The time for filing comments has expired, and the Board has considered the application and all comments received in light of the factors set forth in sections 3 and 4 of the BHC Act. Regions, with total consolidated assets of approximately $24.4 billion, operates banks in Alabama, Florida, Georgia, South Carolina, Louisiana, and Tennessee, and engages in a number of permissible nonbanking activities. Regions is the largest commercial banking organization in Alabama, controlling deposits of approximately $9 billion, representing 19.4 percent of total deposits in commercial banking organizations in the state ("state deposits"). First Commercial, with total consolidated assets of approximately $7.4 billion, operates banks in Arkansas, Texas, Tennessee, Louisiana, and Oklahoma and engages in mortgage and trust company activities through its nonbanking subsidiaries. First Commercial is the largest commercial banking organization in Arkansas, controlling deposits of approximately $4.7 billion, representing 17.3 percent of Arkansas state deposits.

Alabama NRCS Announces Special Poultry Litter Distribution Project
The Alabama Litter Distribution Project, a special project for Alabama designated by the NRCS State Conservationist, is now funded by 2004 Environmental Quality Incentive Program (EQIP) funds at the state level. The project has two primary objectives. The first objective is to create an incentive to distribute litter to areas of the state that has historically not used litter. This will reduce litter application in areas where it has traditionally been over applied. The second objective is the promotion of a long-term market for litter as fertilizer around the state to maintain better distribution of the nutrients. This project is intended to fund incentive payments for three years for the hauling of poultry litter under a long-term agreement (LTA) contract. The three years do not have to be consecutive. Money received from this project counts toward the $450,000 limit a farmer can receive in EQIP funds. Applications will be taken on a continuous sign-up basis and will be funded on a first-come, first-served basis. Local field offices will begin accepting applications March 1, 2004

INTRODUCTION AND BACKGROUND
Location of a suitable site is a crucially important step in the planning and installation of new bioenergy plants, because many factors which will determine the success of these plants are site-related. In 1994, Sladden and Bransby (1995) conducted a survey among farmers in Alabama to determine the general potential for growing switchgrass for energy in the state. Subsequently, Graham et al. (1996) used a computer model to identify suitable sites for bioenergy plants in Alabama. However, this model assumed that switchgrass would replace annual rowcrops, and not perennial grassland that is currently used for grazing and hay. In contrast, Sladden and Bransby (1996) argued that switchgrass would more likely replace perennial grassland than rowcrops, because of the lower economic returns associated with grassland enterprises: $170/ha ($69/acre) for beef production from pastures, compared to $272/ha ($110/acre) for rowcrops, as projected by farmers in the survey. Another incentive for the work described in this report was change in the agricultural sector that had occurred since the 1994 survey. In particular, a large number of Conservation Reserve Program (CRP) contracts had expired, and some were not renewed. In addition, profitability in the beef industry had declined sharply, a national survey of beef producers showing that nearly 50% of cow-calf operations were not profitable in 1996, compared to only 15% in 1994.

Alabama's Shame: Its 1901 Constitution. Alabamians want modern schools, high paying jobs and efficient government. Yet, curiously, they tolerate an antiquated state constitution that works against those desires. It contains articles that denied the use of state funds for internal improvements such as roads and bridges, disenfranchised poor whites and almost all blacks from voting, banned marriage between any white person and a negro or descendent of a negro. It embeds tax codes that promote an unfair tax system that penalizes low income families and deprives poor counties of adequate revenues to suppport schools and other social needs.
