Meeting the Challenge: Including Special Needs Students in our Day Schools Michael B. Held, PhD, Founder and Executive Director , Etta Israel Center, Los Angeles, CA I have been working in the Jewish community as a psychologist and educator since 1982; for the past 10 years I have served as the founder and director of the Etta Israel Center in Los Angeles, the largest agency for Jewish special needs students on the West Coast. Over the past two decades there has been notable progress in the field of Jewish special education. There are a variety of stellar programs run by individual schools, specialized agencies, and in some rare cases, by entire communities. However, it is still accurate to say that no one group remains as disenfranchised by the Jewish establishment as the disabled, and within Jewish education, the disabled are nearly always addressed in a piecemeal fashion, usually through the vigor and drive of a parent or better yet, a parent who donates money so that other children in the same situation can benefit. Rarely does a community create a cogent, strategic, and sustained plan for those with special needs.

Special Schools Programs Preschool Special Center Riverside Unified School District has one special school campus Sunshine Early Childhood Center . This school offers unique curricula especially designed to meet the learning needs of the disabled preschool student. Head Start classes and the Peer Buddy Program provide peer modeling. Nonpublic Nonsectarian Schools Placement in a nonpublic school is provided for those students whose educational needs cannot be met in the public schools. State Special Schools Special schools, for the deaf and blind operated by the California State Department of Education, sometimes serve as placement when a student's special needs warrant such a program. The School for the Deaf, Southern California , is located in Riverside. Individual Instruction in Home/Hospital Disabled students who cannot profit from special class placement in the regular school setting may be placed on home instruction. The student may be provided with up to 300 minutes of individual instruction at his/her home per week. This is usually intended as a short term service until the student can be returned to a school program. Residential Institution When the student's problems are so severe that the child needs 24-hour care to provide an appropriate education, the student may be placed in a residential setting.

    Chicago JUF News Sitting behind her teacher's desk, Aviva Lopin helps a 10-year-old student with her Hebrew skills. Directly across from them, at the back of the room, a teacher's aide looks on as a student completes his assignment. Elsewhere in the classroom, students, more often restless than not, tackle their worksheets on their own. Noise punctuates the atmosphere on this particular day; occasionally, a student will express frustration, to which Lopin responds with a gentle "Do you want to ask me your she'elah [question]?" Other students will work for 10 minutes and then, fidgeting in their seats, will talk to their neighbor, only to be quieted by the teacher or her aides. A few minutes before noon, the kids put away their work and get ready for lunch; some of them will eat in the room, others will join the rest of the school in the cafeteria. This trend is expanding to include children in special needs programs, resulting in an increasing number of questions from parents choosing to homeschool their children who are interested in continuing or obtaining special needs help from the schools. In many instances a special needs child shows tremendous gains just by being removed from the public school situation and educated at home by loving and caring parents who are able to provide the stimulation and enrichment each child needs and deserves. If services are offered the family is not required to accept them. Many families do just fine without government help, but if you need it, special needs services are available to homeschoolers. We are striving to prepare all students to pass the upcoming California High School Exit Exam. We also take pride in preparing our students to be successful in their post-secondary plans. SPECIAL EDUCATION (Instructional Programs) The Oxnard Union High School District serves approximately 1,700 students with special needs through a variety of programs. These programs are, for the most part, offered at the students' neighborhood schools. Special Education Handbook Standards Based Education All Special Education students enrolled in the California Public Schools are required to meet the same standards for graduation as their peers. At this time there is no provision for a differential standard on the CAHSEE (California High School Exit Exam).

    As the Parent of a Child With Special Education Needs, Are You Entitled to Damages? Ordinarily, a prevailing parent in an Individuals with Disabilities Education Act (IDEA) court action is only entitled to a compensatory education for his/her child and is not entitled to damages, which is money awarded in order to compensate for a loss. It is important for parents to understand from the outset that damages are not recoverable, so that they have realistic expectations when filing for due process or seeking the aid of an attorney. Eight of eleven Circuit Courts have held that damages cannot be recovered for IDEA violations. Only the Second and Third Circuits allow for the recovery of damages under IDEA. The Ninth Circuit has still yet to decide the issue; however, a California District Court, which is in the Ninth Circuit, has recently ruled that parents can recover damages in IDEA actions. In Goleta Union v. Ordway, 166 F.Supp.2d 1287 (C.D. Cal., 2002), the District Court held that the mother of a child transferred to high school without having his special education or behavioral needs met or his placement checked, was entitled to damages.

    Significant changes have occurred in services and programs provided for children with exceptional needs in the public schools of California. These changes have stemmed from new laws and regulations at both the state and national levels, as well as from the spirit of fairness, balance and equality that characterize the public school system in America. New interpretations of existing laws by the courts have further modified and expanded the services required for exceptional students. Previously, children with disabilities were identified only if their educational needs were obvious. Then, they tended to be placed into programs designed to serve children with similar disabilities in special schools or located separately on comprehensive school sites. Such categorical programs were usually effective in providing specialized services for the populations they served; but in many cases, expectations for these groups were inappropriate in relation to the students' actual potential. Gradually, the community and public agencies have become aware that children with disabilities can be educated with their non-disabled peers, guaranteeing equal opportunities for all children....

    Easter Seals Helps People with Disabilities Hold Steady Jobs
    Josie Lopez started receiving services from the Easter Seals Adult Day Program in 1996. A year later so did Ericke Guerra. The Adult Day Program is community based and offers individuals with developmental, physical or multiple disabilities the opportunity to enjoy and become more integrated with their communities. It also provides instruction in pre-vocational, self-help, motor and communication skills. In 1998, Easter Seals helped Josie and Ericke get jobs at The Gap in Carlsbad, California. They work three days a week folding, hanging and stocking. An Easter Seals coach goes to work with Josie and Ericke to provide job training and support. Both are hard workers and well liked by their peers. The two have also received several raises!
