Rules that certain states follow in applying the death penalty were impacted by separate decisions of the Supreme Court in June. In one, the justices said that executing mentally retarded prisoners convicted of murder is excessive punishment. In the second, they declared it unconstitutional for judges, rather than jurors, to decide the factors that send a person to death row. Most analysts did not see the rulings as necessarily leading toward abolition of capital punishment. Those two decisions and other developments concerning the death penalty, said a Washington Post analysis on June 25, "could just as easily fit into an age-old American trend of embracing the death penalty while struggling to cleanse it of moral and intellectual conundrums." On June 19 the court ruled that executing mentally retarded inmates is cruel and "excessive" punishment. "We are not persuaded that the execution of mentally retarded criminals will measurably advance the deterrent or the retributive purpose of the death penalty," said Justice John Paul Stevens, who wrote the 6-3 decision. It is the first time the high court has ruled on such executions since 1989, when in a 5-4 opinion Justice Sandra Day O'Connor wrote that no "national consensus" existed on the issue.

Stephen Nathanson "Is the Death Penalty What Murderers Deserve?"
Nathanson argues against the proposition that just deserts leads to executions. He believes it is difficult to be able to know what people deserve, and setting up an institution to consistently deliver just deserts is different from the outcome in an individual case. The analogy he uses is putting a grade on essay exams and trying to decide between an A- and a B+. Randomness in some judging is acceptable, but discrepancies in the death penalty are not. A Catholic View of the Death Penalty

John 7:53-8:11 In the last 2 years our state has executed six people and our nation has executed 131 individuals. Since 1976, our country has executed 880 people ( ). 880 individuals, many of them, doubtless, were some of the most heinous monsters this world has ever seen and probably all of them were deserving of justice. Our legislatures have passed these death penalty laws and our politicians largely are supportive of them. The Supreme Court has ruled that the death penalty is legal and not cruel and unusual punishment. And it is supported by a large majority of Americans. So, the issue is easy, right? Not by a long shot. The story of the woman caught in adultery has interesting parallels today, but many of the specific details have changed. Instead of early in the morning, executions now usually occur late at night. They're not carried out by the religious authorities, but by the secular judicial system. Instead of coming before Jesus asking for mercy, the prisoners go before a judge, a jury, or a president or governor. The fate of the defendant, his or her life, lies with these individuals. They make the decision about whether or not these people live or die. What a responsibility! And like the woman, who is singled out for special punishment while the man is let off the hook, our society often singles out the poor, minorities, and the defenseless for execution. For example, 35% of all defendants executed are black, while blacks only make up around 12% of the overall population. Since 1976, 12 white men have been executed for murdering black victims, while 180 black men have been executed for murdering white victims (

Arguments For and Against the Death Penalty

Abstract
    Despite capital punishment having been abolished in Canada 20 years ago, the majority of Canadians continue to favour the death penalty as a sentencing option. In this study, a 2 x 6 design was employed to investigate the effects that argument position (for or against the death penalty) and type of justification for punishment (deterrence, morality, rehabilitation, incapacitation, economic, and possibility of mistake) have on participants' sentence recommendations for a defendant found guilty of first degree murder. Results indicated that only those arguments in favour of the death penalty, based on retribution, economics, and impossibility of mistake, were effective in influencing participants to recommend that the accused be sentenced to death. Compared to participants who recommended a life sentence, those who recommended the death penalty were found to have significantly higher scores on a measure of vengeance.
A lthough the Parliament of Canada abolished the death penalty as a sentencing option in 1976 (Amnesty International, 1987), a majority of Canadians (approximately 65-75%) have indicated that they would support a return of the death penalty (Reid, 1987). Furthermore, calls for the reintroduction of the death penalty by politicians and others occur frequently. As a result of the public's apparent support for capital punishment, and the possibility of its return, it is important to continue studying factors that influence people's attitudes regarding the death penalty.

