    House Bill 1012 (Delegate Scott) was identical to House Bill 707 so it was incorporated into House Bill 707. Senate Bill 235

    Section L is removed from 3.1-796.115 that states that adequate care shall only apply to companion animals. This provision has forced judges to give animals back to those who starve them. This bill also adds the federal definition of soring of horses, and includes the soring of horses as cruelty to animals. House Bill 773

    This bill limits animal shelter notification and public accessibility requirements to those animal shelters that confine animals not received from their owner or from another releasing agency. This bill also limits notification to the pounds to those animals that the releasing agency finds or that have not been received from an owner.
    A provision is also included to limit the number of companion animals that a foster home can keep to no more than 50. The penalty for failure to comply with the provisions for home bases rescues/foster homes, as it relates to 3.1-796.96:5 and 3.1-796.96:6, is changed from a Class 1 misdemeanor to a civil penalty, not to exceed $250.
    The final provision of this bill requires individuals finding a companion animal, within 48 hours to make a reasonable attempt to notify the owner of the animal and to notify the pound in the locality where the animal was found. The penalty for this provision is civil, not to exceed $50.

    The civil penalty language for animal shelters that includes the term "operator" in 3.1-796.120 is removed. This language is no longer needed because it is in 3.1-796.96:2.

    WHY ANIMAL DISASTER PREPAREDNESS?

    Animal Disaster Preparedness (ADP); What is it and do we really need to be concerned about it? Imagine these few scenes: Early morning, rains begin to cause the river to rise. Soon the news is that you have to prepare to evacuate, then it is confirmed that you have to leave. Are you ready in 20 minutes? How about your pets? You leave food and water out, animals and valuables upstairs, and guess what, you loose everything: Including your pets whose futile cries rendered them horse. They all died by drowning, crying out in vain for human help. You awaken to massive movement like the kids jumping on your bed or someone playing a bad joke on you. Around you your home creaks and collapses. You barely escape with your family. Once things settle down where are your pets? The cat, untagged and unmarked has bolted through the broken window, your fence has fallen down around the house and your dog is gone. Your children are frantic about their pets, what do you tell them? Fortunately at dusk several days later you find your cat, you can't catch her and don't have anywhere to put her if you did, at least you can feed her and the kids are reassured. No luck at the local shelters looking for your dog. There is nothing to make signs with and no photos to help with locating him. The roads are so bad it is not an easy trip to check daily or even get near the other surrounding area shelters; the phones are out so you can't call. What could you have done?

More Shelter Links Five Rescues Harley, pictured above, came out of a local shelter on his last daydue to be euthanized at closing time. It took three baths to reveal the beautiful Australian Shepherd underneath coats of reddish mud and dust. After several weeks with us in foster care, a longer period with a great Aussie Rescue foster family, and a brief inappropriate placement, Harley went to his "forever" home with someone who appreciates him as he deserves. Who could possibly not appreciate a dog like this? Yes, all three of the pictures below also show rescued dogsone from a shelter, two from breed rescue. Right: Kohl, who arrived with severe demodectic mange and bad hips, belonged to a student who couldn't cope with his terrible health problems. As a responsible owner who wanted the best for the dog, he listed Kohl with German Shepherd Rescue. The picture you see here was taken nearly eight years later. Today Kohl is going strong at nearly ten years of age. At left (click for larger picture): Kirsten, who was found tied to a shelter fence, and weighing only 43 pounds, regained excellent health. She lived several more happy years despite a chronic condition, Exocrine Pancreatic Insufficiency.
