The German Welfare Laws
Why should German Welfare laws interest anyone outside Germany? First and foremost, any welfare laws and rules should be of immediate interest to anyone involved in pet breeding and pet keeping. There is some controversy over the proposals published by the German Ministry for Consumer Protection (BMVEL) in Bonn in October 2000. In a booklet, a number of problem breeds and varieties were identified. In 1995, a Multilateral Consultation took place to discuss the European Convention for the Protection of Pet Animals and a resolution was published which included extensive guidelines for the revision of breeding policies. These guidelines form the basis for the proposed German breeding regulations.

This project, the first of its kind in North America, was spearheaded by Mary Zilney, Family Services Supervisor at Family and Children’s Services (FCS) of Guelph and Wellington County and Lorna Ronald, Executive Director at the Guelph Humane Society (HS). Statistical analysis was conducted by Lisa Anne Zilney, Ph.D. candidate at the University of Tennessee. Purpose of the Research
To examine the link between animal and child cruelty by gathering statistics in Wellington County’s urban and rural locales. Abuse concerns were reported between the HS and FCS, to use the knowledge gained as an educational tool to raise awareness of this connection of violence. Methodology
Investigators from both agencies were required to complete a checklist for each new investigation, prompting workers to ask questions about both animals and children in the home. Implementation of the checklist and data collection commenced February 1, 2001 and ended January 31, 2002.

    (b) The number and-severity of these attacks are attributable to the failure of owners to register, confine, and properly control vicious and potentially dangerous dogs.
    (c) The necessity for the regulation and control of vicious and potentially dangerous dogs is a statewide problem, requiring statewide regulation, and existing laws are inadequate to deal with the threat to public health and safety posed by vicious and potentially dangerous dogs.

    I recently readand was much dismayedby an article on the subject of "pitbulls" by Naomi Lakritz in the Calgary Herald . As a dog owner (originally from the US and living for some years in the Netherlands), I find very worrisome any call anywhere for Breed Specific Legislation, and as the owner of a Staffordshire Bull Terrier, which is often placed under the "pitbull" rubric, these worries become quite personal.
    I am as well a writer and a historian, and I find it disturbing that Ms. Lakritz apparently did little research in producing what must be characterized as an inflammatory and having been publishing art and culture criticism for nearly 15 years a good part of my own writing is necessarily the expression of a very personal point-of-view.

    TO THE EUROPEAN COMMISSION
    JUNE 2001 On the 7th June 2001 representatives of The Kennel Club travelled to Brussels to attend a meeting with Michael Scannell - a Member of Mr David Byrne's* Cabinet, who specialises in Animal Welfare Legislation, and Paul Remits - a European Commission legal advisor, to discuss the current 'dangerous dog' legislation being perpetrated in Germany and other areas of Europe. The meeting lasted for over an hour and was considered constructive by all parties. Interestingly, Mr Scannell said "Whilst dog welfare issues are not always high on the political agenda, the German situation has made a significant impact and could easily be measured on the Richter scale"! Both Mr Scannell and Mr Remits confirmed that their colleagues had been inundated with protest correspondence predominantly from the UK, and their postbags continued to bulge! The Kennel Club were encouraged to learn that this is seen as a positive factor by all those connected with the European Parliament who have received letters and many now have large reference files. For all those who have already written: your time and postage was certainly not wasted as the matter is being taken very seriously as a result. The Kennel Club reiterated its policy regarding so called dangerous and vicious dogs: 'Punish the deed, not the breed' - based on the circumstances of individual occurrences. Breed specific legislation is not the solution, as it is unacceptable to ban all dogs of a specific breed based on the actions of a single animal. This factor was taken on board by the Commissioner's colleagues and fully appreciated.

    It was clear from the meeting that UK dog lovers deserve congratulations for keeping the issue on the political agenda. Parliaments both here and abroad are aware of the situation and also aware of the strength of feeling. The EU will continue to ask the German Chancellor for the rationale behind the decision to outlaw breeds like the Staffordshire Bull Terrier and Bull Terrier, when there is clear evidence that they cannot be held responsible for incidents in Germany. WHAT YOU CAN DO!
    Please consider writing to your MP, MEP, Mr Blair and the German Government and German Embassy (even if you have already done so), to keep this issue firmly in the public spotlight and on the political agenda. Writing again is important as the situation has changed since April 2001 when these laws came into force in Germany and not everyone will be fully aware of the changes. Contact YOUR MP and MEP and let them know what YOU think now.
