Capital punishment is the lawful infliction of death as a punishment and since 1608 it has been used for a variety of offences. The Bible prescribes death for murder and many other crimes, including kidnapping and witchcraft. In America it has been inflicted principally for murder and rape in the last two hundred years and there have been some 19,665 executions since 1608. As of January 2003, 38 states have the death penalty and 32 of these have carried out at least one execution since 1976. 12 states plus the District of Columbia have no capital punishment statutes. There have been a total of 820 executions since 1977 to the end of 2002, with 71 executions in 2002. The application of the death penalty is very patchy with two states, Texas and Virginia accounting for more than half of all executions whilst six retentionist states have had no executions since 1976 and seven of these have 5 people, or less, on death row. New Hampshire is the only one of these to have no one on death row. California has a staggering 617 on its death rows - the highest in the country and yet has had fewer executions (10 in all) than Delaware which has 1/43rd of California's population. Georgia, 433 U.S. 584 (1977) , the Supreme Court ruled that the death penalty is a grossly disproportionate punishment for the crime of rape of an adult woman. The Court came to this conclusion by considering objective indicia of the nation's attitude toward the death penalty in rape cases. How, if at all, this information affects your response, either emotional or political, to capital punishment remains entirely up to you. The questions of fact concerning capital punishment fall into three general areas: does capital punishment save money , freeing social resources for better purposes than warehousing and feeding murders, or does it actually cost more, consuming resources that could go into preventing crime? Does capital punishment strike fear into offenders, saving innocent lives by deterring would-be killers? And, finally, the courts make mistakes; what does capital punishment mean to an innocent person wrongly accused These questions fit together to define a complex problem. If experience showed capital punishment saved lives by deterring offenders, the cost would not matter; a certainty that capital punishment would save innocent lives might even make the risk of wrongful convictions acceptable. If no risk at all existed of an error by the courts, the question of whether capital punishment saves innocent lives by deterring murder might matter less. And we cannot limit the cost of capital punishment simply to money, since society has limited resources, and can only spend so much on criminal justice. A society that spends money on executions can't spend that money on police officers, courts, or jails; to say nothing of schools, vocational programs, or other measures aimed at preventing crime.
