Held, PhD, Founder and Executive Director , Etta Israel Center, Los Angeles, CA I have been working in the Jewish community as a psychologist and educator since 1982; for the past 10 years I have served as the founder and director of the Etta Israel Center in Los Angeles, the largest agency for Jewish special needs students on the West Coast. Over the past two decades there has been notable progress in the field of Jewish special education. There are a variety of stellar programs run by individual schools, specialized agencies, and in some rare cases, by entire communities. However, it is still accurate to say that no one group remains as disenfranchised by the Jewish establishment as the disabled, and within Jewish education, the disabled are nearly always addressed in a piecemeal fashion, usually through the vigor and drive of a parent or better yet, a parent who donates money so that other children in the same situation can benefit. Rarely does a community create a cogent, strategic, and sustained plan for those with special needs.

Directly across from them, at the back of the room, a teacher's aide looks on as a student completes his assignment. Elsewhere in the classroom, students, more often restless than not, tackle their worksheets on their own. Noise punctuates the atmosphere on this particular day; occasionally, a student will express frustration, to which Lopin responds with a gentle "Do you want to ask me your she'elah [question]?" Other students will work for 10 minutes and then, fidgeting in their seats, will talk to their neighbor, only to be quieted by the teacher or her aides. As the Parent of a Child With Special Education Needs, Are You Entitled to Damages? Ordinarily, a prevailing parent in an Individuals with Disabilities Education Act (IDEA) court action is only entitled to a compensatory education for his/her child and is not entitled to damages, which is money awarded in order to compensate for a loss. It is important for parents to understand from the outset that damages are not recoverable, so that they have realistic expectations when filing for due process or seeking the aid of an attorney. Eight of eleven Circuit Courts have held that damages cannot be recovered for IDEA violations. Only the Second and Third Circuits allow for the recovery of damages under IDEA. The Ninth Circuit has still yet to decide the issue; however, a California District Court, which is in the Ninth Circuit, has recently ruled that parents can recover damages in IDEA actions. In Goleta Union v. Ordway, 166 F.Supp.2d 1287 (C.D. Cal., 2002), the District Court held that the mother of a child transferred to high school without having his special education or behavioral needs met or his placement checked, was entitled to damages.
