Arizona Becomes 33rd State to Adopt Massage Regulations
Arizona has become the 33rd state to pass massage therapy legislation. Senate Bill (SB) 1103, sponsored by Sen. Carolyn Allen, et al., was signed on May 12, 2003 by Governor Janet Napolitano, and will be formally introduced into law on July 1, 2004. Elements of the bill could potentially assist massage therapists who have experienced difficulties practicing massage in multiple jurisdictions. Currently, individual municipalities have their own massage regulations, some of which contradict one another; this makes it difficult for massage therapists to work in more than one city. The Arizona House of Representatives cites this example: "... a massage/bodywork therapist practicing in Phoenix only needs 500 educational hours, while a therapist practicing in Chandler would need 700 educational hours. The cost of a license also varies depending on the municipality." Statewide licensure will require that all applicants meet the same criteria. Applicants will initially be required to complete a minimum of 500 hours of massage therapy education; pass a board-approved examination; and supply a complete set of fingerprints for state and federal background checks.

Arizona Cities Hit With Additional Massage Regulations
Less than one month after Arizona Governor Janet Napolitano, signed SB 1103 - a bill that would regulate the practice of massage therapy ( www.massagetoday.com/archives/2003/07/01.html ) - into law, Scottsdale and Phoenix have adopted their own massage regulations. On June 3, the Scottsdale City Council voted unanimously to tighten the reigns on the massage therapy profession in an effort to close illegitimate massage sites and bring an end to prostitution masquerading as massage. Shortly following the Scottsdale decision, which took effect July 3, the city of Phoenix followed suit, voting on June 25 to implement new rules governing the profession for the same reason. The Phoenix ordinance is scheduled to take effect July 25. The regulations will likely affect many massage therapists legitimately practicing in both areas.

Arizona District Court Upholds “Lou Anne's Law” On September 30, the U.S. District Court in Tucson upheld in substantial part Arizona’s comprehensive abortion clinic regulations known as “Lou Anne’s Law,” rejecting the vast majority of the constitutional challenges brought by three Arizona abortion providers. “This is a tremendous victory for the women of Arizona,” said Denise Burke, staff counsel with Americans United for Life (AUL). Burke, along with Nikolas T. Nikas, AUL’s general counsel, has been appointed a Special Assistant Maricopa County Attorney to defend “Lou Anne’s Law.” “Women in Arizona and elsewhere have been the victims of the abortion industry's refusal to police itself. In opposing these common-sense regulations, the abortion industry reveals an ugly agenda—pocketing profits instead of investing in women's safety. How many more women need to die or be permanently injured from unsafe abortions? Until now, a veterinary clinic had more safety regulations.” “Lou Anne’s Law” was passed in direct response to the tragic 1998 death in a Phoenix abortion clinic of Lou Anne Herron. She bled to death after her uterus was punctured by an abortion provider, who later left the clinic while she was bleeding heavily in the recovery room and in need of immediate emergency care. The abortion provider, John Biskind, was later convicted of manslaughter and is currently serving a five-year prison sentence.

Court Arguments Held on Safety Regulations for Abortion Clinics TUCSON, April 8—Federal District Judge Raner C. Collins heard arguments today concerning the constitutionality of "Lou Anne's Law," a comprehensive set of health and safety regulations for abortion clinics adopted by Arizona in 1999. "Lou Anne's Law" was passed in direct response to the tragic and preventable death of Lou Anne Herron at a Phoenix abortion clinic. In April 1998, Ms. Herron, a thirty-two-year old mother of two, was left to bleed for three hours after her uterus was lacerated during a late-term abortion. Dr. John Biskind, the abortion provider, ignored requests to check on her and left the clinic to visit his tailor—while Ms. Herron was still bleeding. An ambulance was not called until more than three hours after the botched abortion and, by the time the emergency crew arrived at the clinic, Lou Anne Herron was dead. (In February 2001, Biskind was convicted of manslaughter in the death of Ms. Herron and is currently serving a five-year prison sentence.) "The state of Arizona has an important and legitimate interest in protecting women's health," said Denise Burke, staff counsel with Americans United for Life and Special Deputy Maricopa County Attorney appointed to defend "Lou Anne's Law."
