constraints prevent this, then a public agency may charge a nominal

a substantial amount of employee's time is required. 184 Ala. Op.
Atty. Gen. 27 (Aug. 25, 1981). There is a statutory authority for the
collection of fees to defray costs of providing a citizen with

Analysis of Textbooks in Alabama
I. General Observations
During the process of reviewing science textbooks for use in Alabama public schools, members of the 1995 Alabama State Textbook Committee found numerous problems with the books submitted for adoption. A detailed examination of these problems follows. A major class of problems concerns the way in which explanations of origins are presented in the texts. It was felt by a minority (six members of the State Textbook Committee) that many of the books violate an important directive of the Alabama State Board of Education. On March 9, 1995, this Board unanimously required that the Alabama Course of Study - Science include the following amendment: "Explanations of the origin of life and major groups of plants and animals, including humans, shall be treated as theory and not as fact. When attempting to apply scientific knowledge to world problems, no social agenda shall be promoted." This statement was deemed necessary by the State Board of Education to insure that the children of Alabama receive training in how to think rather than in what to think, and that they receive good science education, not ideological indoctrination.

Box 302101 Montgomery, Alabama 36130-2101 Dear Ms. Holloway: This is in response to the information you provided this Office on January 23, 2004. Specifically, you faxed us a memorandum dated April 22, 2003 from Donald E. Williamson, M.D., State Health Officer, Alabama Department of Public Health (DPH), that was addressed to superintendents and head masters. In the memorandum, Dr. Williamson noted that concerns had been raised regarding the "sharing information with the [DPH] regarding immunizations." Dr. Williamson went on to state that the Health Insurance Portability and Accountability Act of 1996 (HIPAA) applies to students' immunization records and that HIPAA permits schools to disclose these records to the DPH. He also stated: The U.S. Department of Health and Human Services (HHS), who promulgated the HIPAA regulations, and the Centers for Disease Control [and Prevention] (CDC) recently emphasized the public health exception to HIPAA in guidance issued on April 11, 2003. The guidance states that covered entities may disclose protected health information to public health entities, without patient authorization, for the conduct of public health surveillance, investigations, or interventions, as well as for the purpose of preventing or controlling diseases. Additionally, the HHS Office of Civil Rights guidance issued on July 6, 2001 states that covered entities may rely on the judgement (sic) of a public health entity when requesting a disclosure as to the minimum amount of information that is needed by Public Health.

Post Office Box 1033 Alamo, CA 94505-7033 Re: Corporal Punishment Dear Mr. Riak: Dr. Richardson requested that I respond to your letter dated August 14, 1997, concerning corporal punishment in public schools in the state of Alabama. Ala. Code §§ 16-28A-1 through -5 (1975), requires each local board of education to develop a written policy on student discipline and behavior. Pursuant to this statute all teachers and administrators in each classroom are expected to maintain order and discipline and are thereby given the authority and responsibility to use appropriate means of discipline, up to and including corporal punishment, consistent with local board of education written policies. Ala. Code § 16-1-24.1 (1975) requires local boards to adopt and make available to all teachers, school personnel, students, and parents/guardians, at the beginning of the school year, a code of student conduct developed in consultation with teachers, school personnel, students, and parents/guardians. The code shall include, but not be limited to, specific grounds for disciplinary action and procedures to be followed for acts requiring discipline. Consistent with these state laws, corporal punishment should only be administered in compliance with a written discipline policy adopted by a local board of education.

The Model School Inclusion Award (MSIA) is a project of the Alabama Council for Developmental Disabilities that was designed to recognize and reward the work of public school personnel who make inclusive education a reality for students with disabilities. The winner of the 2003 MSIA is the Homewood Middle School 6th Grade General Education Team that consists of team leaders Peggy Sheffield, Malinda Tankersley, and Lynn Burgess and team members Kiana Billings and Jana Kelley, Janice Dinkins and Pat Martin, Donna Johnson and Michelle Jones, Melinda Morris and Rachel Paden, and Pam Brown, Carol Heinse, and Joy Brunson. The inclusion team was presented with the award and check for $1,000 at the State Department of Education Mega Conference in Mobile on June 19, 2003. Homewood Middle School implements their school inclusion practices through a co-teaching concept that begins with a transition program in the spring before 5th graders move up to Homewood Middle School. The resource room teachers, special education teacher, general education teacher teams, and school administrators work together during the summer to identify the type of instruction needed by each student. Students' Fall schedules are consequently set up to ensure that everyone, including students who have disabilities, have a smooth transition into Homewood Middle School.

labama continues to take steps to improve its schools, but it can't escape such facts of life as limited money for education and the influence of special interests. The powerful state teachers' union, the Alabama Education Association, made lowering class sizes a priority last year. And both the state school board and the legislature took action to help. But the legislature also failed to approve a $125 million bond issue that would have paid for a statewide computer network, a central part of the state's ambitious plan for educational technology. Among the opponents: the AEA. The union, a National Education Association affiliate, backed a smaller, $35 million bond issue that the legislature was expected to address this month. Legislators also shrank the amount of money per teacher that was devoted to technology, dropping it from $200 a teacher last year to $75 this year. That reduction occurred, a state education department analyst says, because the budget was written at a time when lawmakers were looking at the more sizable technology bond issue. After Gov. Fob James Jr., a Republican, vetoed both the education and general-fund budgets last May, the legislature passed the $3.7 billion education budget in a special session in September.
