Background. Capital punishment is the lawful infliction of death as a punishment and since 1608 it has been used for a variety of offences. The Bible prescribes death for murder and many other crimes, including kidnapping and witchcraft.
In America it has been inflicted principally for murder and rape in the last two hundred years and there have been some 19,665 executions since 1608.
As of January 2003, 38 states have the death penalty and 32 of these have carried out at least one execution since 1976. 12 states plus the District of Columbia have no capital punishment statutes.
There have been a total of 820 executions since 1977 to the end of 2002, with 71 executions in 2002. The application of the death penalty is very patchy with two states, Texas and Virginia accounting for more than half of all executions whilst six retentionist states have had no executions since 1976 and seven of these have 5 people, or less, on death row. New Hampshire is the only one of these to have no one on death row. California has a staggering 617 on its death rows - the highest in the country and yet has had fewer executions (10 in all) than Delaware which has 1/43rd of California's population. (see Analysis by state ). Delaware has the highest execution rate per head of its population in the U.S.

A VIOLATION OF HUMAN RIGHTS The death penalty is the ultimate denial of human rights. It violates the right to life as proclaimed in the Universal Declaration of Human Rights. It is the ultimate cruel, inhuman, and degrading punishment. In , the United Nations adopted the Universal Declaration of Human Rights. The Declaration, adopted without dissent, is a pledge among nations to promote fundamental rights as the foundation of freedom, justice, and peace in the world. The Declaration proclaims each person's right to protection from deprivation of life, and it categorically states that no one shall be subjected to cruel or degrading punishment. The death penalty the pre-meditated and cold-blooded killing of prisoners in state custody violates both of these rights. In In In In , the United Nations General Assembly adopted the Second Optional Protocol to the International Covenant on Civil and Political Rights Aiming at the Abolition of the Death Penalty. It binds the states that are parties to it not to carry out executions and to abolish the death penalty.

How would you react if somebody raped and murdered your child?

I have often been asked this question by supporters of the death penalty, and my answer is: My first reaction would probably be a strong wish to cut the balls off the bastard, to tear him apart and kill him.
But my next reaction would hopefully be gratitude for living in a constitutional state where the principle of personal revenge has been replaced by societies obligation to administer an appropriate punishment and give me the necessary support to get a decent life in spite of my loss.

This article may be reproduced in part, or in whole, electronically, on paper, or digitally, without cost or permission. -Punkerslut Thirty eight states allow the death penalty and twelve states disallow the death penalty. Like abortion, it is a hotly debated issue. The primary problem with the Death Penalty as it stands today is that it results in executing many innocents. In 1915, Joe Hill was executed and was later proven innocent. There are obviously major flaws with the system as it stands. To quote a qualified source in regards to Capital Punishment... Whether you support or oppose capital punishment, there is mounting evidence that the system is broken. A review of death penalty judgments over a 23-year period found a national error rate of 68 %. In a matter of life and death, we are getting it wrong more than 2 out of every 3 times. We need a moratorium on executions to give us time to figure out why the system is not working. [*1] *1.     The death penalty, or capital punishment, may be prescribed by Congress or any state legislature for murder and other capital crimes. The Supreme Court has ruled that the death penalty is not a per se violation of the Eighth Amendment's ban on cruel and unusual punishment. Furthermore, the Sixth Amendment does not require a jury trial on the sentencing issue of life or death. In the landmark case, Coker v. Georgia, 433 U.S. 584 (1977) , the Supreme Court ruled that the death penalty is a grossly disproportionate punishment for the crime of rape of an adult woman. The Court came to this conclusion by considering objective indicia of the nation's attitude toward the death penalty in rape cases. At the time, only a few states allowed for executions of convicted rapists. More recently, in Atkins v. Virginia

How, if at all, this information affects your response, either emotional or political, to capital punishment remains entirely up to you. The questions of fact concerning capital punishment fall into three general areas: does capital punishment save money , freeing social resources for better purposes than warehousing and feeding murders, or does it actually cost more, consuming resources that could go into preventing crime? Does capital punishment strike fear into offenders, saving innocent lives by deterring would-be killers? And, finally, the courts make mistakes; what does capital punishment mean to an innocent person wrongly accused These questions fit together to define a complex problem. If no risk at all existed of an error by the courts, the question of whether capital punishment saves innocent lives by deterring murder might matter less. And we cannot limit the cost of capital punishment simply to money, since society has limited resources, and can only spend so much on criminal justice. A society that spends money on executions can't spend that money on police officers, courts, or jails; to say nothing of schools, vocational programs, or other measures aimed at preventing crime.

Only Dennis Kucinich, Al Sharpton, and Carol Moseley Braun are in outright opposition. Here's the way each one comes down on the issue: Wesley Clark has serious doubts about how it is being used. He would support mandatory review of all death penalty sentences. "I'll tell you, I'm uneasy about the death penalty," Clark said answering a question recently in Arkansas. "A government like the United States has the right to, in extraordinary cases, take the life of a criminal, but I don't like the way the death penalty has been applied in America," Clark said. "I think it's been applied in an unfair and discriminatory fashion and I think we need to go back and use modern technology and unpack all those cases on death row."
