Introduction In 1974, out of a commitment to the value and dignity of human life, the U.S. Catholic Conference, by a substantial majority, voted to declare its opposition to capital punishment. As a former president of the National Conference of Catholic Bishops pointed out in 1977, the issue of capital punishment involves both "profound legal and political questions as well as 'important moral and religious issues,'" And so we find that this issue continues to provoke public controversy and to raise moral questions that trouble many. This is particularly true in the aftermath of widely publicized executions in Utah and Florida and as a result of public realization that they are awaiting execution in various prisons. The resumption of capital punishment after a long moratorium which began in 1967, is the result of a series of decisions by the United States Supreme Court. In the first of these decisions

1961 General Resolution WHEREAS, respect for the value of every human life must be incorporated into our laws if it is to be observed by our people; and WHEREAS, modern justice should concern itself with rehabilitation, not retribution; and WHEREAS, it has not been proved that fear of capital punishment is a deterrent to crime; and WHEREAS, human judgements are not infallible, and no penalty should be used which cannot be revoked in case of error; and WHEREAS, capital punishment has not always been used impartially among all economic and racial groups in America; THEREFORE BE IT RESOLVED: That the Unitarian Universalist Association urges its churches and fellowships in the United States and Canada to exert all reasonable efforts toward the elimination of capital punishment; and BE IT FURTHER RESOLVED: That copies of this resolution be sent to the Governors of all states in which capital punishment has not yet been eliminated, and to the Canadian Minister of Justice. 1979 General Resolution WHEREAS, General Assemblies of the Unitarian Universalist Association have opposed capital punishment by resolutions in 1961, 1966, and 1974; and WHEREAS, the aforementioned resolutions have urged complete abolition of capital punishment as inconsistent with respect for human life; for its retributive, discriminatory, and non-deterrent character; and opposed its restoration or continuance in any form; and WHEREAS, the State of Florida has declared its intent to proceed with the executions of those under the capital sentence in Florida prisons, numbering more than one hundred, and having begun with the execution of John Spenkelink on May 25, 1979; and WHEREAS, the Florida example may become precedent for a new wave of capital punishment in numerous other states; BE IT RESOLVED: That the 1979 General Assembly of the Unitarian Universalist Association urges the Governor of the State of Florida to commute all existing death sentences; and BE IT FURTHER RESOLVED: That the General Assembly urges Governors of all other states similarly to commute death sentences and to prevent the restoration or continuance of capital punishment in any form.

Background of the survey
According to the Gallup Organization's recent surveys on the death penalty, reprinted in the Bureau of Justice Statistics' 1994 Sourcebook of Criminal Justice Statistics, 77 percent of those surveyed favored the death penalty for those convicted of murder, while 13 percent opposed it. When demographic factors such as the gender, age, education, income, political affiliation, or region of the respondent are considered, similar percentages were found. When the race of the respondent is considered, some differences do emerge: Blacks favor the death penalty by a narrower margin (53% in favor / 31% opposed) than do whites (81% in favor / 10% opposed) ( Justice , Table 2.57, p 181). When Gallup prefaced the question with the estimate that 1 percent of those sentenced to death were actually innocent, and Gallup posed it to those who had favored the death penalty, 74 percent still supported the death penalty, while 20 percent did not. When demographic factors such as the gender, age, education, income, political affiliation, or region of the respondent were considered, similar percentages were found ( Justice , Table 2.60, p 184). Capital Punishment - The Pope's Position The Church's teaching has not changed, nor has the Pope said that it has. The Catechism and the Pope state that the state has the right to exact the death penalty. Nations have the right to just war and individuals have the right to self-defense. Does that means that any and all uses of force to defend oneself against a criminal, or a criminal nation, are justified? No, and most people understand that. To be good every moral act must satisfy three elements
1) The act itself must be good.
2) The intention of the one doing it must be good.
3) The circumstances must be appropriate. 1. Capital punishment is the right of the state. This is the principle taught by the Church. The Pope does not deny it, but neither St. Thomas or any Magisterial text presumes this gives the state an unlimited right to make capital laws and carry them out. It is inherent in a just capital punishment law that there be proportion between the taking of the life of the criminal and the benefit expected to the common good. A law, for example, that takes no account of factors such as repentance, mental age and so on is unjust. States have executed the mentally retarded, who could be of no conceivable future threat to society, and in one case a woman whose evident conversion even the state admitted. Thus, the

Response to the Governor's Commission on Capital Punishment On Monday, April 15, the Governor's Commission on Capital Punishment released its report. The Chicago Tribune asked the candidates for Governor and Attorney General to write an Op-Ed on the recommendations made within the report. Sen. Madigan's response was published in the Tribune on Friday, April 26. For decades most Illinois citizens, prosecutors, judges and juries have believed that the death penalty is the appropriate punishment for those who commit the most brutal and heinous murders. I agree. Clearly, though, the wrongful convictions and death sentences of 13 men have shaken public confidence in our system of capital punishment. Over two years ago, Governor Ryan courageously and correctly halted executions and called for a much needed, comprehensive study of Illinois' death penalty. History of Capital Punishment in California History Legal executions in California were authorized under the Criminal Practices Act of 1851. On February 14, 1872, capital punishment was incorporated into the Penal Code, stating:
A judgment of death must be executed within the walls or yard of a jail, or some convenient private place in the county. The Sheriff of the county must be present at the execution, and must invite the presence of a physician, the District Attorney of the county, and at least twelve reputable citizens, to be selected by him; and he shall at the request of the defendant, permit such ministers of the gospel, not exceeding two, as the defendant may name, and any persons, relatives or friends, not to exceed five, to be present at the execution, together with such peace officers as he may think expedient, to witness the execution. But no other persons than those mentioned in this section can be present at the execution, nor can any person under age be allowed to witness the same. The various counties may have some records of the executions conducted under the jurisdiction of the counties, but the department knows of no compilation of these.

According to data collected by the federal government, between 1930 and 1968, 3,859 persons were executed in the United States under civil authority. After 1950, the number of executions consistently declined from 105 in 1951 to 2 in 1967—and to zero from 1968 through 1976— primarily due to legal challenges to the death penalty. These challenges culminated in 1972 when the Supreme Court, in the case of Furman v. Georgia
The United States is the only Western democracy that allows capital punishment, and the sentence has widespread popular and political support. In a 1997 Time magazine poll, 74 percent of those surveyed said they favor capital punishment for persons convicted of serious crimes. This number, though, masks the conflicted attitudes Americans have toward the death penalty. The same poll reveals that when Americans are asked whether they think vengeance is a legitimate reason to execute a murderer, 60 percent do not. Additionally, a slight majority (52 percent to 45 percent) do not believe the death penalty deters crime. Most Americans may want killers executed, but a majority are uncomfortable with the two primary reasons for capital punishment—vengeance and deterrence.