What the Vatican has said The definitive Latin edition of the Catechism of the Catholic Church, issued in September 1997, states that although the death penalty would be theoretically permissible in instances when it is "the only possible way of effectively defending human lives against the unjust aggressor," such instances are "practically non-existent" in today's world, given the resources available to governments for restraining criminals. The Catechism language (click here for text) reflects the views of Pope John Paul II, expressed in his 1995 encyclical "The Gospel of Life."
More recently, at his Sept. 13, 2000 general audience in St. Peter's Square, the Holy Father expressed his hope "that there no longer be recourse to capital punishment, given that states today have the means to efficaciously control crime, without definitively taking away an offender's possibility to redeem himself."
In a homily at a Jan. 27, 1999 Papal Mass in St. Louis, Mo., he termed the death penalty "both cruel and unnecessary," and went on to say:
"The new evangelization calls for followers of Christ who are unconditionally pro-life: who will acclaim, celebrate and serve the Gospel of life in every situation. A sign of hope is the increasing recognition that the dignity of human life must never be taken away, even in the case of someone who has done great evil. Modern society has the means of protecting itself, without definitively denying criminals the chance to reform."

Every thing in Nature exhibits the Heavenly Father's extraordinary care for the well being of his intelligent creatures. Every provision has been made for the sustenance of man, and there are wise adaptations in the laws of Nature, to contribute to his preservation and happiness. Thus we see, in what sense the Almighty is the Savior of all men. Next, we shall proceed to the discussion of the question:

We may, indeed, have as exaggerated views of our own attainments in this our "age of reason", "march of mind", and brilliant advances into the mysteries of nature, as they had of themselves and their attainments. Posterity, too, may look back upon our age as we are wont to contemplate ages long since passed away, and wish, as "duteous sons, their fathers had been more wise." Certain it is, that we are not satisfied with ourselves, and that a spirit of inquiry, revolution and change is now abroad in the land, which no man can limit or restrain. We live in the midst of a great moral revolution. Opinions held sacred by our fathers, usages consecrated by the devotion of ages, institutions venerated by the most venerable of mankind are now subjected to the same cold, rigid analysis, and made to pass through the same unsparing ordeal, to which the most antiquated errors and the most baseless hypotheses of the most reckless innovators are now so /312/ unmercifully doomed. Few, indeed, of the most popular theories of the Pagan schools on the great subject of man's social and moral relations, have, when cast into this fiery furnace, like Shadrach, Meshach and Abed-nego, came out unscathed.     It must be borne in mind that the killing of a person guilty of grievous crime does not, in primitive society, belong to the class of deliberate ordinances enacted by the community. It is rather a form of the impulse of revenge, which the primitive institutions of all the older civilized nations first tolerate, and then regulate and uphold or limit (see B LOOD -R EVENGE ...     “The Rap: On Capital Punishment”
    This subject is very controversial but the name of my game is to address any issue with complete honesty and the ability to explain my thinking. Many times, I find that a discussion on capital punishment is confused by the introduction of other issues, which doesn’t allow us to be able to view capital punishment in absolute terms. The most controversial issue of our time, “Abortion; Pro-Choice vs. Pro-Life,” has practically nothing to do with capital punishment, yet is always presented as evidence of convoluted thinking by specific Americans.
    Here’s the way Capital Punishment is implemented in the United States:
    • My Experience as a Teacher
    The subject I taught at a Brooklyn Intermediate School was “Law.” Some of you may laugh because you know I was teaching a relatively heavy subject to children in Grades 6, 7, and 8. It was listed as a “minor pool,” the equivalent of an elective that one opts for in College. There wasn’t a real curriculum although others had taught it before and turned it into; teacher lectures, students listen and take notes, and teacher leads a regulated group discussion in the classroom, type of class.

It is clear from contemporary reports in the media, together with submissions made by such responsible agencies as Amnesty International, that the way in which civil authorities in a number of countries are using this most serious of punishments can in no way be reconciled with the principles of the United Nations instruments to which the governments of those countries have subscribed. In yet other jurisdictions, disproportionately high percentages of persons representing ethnic minorities among the executed raise disturbing doubts of yet another kind. Nor can one be indifferent to the body of evidence suggesting that, in a great many cases, capital punishment is accompanied by conditions that impose an unnecessary and unacceptable degree of suffering.
