Overview Wright County, established in 1855 and named after former U.S. Senator Silas Wright, has undergone numerous changes during the past 150 years. All Sheryl Weinstein wanted to do was paint her house. She was ecstatic when she found out that the homeowners' association in her gated community in Boynton Beach, Fla., planned to paint all the homes in the community. Then she found out that she couldn't pick the color.
"They said you had to have the same color you had before," says Weinstein, who moved into the community about two years ago. "I don't hate the color of the house, so I'm not opposed to it. I'm just surprised that I didn't get a choice."
Weinstein is one of the estimated 50 million Americans who live in developments governed by community associations. On May 13, 2002, the United States Supreme Court reversed the landmark decision of the Third Circuit Court of Appeals, concluding that application of varying community standards to Internet communications does not, in itself, render the Child Online Protection Act ("COPA") unconstitutionally overbroad. This was an unusual case for the High Court in that it was an appeal from a preliminary injunction; the Court rarely agrees to review cases that are not final. The majority of Justices decided to "remand" (read: send back) the case to the Court of Appeals for further consideration of the constitutional issues raised by the parties.
The narrow grounds upon which the Third Circuit invalidated COPA were, to be sure, ground-breaking. Striking down the law based on the community standards issue essentially forced the Supreme Court to take the case, reverse it, and send it back for a final decision on the other constitutional issues. Thus, the preliminary injunction will remain in effect while the courts work this out.
The Third Circuit Court of Appeal could still readily declare COPA unconstitutional on vagueness or other overbreadth grounds, or even strike the law down based on failure to meet the strict scrutiny test applicable to content-based restrictions on speech. For those Webmasters seeking to provide free hardcore materials on the Web, this additional "hold time" will be seen as a benefit. But for the reasons which follow, the Supreme Court's decision has struck a critical blow to First Amendment jurisprudence, and further complicates the issues relating to online obscenity.

The promotion of commercial lotteries and other forms of traditional gambling has long been the subject of state and federal regulation. As early as 1827, Congress passed a law that provided: "No Postmaster, or Assistant Postmaster, shall act as agent for lottery offices." By 1868, Congress made it unlawful to mail any letters or circulars concerning lotteries or other similar enterprises offering prizes of any kind or any pretext whatsoever. Congress extended the mailing ban from letters to cover newspapers through the Anti-Lottery Act of 1890, which was upheld in the face of an 1892 First Amendment challenge. By 1895, Congress eliminated interstate lotteries altogether, and prohibited the transportation of lottery tickets in interstate commerce.

Research News: Vol. 1, No. 2 June 2002 Recent doctoral research at AFIT develops new methods for the modeling and analysis of social networks. Social networks describe the complex relationships of individuals and groups in multiple overlapping contexts. This research advances the science of Operations Research and its application to broad classes of problems dealing with social networks. Application areas span academic, private sector,and government analysis. Sample cases were used in the research from the private sector and government. Specifically, influencingforeign government decision making was demonstrated for the case of Iran. Counter- terrorism applications were demonstrated for a sample case using Usama Bin Ladin. THE CHILD ONLINE PROTECTION ACT OF 1998 (COPA) Summary: Please note the Supreme Court ruling of May 13, 2002, discussed below. On March 7, 2003 the Third Circuit upheld Judge Reid’s injunction on other grounds (see below). On May 13, 2003 the Third Circut refused the government's request for an en banc hearing. On August 11, 2003 the Justice Apartment appealed this decision to the Supreme Court (again). The plaintiffs filed a reply in September 2003, and the Supreme Court announced that it would hear the case (on non-community-standards grounds) on October 14, 2003. Briefs are due by the beginning of 2004. Oral arguments may be heard in early 2004 (probably around early Feb or Mar it now looks like the date is March 2, 2004 at 1 PM) and a decision may occur by June 2004. SAN FRANCISCO If Kamala Harris wins next month's runoff election for San Francisco District Attorney, it would mark a new chapter in the racial history not only of the city but the entire state.
Harris, 38, who is of mixed Jamaican and Indian descent, could simultaneously lay claim as San Francisco's first female district attorney, the first official of Asian descent to hold the office, and the first African-American top county prosecutor in the state. The significance of that potential moment, however, is subject to debate among lawyers and other professionals who are following the race closely. "I think it's historic. Given that San Francisco is so diverse, why did it take until 2004 that we have the possibility of having an attorney of color in the position?" asks Gillian G.M. Small, President of the California Association of Black Lawyers. Harris, the daughter of a mother from India and a father of Jamaican heritage, had been a relative unknown at the outset of the campaign. She ran on a platform critical of incumbent Terrence Hallinan's low conviction rate, and promised an aggressive prosecution of violent crimes, especially sexual exploitation and domestic violence against women and children.

America after the Attacks The U.S. War on Terrorism ATTORNEY GENERAL ASHCROFT: Mr. Chairman, Senator Hatch, members of the Judiciary Committee, thank you for this opportunity to testify today. It is a pleasure to be back in the United States Senate. On the morning of September 11, as the United States came under attack, I was in an airplane with several members of the Justice Department en route to Milwaukee, in the skies over the Great Lakes. By the time we could return to Washington, thousands of people had been murdered at the World Trade Center. 189 were dead at the Pentagon. Forty-four had crashed to the ground in Pennsylvania. From that moment, at the command of the President of the United States, I began to mobilize the resources of the Department of Justice toward one single, over-arching and over-riding objective: to save innocent lives from further acts of terrorism. America's campaign to save innocent lives from terrorists is now 87 days old. It has brought me back to this committee to report to you in accordance with Congress's oversight role. I welcome this opportunity to clarify for you and the American people how the Justice Department is working to protect American lives while preserving American liberties.
