Anti-Family Canadian Supreme Court Justice Louise Arbour Nominated as United Nations High Commissioner for Human Rights OTTAWA, February 20, 2004 (LifeSiteNews.com) - Canadian Supreme Court Justice Louise Arbour has been nominated today to the post of United Nations High Commissioner for Human Rights by UN Secretary General Kofi Annan. Justice Arbour is expected to retire from the Supreme Court of Canada to take up her post in Geneva in late June. As described by LifeSiteNews.com last week, while the development may be welcome news to social conservatives in Canada who will see at least one radical leftist judge leave the Supreme Court, from her new post, Arbour will now tax pro-family supporters the world over.
Justice Arbour's anti-family legacy as a Canadian Supreme Court Justice includes the legalization of lap-dancing; she has ruled in favour of common-law relationships, being in at least one herself; in a 1992 insurance case, she ruled that laws should not discriminate against common-law couples as compared to married couples; and in the recent Canadian Supreme Court decision on the use of spanking by parents as a form of discipline, justice Arbour was the only one among Canada's nine radical Supreme Court Justices to insist on total criminalization of all spanking.

Canadian Supreme Court Refuses to Criminalize Parents Use of Spanking Former Top UN Judge Would Have Seen Parents in Jail for Spanking OTTAWA, January 30, 2004 (LifeSiteNews.com) - In a 6-3 decision rendered today, the Supreme Court of Canada turned down an attempt by an activist group to criminalize parental use of spanking as a form of disciplining their children. The ruling is a victory for parents, said representatives of the Coalition for Family Autonomy (CFA) - one of the groups intervening in the case.
Of note, only one justice was strident in insisting on criminalization spanking by parents - justice Louise Arbour. Arbour's opinion comes as no surprise to UN watchers since she was at one time the United Nations' top judge - the UN's chief prosecutor in the International War Criminal Tribunal. The United Nations has for years insisted that Canada, and all countries, prohibit parents from using spanking as a form of discipline. The U.N. has also been advocating many other restrictions on the rights of parents to raise their children according to their own cultural, religious and personal beliefs.

The Supreme Court decision striking down the abortion law is a dramatic challenge to all lay members of the Church and to all of us their pastors. The need for responsible political action was never more urgent. For God's law condemning abortion is not changed by the Supreme Court decision. Canadian Supreme Court rules against farmer in biotech dispute By COLIN McCLELLAND OTTAWA (AP) - Canada's top court ruled Friday against a farmer accused of patent infringement for using a genetically engineered seed that he insisted had arrived on his field by accident. The Supreme Court of Canada upheld a lower court ruling in favor of Monsanto Co., which makes a canola variety found on the Saskatchewan farm of Percy Schmeiser. The canola was engineered to resist the U.S. company's powerful Roundup weedkiller. The seven-year legal battle has become a cause for biotechnology opponents and proponents around the globe, dating to 1997 when Monsanto found the gene-altered plant growing on the farm. Some farmers, especially those from developing nations, fear that natural or accidental contamination of their conventional crops with biotech varieties will give biotech companies like Monsanto licenses to seize their crops. Further, the case also highlighted the growing concern among organic farmers and other conventional growers over controlling the accidental spread of genetically engineered crops into their fields. Consumers pay a premium for organic food, but a number of farmers are finding trace amounts of genetically engineered crops in their fields, raising liability issues for biotech companies. Conventional farmers fear biotech-averse consumers, especially in Europe, will reject their crops if they're found to be widely cross-pollinated with genetically engineered plants.

Canada's Supreme Court on Thursday upheld GlaxoSmithKline's Canadian patent on the antiretroviral drug AZT, disallowing generic competition and forcing two generic companies to reimburse GlaxoSmithKline for the money it lost while they produced generic versions of the drug, Toronto's Globe and Mail reports.
The court ruled that GlaxoSmithKline's 20-year patent, granted in 1985, on AZT known generically as zidovudine is valid, even though the company had not conducted clinical trials on effectiveness of zidovudine in fighting HIV/AIDS when it applied for the patent.
Two Canadian generic drug companies, Apotex and Novopharm, contended GlaxoSmithKline applied for a patent for AZT because it "only speculated" the drug would be effective against HIV/AIDS and had "improperly" claimed credit for discovering the drug's formulation (Lewis, National Post , 12/6/02). The London Free Press , June 6, 2003 OTTAWA Anti-spanking advocates carried their cause to the country's highest court yesterday, arguing corporal punishment of children should be outlawed as an affront to human dignity. "This case is about the right of children not to be hit, a right that in a modern, 21st-century democracy should be unquestioned," lawyer Paul Schabas told the Supreme Court of Canada. He got a skeptical reception from some of the nine judges, who sharply questioned his legal reasoning. He also met vigorous opposition from the federal government, which maintained that, whatever the merits or pitfalls of spanking, parents should be free to resort to it in "mild to moderate" measure. At issue is Section 43 of the Criminal Code, enacted more than a century ago, which protects parents, teachers and caregivers from prosecution for using "reasonable" force to discipline children. Children's advocacy group the Canadian Foundation for Children, Youth and the Law wants that immunity struck down as a violation of the Charter of Rights. "Section 43 has the effect of making children second-class citizens," Schabas said on behalf of the foundation.

RELATED STORIES, SITES OTTAWA (CNN) In a landmark gay rights ruling that could have ramifications across Canada, the Supreme Court ruled Thursday that Ontario's legal definition of a spouse as someone of the opposite sex is unconstitutional. The high court, by an 8-to-1 vote, gave Canada's most populous province six months to amend its Family Law Act to recognize same-sex couples. However, the court stressed that the ruling should not be construed as giving same-sex couples the right to marry. The decision was the Supreme Court's most definitive ruling yet on the legal rights of gays and lesbians in Canada. While Thursday's ruling applies directly only to Ontario, observers believe it could mean that hundreds of laws on both the federal and provincial levels will have to be rewritten.
