Rights, Sociology, And Equality By Timothy Sandefur Liberty August 2001) Brown v. Board of Education: A Civil Rights Milestone And Its Legacy, by James T. Patterson. Oxford University Press, 2001. The chiliasm of 1960s liberals has left its constituents high and dry, yet they persist in scratching their heads and wondering why people just don’t seem to “care” anymore—and then blame “the system” rather than seeking the causes of their own failures. Consider, for example, James Patterson’s assessment of Clarence Thomas’ objections to the most important Supreme Court decision of the past half-century, Brown v. Board of Education . Thomas, according to Patterson, is “cool to integration” and has “long been critical of many arguments on behalf of Brown .” That’s true, but Patterson does not take the time to explain Thomas’ objection to Brown, even in a footnote. Brown v. Board of Education is one of the most misrepresented cases in legal history. It did not reverse Plessy v. Ferguson or the doctrine of “separate but equal,” on the basis of our natural equality under the law. Instead, it relied on questionable scientific research suggesting that black children were being harmed psychologically by their segregation from white children. It did not embrace the principles of John Harlan’s dissent in Plessy which argued that “our Constitution is color-blind, and neither knows nor tolerates classes among citizens. In respect of civil rights, all citizens are equal before the law. The humblest is the peer of the most powerful. The law regards man as man, and takes no account of his surroundings or of his color when his civil rights as guaranteed by the supreme law of the land are involved.”

    by Gary Puckrein The Dilemma of Slavery In 1776, the Founding Fathers of the United States laid out a compelling vision of a free and democratic society in which individual could claim inherent rights over another. Emancipation and Segregation Although its origins are complex, the immediate cause of the Civil War (1861-1865) was not the practice of slavery in the South, but the attempt of the Southern states to secede from the Union. In addition, the North refused to permit the expansion of slavery into the new territories of the West. As the bloody conflict became prolonged, however, Northern war aims shifted to the elimination of the institution of slavery itself, as well as the preservation of the Union. Origins of a Movement At the turn of the century, dissatisfied with the absence of racial equality, a group of Northern black intellectuals began to agitate anew for a restoration of civil rights.

Ralph Lazo in camp Former neighbors, classmates and "Manzanite" friends shared reminiscences about their Mexican/Irish American teenage friend who unexpectedly joined them on their train to the Manzanar internment camp. Two of Ralph’s children also related how they learned about their father’s experiences in camp. After lunch the participants viewed the Stand Up for Justice trailer.

    In modern societies contracts are enforced in two quite different ways: publicly, through the court system, and privately, largely through reputation. Friedman discusses two problems for conventional mechanisms of public contract enforcement in cyberspace. (i) An increasing fraction of commercial transacties will be between parties in different countries. The public enforcement of these contracts is more costly and uncertain than public enforcement within a single jurisdiction.(ii) Modern technologies such as public key encrtyption make possible an online world where many people do business anonymously, with reputations attached to their cyberspace, not their realspace, identities.

This paper must be 2-3 double-spaced pages in 10-12 point font. For this assignment only:
You must BOTH hand in a hard copy
AND e-mail Dr. Clifford with a Word file of the paper attached.
The file should be named "your last name, your first name."
Please also have your word file be single-spaced, even though your hard copy should be double-spaced.
The hard copy must be handed in during class, while the e-mail can arrive any time that day. For this paper, you must interview someone who is at least 60 years old. (So that they would have been at least 9-10 years old when Brown v. Board of Education was decided). I’m hoping there will be a mix of races represented by these interviews, so that we can get perspectives of what the civil rights era was like for African Americans as well as other groups. Your subject need not have lived in Maryland at the time, and perhaps will never have lived in Maryland. Your interview subject could be a family member, a neighbor, a friend, etc. If you belong to a church, synagogue, mosque or temple, think about interviewing someone from there. If you really have trouble finding someone, let me know as soon as possible and I will see if I can help you at all. Tell your interview subject the purpose of the interview: you are writing a short paper for a class, and the papers will then be posted on the class website as an archive of civil rights memories. In 1903, W.E.B. DuBois wrote, “The problem of the twentieth century is the problem of the color line.” 84 years later, legal scholar Derrick Bell wrote of race in America that, “It appears that my worst fears have been realized: we have made progress in everything yet nothing has changed.” By examining the work sociologists have done about the civil rights movement, residential segregation, contemporary discrimination, and black immigration, we will examine “the problem of the color line” in the twentieth century. We will read about and discuss how others have used race to exclude African Americans and deny them rights. This will also involve sociological analysis of how racism, sexism, class inequality, and other forms of discrimination have combined to help shape the experiences of African Americans. We will also examine how African Americans have challenged injustice and oppression in both formal and informal ways, and how social scientists have explained such resistance. Thinking about Bell’s quotation, we will question whether discrimination in America has improved, or if, instead, Bell is correct in arguing that “nothing has changed.” Will the problem of the

Reviews Table of Contents In 1958, an African-American handyman named Jimmy Wilson was sentenced to die in Alabama for stealing two dollars. Shocking as this sentence was, it was overturned only after intense international attention and the interference of an embarrassed John Foster Dulles. Soon after the United States' segregated military defeated a racist regime in World War II, American racism was a major concern of U.S. allies, a chief Soviet propaganda theme, and an obstacle to American Cold War goals throughout Africa, Asia, and Latin America. Each lynching harmed foreign relations, and "the Negro problem" became a central issue in every administration from Truman to Johnson. In what may be the best analysis of how international relations affected any domestic issue, Mary Dudziak interprets postwar civil rights as a Cold War feature. She argues that the Cold War helped facilitate key social reforms, including desegregation. Civil rights activists gained tremendous advantage as the government sought to polish its international image. But improving the nation's reputation did not always require real change. This focus on image rather than substancecombined with constraints on McCarthy-era political activism and the triumph of law-and-order rhetoriclimited the nature and extent of progress.

Craig Jenkins, Department of Sociology Introduction It has often been stated that the civil rights movement is the ideal movement to study when looking to test social movement theory. This is, in part, attributable to the struggle for civil rights being arguably the most important social movement of the 1950s and 1960s, and "clearly one of the pivotal developments of the twentieth century" (Morris, 1999). With this in mind, the findings of this inquiry should easily be generalizable to other movements such as the women’s movement and the environmental movement. My review of past literature delineates the major features of the theories I am testing, and some of the work done with each. These theories will be tested against the protest events of the civil rights movement from 1947 through 1997 to see which theory can best explain the ongoings of the movement. I feel that it is important to look at the civil rights movement beyond the legislative victories of the 1960s, since the struggle for equality is an ongoing battle.
