Capital Punishment in Canada
Capital punishment is the execution of criminals by the state for committing crimes that are regarded so heinous that this is the only acceptable punishment. Capital Punishment deters murder, and is just retribution. Capital punishment not only lowers the homicide rate, but its value as retribution alone is a good reason for handing out death sentences. Support for the death penalty in the U.S. has risen to an average of 80% according to an article written by Richard Worsnop, entitled "Death penalty debate centres on Retribution." This figure is slightly lower in Canada where support for the death penalty is at 72% of the population over 18 years of age, as stated in an article by Kirk Makir, in the March 26, 1987 edition of the Globe and Mail, entitled "B.C. MPs split on Death Penalty." The death penalty deters murder by injecting the fear of execution into potential killers. People are less likely to do something illegal if they think that harm will come to themselves. Let us now focus on Canada. The last two people to be executed in Canada were Arthur Lucas and Ron Turpin. They were executed on December 11, 1962. These executions in Canada were carried out by hanging.

INTRODUCTION:
Putting to death people judged to have committed certain extremely heinous crimes is a practice of ancient standing, but in the United States in the latter half of the twentieth century, it has become a very controversial issue. Changing views on this difficult issue and many legal challenges to capital punishment working their way through the courts resulted in a halt to executions in the United States in 1967. Eventually, the Supreme Court placed a moratorium on capital punishment in 1972 but later upheld it in 1977, with certain conditions.

    Capital punishment , also referred to as the death penalty , is the judicially ordered execution of a prisoner as a punishment for a serious crime , often called a capital offence or a capital crime . In those jurisdictions that practice capital punishment, its use is usually restricted to a small number of criminal offences, principally, treason and murder , that is, the deliberate premeditated killing of another person. Prisoners who have been sentenced to death are usually kept segregated from other prisoners in a special part of the prison , pending their execution. In some places this segregated area is known as Death Row The term capital comes from the Indo-European kaput , meaning "head", through the Latin capitalis .     At the dawn of the 21st century, the death penalty is considered by most civilized nations as a cruel and inhuman punishment. It has been abolished de jure or de facto by 106 nations, 30 countries have abolished it since 1990. However, the death penalty continues to be commonly applied in other nations. China, the Democratic Republic of Congo, the United States and Iran are the most prolific executioners in the world. Indeed, the US is one of six countries (including also Iran, Nigeria, Pakistan, Saudi Arabia and Yemen) which executes people who were under 18 years-old at the time they committed their crimes. While international documents have restricted and in some cases even banned the death penalty, its application is still not against customary international law. Much debate continues in the US as to whether it constitutes an appropriate punishment, at least to the most heinous crimes. In recent years, the debate has been further fueled by the use of new technologies which have shown that a large proportion of people sentenced to death are, indeed, innocent.     The infliction by due legal process of the penalty of death as a punishment for crime. The Latins use the word capitalis (from caput , head) to describe that which related to life, that by which life is endangered. They used the neuter form of this adjective, i.e., capitale , substantively to denominate death, actual or civil, and banishment imposed by public authority in consequence of crime. The idea of capital punishment is of great antiquity and formed a part of the primal concepts of the human race. When Cain committed fratricide (Genesis 4), and was rebuked therefor by God , he uttered the lament that his life would be in danger by reason of the hostility of others. A mark was set upon him by the Lord which was a guarantee of his personal safety. The first Divine pronouncement which seems to sanction the death penalty is found in Genesis 9:6: "Whosoever shall shed man's blood, his blood shall be shed; for man was made to the image of God ." When the ancient Israelites had departed from Egypt and were sojourning in the Sinaitic Peninsula, they received from the Lord a code of legislation wherein the death penalty was prescribed for many offences. Thus, in Exodus 21, that penalty is prescribed for murder, for a wilful assault upon the father or mother of an offender, for cursing a man's father or mother, and for man-stealing. Down to their latest days the Kingdoms of Israel and Juda preserved capital punishment as a feature of their criminal code.

"The bottom line is, one method of execution is just as brutal and as barbaric as the next," says Mr. Breedlove of the National Coalition to Abolish the Death Penalty. This comes straight from the mouth of a member of a national organization against capital punishment. The American Heritage® Dictionary of the English Language, Third Edition defines execution as The act or an instance of putting to death or being put to death as a lawful penalty. So if Breedlove’s words hold true, then what he believes is that someone going out and killing someone is barbaric. In a sense isn’t that what he’s saying, that one way of killing someone is just as bad as any other. So if he finds this so barbaric, why doesn’t he do something about it? Many people who are against capital punishment are only thinking of the criminal and how cruel it is for them. But, shouldn’t we think of the families that are broken apart now because of the merciless acts of these criminals. Think of Susan Smith, how she knowingly drove her car off into a lake with her two children strapped to the seats. Think of how they must have felt as the cold water started to fill the cabin of the car, and then ultimately drown them. Barbaric is exactly the word I would use to describe her actions. But yet, the jury rejected the death penalty and chose a life sentence instead. Mr. Smith, the father of the two children, broken up from the ruling said "Me and my family are disappointed that the death penalty was not the verdict, but it wasn’t our choice. They returned a verdict they thought was justice" (Bragg, pg. 1+).

    In 1972 the Supreme Court struck down the death penalty in Furman v. Georgia, only to reinstate it in the 1976 Gregg v. Georgia decision. Since then the fiery debates over capital punishment have been as hot as ever. The 38 states that use capital punishment held 3,452 inmates on death row at the end of 1998, according to Bureau of Justice Statistics . California and Texas lead the nation with the number of prisoners sentenced to death.
    Advocates argue that capital punishment acts as a deterrent to potential criminals, plus it provides justice to victims' families. Meanwhile opponents argue that the death penalty violates the "cruel and unusual punishment" doctrine of the Constitution. Saying the system is corrupt, opponents point to numerous examples of death row inmates who were later freed based on new evidence.

Harder - Since the beginning of the nineteenth century, most executions in the United States have resulted from murder convictions. However, the sentence of death has been imposed for such serious crimes as armed robbery, kidnapping, rape, and treason. People disagree about whether capital punishment is moral or if it is effective in discouraging crime. Many oppose the death penalty because they consider it cruel. Critics also believe that there is a risk of executing mistakenly convicted people. Supporters of the death penalty believe that in some instances, people who take another human life deserve to forfeit their own lives. Many supporters also argue that the threat of death discourages crime.

    Pro-Life, Anti-Death Penalty?

Christopher Kudlac , a graduate student at Fordham, prepared the data. Cardinal Joseph Bernardin articulated a consistent ethic of life, which included opposition to both abortion and the death penalty, in 1985. Ten years later, in his encyclical The Gospel of Life, Pope John Paul II taught that opposing capital punishment should be part of a pro-life witness for a culture of life that promotes human dignity and solidarity. The National Conference of Catholic Bishops as well as individual bishops across the country have repeated the teaching. Have Catholics in general and pro-lifers in particular been listening to this message from their church's hierarchy? Are abortion opponents becoming less likely to support capital punishment? And what about pro-choice supporters? Where do they stand on the death penalty? Until recently, opposition to capital punishment was widely assumed to be part of any politics characterized as "progressive." Are pro-choice advocates consistently progressive? To answer these questions, we will review the data from the General Social Survey (G.S.S.) of the University of Michigan for the early 1980's and more recently.
