    July 17, 1998 To meet new federal requirements, Arkansas replaced the old AFDC program with the Transitional Employment Assistance (TEA) Program on July 1, 1997. Below is a summary of major policy changes impacting TEA clients that were made to the TEA program during its first year of operation. Most of these changes have been added to the TEA Policies and Procedures Manual, the official regulatory guide for the TEA program. Employability and Educational Assessments.
    The level and type of educational assessment required of each TEA customer has been strengthened. Under previous regulations, the level of assessment was left to the discretion of the caseworker and could range from a self-administered assessment to a more in-depth assessment. Under the new regulations, an employability and educational assessment using TABE (Test of Adult Basic Education) must be conducted for each adult unless (1) he/she is exempt or deferred from work requirements or (2) an employability and educational assessment was completed on the client during the last six months (TEA 3100). Beyond the educational assessment (TABE), other assessments may also be conducted at the discretion of the caseworker. TABE testing will be done only after case approval. Transportation
    Each TEA cash assistance recipient may now receive payments or reimbursements for TEA-related transportation expenses up to $200 per month (previous limit was $175 per month). TEA 3410. As before, transportation assistance ends when the client has received his/her first full paycheck. County Administrators may now approve exceptions to the $200 limit and/or the continuation of assistance past the first full paycheck in limited situations (TEA 3410.1). These exceptions will be limited to situations in which the client would be unable to participate in employment or work activities unless the exception is allowed. Another major change is that TEA cases which close due to employment will automatically be eligible to receive two months of extended support transportation assistance (TEA 5140).

The Board of Directors of each school district in the State has the authority to adopt student attendance policies (§80-1504). All children who desire to be released for religious purposes should present a written request to the local School Board of Directors. EDUCATION REGULATIONS: (Policy) None CASES: No Cases Reported. ATTORNEY GENERAL OPINIONS: None SCRIPTURE UNION Recommendations: Like your state, many do not have specific laws or guidelines concerning Released Time. The absence of a specific law does not necessarily prohibit Released Time programs. In fact, it may allow a wider range of Released Time programs. For example, it is possible to offer Released Time classes as an off-campus elective class on the High School or Junior High level, which students take daily. This is being done in states such as Georgia, Florida, Utah, Arizona, and Idaho. The particular challenge in your state is that in the absence of a specific statute, you will need to conduct research into the legal background of Released Time at the federal level (Scripture Union can help!), and how decisions are made within your school system. The majority of school districts would require approval at the school board level, but many are moving to "site-based management," which would perhaps allow individual school principals to approve a Released Time program. Once your research is complete, you will need to approach the appropriate decision-maker(s) with a proposal for a Released Time class.

    I want to discuss the Arkansas Higher Education Reform Act of 199x. It's coming! The handwriting is on the proverbial wall. The real challenge before us will be to ensure that the legislation will be reflective and forward thinking rather than reactive. To understand this challenge, we need a bit of history. Our story begins with the 1960'S space race. The Kennedy administration wanted to be first in space. To be first in space, one needs to be first in science and technology. So the Federal Government did what it does best. As Carl Sagan might explain, it threw 'billions and billions and billions' of dollars at the problem. Research became the primary pursuit of some university faculty for the first time in history, and 'external funding' became a common term in academic households. Academic administrations looked to external funding to solve their resource problems because of the luscious 'indirect costs' (hefty surcharge under 'cost-of-doing-business' rubric). Everyone was happy. For awhile, at least. While the story above is an oversimplification, there is a great deal of truth to it. The Higher Education Reform Acts which are currently being considered around the country are a fallout from the rapid change which universities have undergone in the past few decades. At the heart of this legislative initiative is accountability - making the institutions accountable to the public for the monies expended. Nothing wrong with requiring accountability per se, so long as it is some genuine measure of something important. All too often, however, we fall into the trap of what I shall call 'measurement mania' where we expend countless energy measuring what we can rather than what we should.

    The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
    There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.
