MIAMI A Florida college professor is claiming the hit television show "American Idol" is breaking the law by limiting the age of its contestants. Rules for "American Idol" say you can't be older than 24. So, Drew Cummings has filed complaints with the state and federal agencies that enforce anti-discrimination laws. Cummings says it's illegal to have an age cutoff. Last season, 23-year-old Kelly Clarkson won a $1 million recording contract in the "American Idol" competition. Her debut single "A Moment Like This" went on to make Billboard chart history with the biggest-ever leap to No. 1. The agencies have six months to review the charges. After that, Cummings could file lawsuits. Cummings says he finds "it hard to believe that age plays a part in determining the next American Idol." Cummings said, "Age discrimination runs rampant in the entertainment industry and corporate America. It's time that someone did something about it."

Federal Anti-Discrimination Laws
Here's a description of the major federal laws that prohibit discrimination in the workplace. There are a number of federal laws that prohibit discrimination in the workplace. Most apply to select employers but a few apply to virtually all employers. The main laws that employers should be aware of are:
Title VII of the Civil Rights Act of 1964 (42 U.S.C. §§ 2000e and following)
Title VII prohibits employers from discriminating against applicants and employees on the basis of race or color, religion, sex, pregnancy, childbirth and national origin (including membership in a Native American tribe). It also prohibits employers from retaliating against an applicant or employee who asserts his or her rights under the law. Transcultural psychiatry has been based on race and geography. There is another group whose culture demands a distinct approach to their psychiatric needs. The prelingually deaf are a distinct group of individuals who have been profoundly deaf since birth or early childhood and who communicate using Sign Language. Unlike those who have gone deaf in later life they have generally never heard the spoken word. English is their second language. They have a unique culture of their own. When writing the word deaf they use a capital D to signify that they identify themselves as part of the Deaf culture. Different Lives

What is the current mental health provision for Deaf people? There are three Deaf services in the UK (London, Birmingham and Manchester). These are mainly aimed at the adults of working age population. All services will see people over the age of 65 years. Referrals for this group are low in number, experience is never really built up and the medical and psychosocial interventions used in old age psychiatry forgotten. Conversely, the local Old Age Psychiatrist may not have the knowledge and experience of Deaf culture or Sign Language. Many do not get referred at all. We know from research in the Deaf general adult population that this lack of familiarity can lead to misdiagnoses and mismanagement.

Age Discrimination At Work
2 December 2002 People who suffer discrimination at work are more likely to be a victim because of their age than any other factor, including race or gender - according to new research from the MORI Social Research Institute. Older workers are considered to be resistant to change and training and lacking technological skills, whilst younger workers are thought to be inexperienced, unreliable, irresponsible, more likely to throw 'sickies' and lacking organisational skills. The research - commissioned by Age Positive to coincide with the start of Age Positive Week - shows that one in five people (22%) have experienced some form of discrimination in the workplace. Of those almost two in five (38%) cite that it was due to their age - by far the biggest cause mentioned. Looking just at those people who feel they have been discriminated against because of their age, almost two in five (38%) say this happened during the initial recruitment process. Others say it was during the promotion process (25%), during the selection stage (25%) and during training and development (16%). Age discrimination during the recruitment process is far more common amongst men, with more than two in five (45%) of the male victims of age discrimination citing it in contrast to a quarter (27%) of the women. Indeed, a similar percentage of the women (26%) suggest that age discrimination is as common in the promotion process as it is during recruitment for a job or career.
