References to bears are found in literature, folk songs, legends, mythology, fairy tales, and cartoons. The American black bear inhabits wooded and mountainous areas throughout most of North America, from Alaska to Florida, Canada to Mexico. [US FWS Line Art by Robert Savannah] The black bear is approximately 5 feet long and varies in weight from 125 to 400 pounds. It has small eyes, rounded ears, a long snout, a large body, and a short tail. The shaggy hair varies in color from white through chocolate brown, cinnamon brown, and blonde to black, but most black bears are indeed black or a darker shade of brown. While black bears are capable of standing and walking on their hind legs, the usual posture is on all fours. The black bear's characteristic shuffle results from walking flat-footed, with the hind legs slightly longer than the front legs. Each paw has five strong, non-retractable claws used for tearing, digging, and climbing. One blow from a powerful front paw is enough to kill an adult deer. But in spite of their size and strength, black bears are surprisingly agile and careful in their movements. Although much of its historical habitat has been destroyed by axe, plow, and bulldozer, the highly intelligent black bear has adapted and survived. Black bears are opportunistic feeders, making use of just about any available food source. While they prefer berries, nuts, grass, and other plants, they also eat carrion, small animals, and fish.

  • SUMMARY MOST RECENT DEVELOPMENTS BACKGROUND AND ANALYSIS SUMMARY The 107 th Congress may consider whether to reauthorize and amend the Endangered Species Act of 1973 (ESA). Major issues in recent years have focused on whether to incorporate further protection for property owners and reduce regulatory impacts, or whether to increase the protection afforded listed species. The ESA has been one of the more contentious environmental laws. This may stem from the strict substantive provisions of this law, which also can affect the use of non-federal lands. Under the ESA, certain species of plants and animals (both vertebrate and invertebrate) are listed as either "endangered" or "threatened" according to assessments of the risk of their extinction. Once a species is listed, powerful legal tools are available to aid the recovery of the species and the protection of its habitat. The ESA is administered by the Fish and Wildlife Service (FWS) for terrestrial and freshwater species and some marine mammals, and by the National Marine Fisheries Service (NMFS) for marine and anadromous species. The U.S. Geological Survey's Biological Resources Division conducts research on species for which the FWS has management authority.

Their reproductive rates are lower than their mortality rates over long periods of time, so their numbers are diminishing. The reasons for this are varied, but lately, very often involves a loss of habitat as people encroach on their living areas. When a species is listed as endangered or threatened, it is not a death sentence. Many animals, like the bald eagle and the American alligator, were on the brink of extinction and are now recovering. Many species, however, will not recover, and could be lost forever. Throughout time, animal species have been going extinct (long before people evolved); paleontologists estimate that well over 90 percent of all plant and animal species that ever existed have gone extinct.

management and recovery zones (1995) On July 12, 1995, the bald eagle was reclassified from endangered to threatened in the lower 48 states. It is the first and only Montana threatened or endangered species to be downlisted since the 1973 Endangered Species Act became law. After years of research, scientists determined that DDE, a breakdown product of DDT, accumulates in the fatty tissues of female eagles and impairs the calcium release necessary for eggshell formation. This induces thin shells and reproductive failure during incubation. These findings eventually led to the banning of DDT and related chemicals in the U.S. in 1972. In 1978, bald eagles throughout the lower 48 states were classified as endangered, except in Michigan, Minnesota, Wisconsin, Washington, and Oregon, where they were designated threatened. Between 1984 and 1994, the number of known breeding pairs in the Pacific States Bald Eagle Recovery Region (Washington, Oregon, California, Nevada, Idaho, Wyoming, and Montana) increased from 479 pairs to 1,192 pairs. One-fourth of all the breeding bald eagles in the lower 48 states come from this region.

What the Congress Did
Dismantling federal safeguards for imperiled animals and plants has been a priority of the 104th Congress. In 1995, Congress clamped a moratorium on any new listings of threatened or endangered species, such as the Florida Black Bear and Atlantic Salmon, under the Endangered Species Act, denying federal protection to more than 400 species of animals and plants. In addition, Congress curtailed funding for crucial research on imperiled wildlife, and virtually eliminated the National Biological Survey, a fledgling and long-overdue effort to inventory the nation's flora and fauna. In March, 1996, the Senate extended the species protection moratorium until the end of the fiscal year. In the House of Representatives, 129 members have cosponsored a bill, introduced by Representatives Don Young of Alaska and Richard Pombo of California, that would dismantle most protections under the Endangered Species Actthe intensive care ward of wildlife conservation. Representative Young is the chairman of the House Resources committee which has jurisdiction over the Endangered Species Act, and Representative Pombo is a co-chair of the House Republican Task Force on the Environment.
