applied for good or evil. Reproductive technologies in general and cloning from somatic cells in particular is no different. We can write policies and laws to encourage "good" uses and discourage "bad" ones, but ultimately there can not be progress without some risk. Interestingly, some of the arguments against cloning are based on science fiction literature. Particularly, David Rorvik's

Pro-cloning group claims to have embryos
Clonaid says this embryo is the result of cloning experiments. By Elizabeth Cohen and MIriam Falco CNN Medical Unit ATLANTA (CNN) A controversial group claims to be well on its way to creating the first human clone, CNN has learned. Clonaid, which operates a secret lab outside the United States, said Monday it had created cloned human embryos before Advanced Cell Technology, the Massachusetts lab that announced Sunday it had created embryos through cloning. Clonaid, unlike Advanced Cell Technology, wants to use its embryos to impregnate a woman and produce a clone. Advanced Cell Technology said it wants to keep its embryos at the microscopic stage and use them only in the production of medical treatments. CNN could not confirm Clonaid's claims since the group has not published its work.

Now cats may have more than nine lives. The company that funded the first successful cloning of a domestic cat two years ago has gone commercial. An e-mail sent in early February to the company's gene-banking clients offered to clone up to six cats. The cost? U.S. $50,000 each. Clients had less than a month to take advantage of the offer, which ended Friday, February 27. Preface
It is the balance between these various needs that drives the Jewish law discussion of all assisted reproductive technology and it is in that spirit that this is intended to be a preliminary analysis of the problem of cloning.
I. Introduction
An analysis of the implications of cloning found in Jewish law really contains within it three distinctly different problems in need of resolution. The first one discusses whether the cloning process is permissible ( mutar ), prohibited ( assur ), or a good deed ( mitzvah ). However, the determination of whether any particular conduct is good, bad or neutral is not dispositive in addressing the second issue: the familial status of an individual (re)produced through cloning in relationship to other humans generally, and other members of this person's "family" specifically. Finally, even when conduct is permissible or perhaps even a mitzvah, Jewish law recognizes that the (rabbinical) authorities of every generation have the authority to temporarily prohibit that which is permissible based on the perception that this intrinsically permissible activity could lead to other more serious violations.

But while critics say science is not yet ready to begin experimenting with human cloning, neither is most of the world. Cardinal blasts cloning plans
ROME, Italy Plans by scientists to clone the first human being have been condemned by a prominent Italian cardinal. An international group of fertility experts announced their proposals for human and so-called therapeutic cloning to help tackle a range of degenerative diseases. But Milan Archbishop Carlo Maria Martini said a person could not be created through technology. A human being has an "innate and natural" dignity, which should "not be violated in any way," the Italian news agency ANSA quoted him as saying. What's at stake in the 'cloning wars'?

Director, Center for Bioethics University of Minnesota (CNN) We may have gotten a glimpse this week of what's at stake in the "cloning wars" taking shape on Capitol Hill. News came out of London that an 18-month-old boy named Rhys Evans had been successfully treated by gene therapy for a deadly genetic defect in his immune system. Rhys was suffering from severe combined immune deficiency, SCID for short. It's a failure in the immune system caused by a single mistake in his genetic makeup. The disease is also known as "boy in the bubble" disease and was made famous by a movie starring John Travolta as a boy with the disease. Rhys' case and those of a few other children in France are the first successes in the longtime efforts to treat disease at the genetic level, done by inserting a corrected copy of the defective gene into their bone marrow. So what's the connection between gene therapy and the "cloning wars"? What may be at stake is the next generation of research on genetic diseases, since this is exactly the sort of research at issue in the cloning and stem cell research debates.

UK set to ban human cloning
LONDON, England Emergency legislation banning human cloning in Britain is being introduced the day after American scientists announced a breakthrough in creating human embryos. The new laws, drawn up to close a legal loophole in Britain after the High Court ruled that cloning humans was not illegal, would not have outlawed the American research. The private U.S. research company Advanced Cell Technology (ACT), based in Worcester, Massachusetts behind Sunday's breakthrough said its scientists had produced "preimplantation embryos" but were aiming to use them for research to treat disease, not to create a cloned human being. Human cloning easier than thought?
DURHAM, North Carolina (CNN) Cloning "may be less complicated in humans than in sheep" because of a subtle genetic difference between humans and most other animals, according to researchers at Duke University. The finding, published Wednesday in the journal Human Molecular Genetics, suggests that humans and primates might not be susceptible to the danger of clones growing dangerously large in the womb. "This is the first concrete genetic data showing that the cloning process could be less complicated in humans than in sheep," said Keith Killian, a molecular evolutionist at Duke University Medical Center who is the first author of the study. Some researchers who say it is not safe to clone humans have told CNN they fear those who do will use the Duke study to validate their claims that cloning a human will not create a grotesquely disfigured baby.
