Hate Crimes, Discrimination, and Harassment
According to the federal government, hate crimes against Muslims and people of Middle Eastern ethnicity in 2001 increased by 1,600 percent over the previous year. The FBI's Uniform Crime Reporting Program released its annual Hate Crimes Statistics report on November 25, 2002. The report documents 481 hate crimes against Arabs and Muslims in the United States during 2001, a massive increase from the 28 cases reported in 2000. Reports from other groups, including the American Arab Anti-Discrimination Committee, the Council on American-Islamic Relations, and Human Rights Watch confirm the severity of the backlash suffered by Arabs and Muslims in the United States after September 11. Incidents included employment discrimination, airport profiling, verbal harassment, vandalism, physical assaults and at least three murders. The Department of Justice has brought federal criminal charges against a number of individuals in connection with hate crimes against Arab Americans, Muslim Americans, Sikh Americans, South-Asian Americans, and those perceived to be members of these communities. In addition, the Department's Civil Rights Division directs a National Origin Working Group which conducts outreach to affected communities and offers information about DOJ resources for victims of discrimination and abuse.

I. FEDERAL 1. The CIVIL RIGHTS ACTS - include: a. 42 U.S.C. § 1971, et seq. - the Voting Rights Act of 1965 - guarantees the right to vote to all "otherwise qualified at law" citizens of the U.S. "without distinction of race, color, or previous condition of servitude."
b. 42 U.S.C. § 1975 - establishing the commission on Civil Rights - to insure that no person is denied equal protection of the laws on account of "race, color, religion, sex, age, handicap, or national origin."
c. 42 U.S.C. § 1981 all "persons" within territorial jurisdiction of the U.S. have equal rights to "make and enforce contracts, to sue, to be parties, give evidence, and to the full and equal benefits of all laws and proceedings for the security of persons or property ..." as is enjoyed by white citizens.
e. 42 U.S.C. § 1982 All "citizens" of the U.S. shall have the same right to "inherit, purchase, lease, sell hold and convey real and personal property."

Defendants/appellants the California Public Utilities Commission and various individual employees (collectively "the PUC") appeal from judgment after a jury verdict awarding (1) plaintiff/appellee Maurice Crommie $151,920 plus 10% interest and costs, and (2) plaintiff/appellee Arthur Mangold $164,052 plus 10% interest and costs against the PUC for violating the Age Discrimination in Employment Act, 29 U.S.C. ss 621, et seq. (ADEA), the California Fair Employment and Housing Act, Cal. Gov. Code ss 12940, et seq. (FEHA), and California common law. The PUC also appeals from the award of $724,380 in attorneys' fees. We have jurisdiction under 28 U.S.C. s 1291 and we affirm the judgment and fee award, but remand for recomputation of post- judgment interest. FACTUAL BACKGROUND These two consolidated cases arise from allegations of age discrimination in promotions by the PUC from the mid-1980s to the early-1990s. Mr. Crommie filed his action in state court October 12, 1989; Mr. Mangold, on February 21, 1989. After the cases were removed, Plaintiffs filed amended complaints, and the cases were consolidated. Meanwhile, the EEOC filed class action suits against the PUC on behalf of 43 other PUC workers who were denied promotion opportunities.

What does this mean to you and me and what can we expect from society on this new adventure. Most people will experience a smooth transition from middle age to old age, but unfortunately some people will experience the harsh reality that others do not always deal in the most appropriate way with aging individuals. It is to these people that I address the issue of age discrimination in employment and attempt to create a lifeline for those who need answers and direction when life is treating them unfair. Age discrimination in the workplace is prevalent even today. Many employers still don't question outmoded stereotypes about the declining abilities of older workers. They still wrongly assume that older workers cost more to train, are more likely to leave sooner, and that they are less up-to-date in their skills. In addition many older workers do not know their rights or how to pursue them. Consequently their jobs are unprotected, and proving age discrimination can be difficult even with the right guidance. Congress, as well as some states, in their wisdom has attempted to effectuate this guidance for our older generations. I.
