The Patriation Of The Canadian Constitution: Not An Auspicious Occasion
SASKATCHEWAN INDIAN MAY 1982 v12 n04 p10 April 17, 1982 was proclaimed as a day of mourning for the aboriginal peoples of Canada. It was the day the British Crown irreversibly betrayed every treaty, proclamation, agreement, trust and promise made with the Indian Nations of Canada. To take a share in our land the British Crown promised to protect Indian lands and to protect Indian jurisdiction on those lands, to protect the Indian way of life. Britain soon forgot her promises and the trickle of settlers became a flood. For the last three years Chiefs, Indian organizations and leaders and ordinary Indian people have written to the Queen to inform her that the treaties were endangered by a new settler government constitution. She resolutely refused to respond or to meet us though graciously accepted our gifts to her when we visited her homeland. When the Queen of Great Britain came to our homeland to proclaim the settler government's constitution, there were no similar acts of courtesy to the Indian leaders. There was no acknowledgement of so many letters to her from the Indian people outlining just how the treaties and the Royal Proclamation would no longer be safeguarded in Canada's Constitution. She could not pretend we no longer existed: the two-month "Indian debate" in Westminster precluded that. So she just pretended that we were happy in the new arrangement that would sanction one of the most massive land grabs in history.

EXECUTIVE SUMMARY
1. West Coast Environmental Law Association applauds the federal government's proposed constitutional commitment to protection of the environment, and the Minister of Constitutional Affairs' statement that the government's intention is not to weaken the federal role in protecting the environment. A strong federal role in protecting the environment is of critical importance. 2. The proposals in this brief for strengthening the ability of the Constitution of Canada to foster protection of the environment are predicated on the recognition that the Canadian Constitution will not be complete until the legal relationship between Canada and Native peoples is resolved on a basis of mutual trust and respect. 3. This brief is offered in a spirit of cooperation with people from Quebec, Newfoundland, Nova Scotia, New Brunswick, Prince Edward Island, Ontario, Manitoba, Saskatchewan, Alberta, the Yukon and the Northwest Territories. We know they all want essentially the same as we do: satisfactory constitutional arrangements and protection of the environment we all love. 4. The proposals' failure to link a prosperous economy and human health with a sustainable environment is a glaring betrayal of Canada's Green Plan and must be rectified throughout the constitutional package.

Hunters challenge Canadian Constitution
The Ontario Federation of Anglers and Hunters (OFAH) has embarked on a court challenge to prove Canadians have a Constitutional right to hunt. The court challenge has been sparked by Ontario's closure of the spring black bear hunt. The closure, as explained by the Ontario government, has no foundation in conservation principles or safety, but was implemented because of "ethical reasons". This of course begs the question, "Whose ethics?" The Canadian Charter of Rights and Freedoms (the Charter) guarantees that all Canadians have the right of freedom of thought, belief, opinion and expression. Consequently, the Supreme Court of Canada has said that we cannot exclude human activity from guaranteed free expression on the basis of content or meaning being expressed. While it may surprise and even shock you, on this basis, the Supreme Court of Canada has said that expressions such as child pornography and hate mongering are protected under the Charter. Hunting, as a core value of many Canadians (particularly in the North) could surely then be deemed expressive as well.

By definition, constitutional laws define the powers and limits of government and override all other statutes inconsistent with their principles. Canadian constitutional law follows this convention, setting out the basic framework of democratic government in Canada and entrenching certain fundamental principles within the supreme law of the country. Prior to 1982, the British North America Act (BNA Act)—a British statute—held supremacy over all Canadian laws and was regarded as the foundation for Canada's constitutional law. When the United Kingdom passed the Canada Act, 1982 , Canada's own constitution was born and British law ceased to extend to Canada. The Constitution Act, 1982 received the approval of Canada's Parliament and all provinces except Quebec. The Constitution Act, 1982 and the Constitutions Acts, 1867 to 1975 collectively make up the Canadian constitution. The constitution defines the powers of the three branches of government (executive, legislative and judicial), the distribution of powers between the federal and provincial governments, and the rights of Aboriginal peoples of Canada. It also outlines the procedure for making constitutional amendments.

A constitution provides the essential framework for orderly government and for relations between people and their government. Canada's Constitution is not a single document as in the United States. It is made up of acts of the British and Canadian Parliaments, as well as legislation, judicial decisions and agreements between the federal and provincial governments. It also includes unwritten elements such as British constitutional conventions, established custom, tradition and precedent. Responsible government, for example, in which the Cabinet is collectively responsible to the elected House of Commons and must resign if it loses a vote of confidence, is a fundamental, but unwritten, element of Canadian parliamentary democracy at the federal and provincial levels. The Constitution's basic written foundations are the Constitution Act, 1867, which created a federation of four provinces ? Ontario, Quebec, Nova Scotia and New Brunswick ? under the British Crown, and the Constitution Act, 1982, which transferred formal control over the Constitution from Britain to Canada and entrenched a Canadian Charter of Rights and Freedoms and procedures for constitutional amendment.

Whereas Canada is founded upon the principles that recognize the supremacy of God and the rule of law: Guarantee of Rights and Freedoms The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society.
