Policy II.2 Subject Contracts Authority 25 TAC §621.29 Purpose To provide a written agreement of duties, responsibilities and other terms and conditions between the Interagency Council on Early Childhood Intervention and the ECI provider. Policy 1. All applicants for funds will be notified in writing, after application review, of the ECI Board's decision to approve or deny funding. 2. Contracts will be sent to ECI providers for signature after ECI Board approval. 3. An approved ECI provider must return a signed contract to the ECI State Office prior to any request for reimbursement. 4. ECI providers must comply with all applicable statutes, rules and policies of the Council, including subsequent amendments, and fiscal requirements on the administration, accounting, auditing and recovering of funds as authorized by the Uniform Grant Management Standards (UGMS) and the OMB Circulars incorporated therein. 5. I. Statement of the Case
This matter is before the Authority on exceptions to an award of Arbitrator Stephen L. Hayford filed by the Union under section 7122(a) of the Federal Service Labor-Management Relations Statute (the Statute) and part 2425 of the Authority's Regulations. The Agency did not file an opposition to the Union's exceptions. The Arbitrator sustained, in part, a grievance alleging that the Grievant's involuntary reassignment from Lake Charles, Louisiana to New Orleans was disciplinary and not implemented in accordance with the parties' collective bargaining agreement. As a remedy, he directed that the reassignment be rescinded and any record of the action be expunged. The Arbitrator denied the remainder of the grievance, including, as relevant here, claims that the Grievant was reassigned in retaliation for a sexual harassment complaint and whistleblower complaints filed by the Grievant against his immediate supervisor. For the following reasons, we conclude that the Union has failed to establish that the award is deficient under section 7122(a) of the Statute. Accordingly, we deny the Union's exceptions.

Please Note: This exemption was approved by the Commission on April 22, 2004, for circulation to other federal agencies and the Office of Management and Budget (OMB). It will not become final until it is approved by OMB and is published in the Federal Register. AGENCY: U.S. Equal Employment Opportunity Commission ACTION: Final rule. SUMMARY: The Equal Employment Opportunity Commission is publishing this final rule so that employers may create, adopt, and maintain a wide range of retiree health plan designs, such as Medicare bridge plans and Medicare wrap-around plans, without violating the Age Discrimination in Employment Act of 1967 (ADEA). To address concerns that the ADEA may be construed to create an incentive for employers to eliminate or reduce retiree health benefits, EEOC is creating a narrow exemption from the prohibitions of the ADEA for the practice of coordinating employer-sponsored retiree health benefits with eligibility for Medicare or a comparable State health benefits program. The rule does not otherwise affect an employer's ability to offer health or other employment benefits to retirees, consistent with the law.     Traveling With Your Pet Dogs, cats, and most other warm-blooded animals transported in commerce are protected by the Animal Welfare Act (AWA). The U.S. Department of Agriculture¹s (USDA) Animal and Plant Health Inspection Service (APHIS) enforces this law. APHIS¹ shipping regulations help ensure that people who transport and handle animals covered under the AWA treat them humanely. Airlines and other shippers are affected by regulations established to protect the well­being of animals in transit. Trip Preparation for Air Transportation Before taking a flight with your animal, have your veterinarian examine your pet to ensure that it is healthy enough to make the trip. Airlines and State health officials generally require health certificates for all animals transported by air. In most cases, health certificates must be issued by a licensed veterinarian who examined the animal within 10 days of transport. Ask your veterinarian to provide any required vaccinations or treatments. Administer tranquilizers only if specifically prescribed by your veterinarian and only in the prescribed dosage. Trips Outside the Continental United States Hawaii, U.S. territories, and certain foreign governments have quarantine or health requirements for arriving pets. For information on Hawaii¹s requirements, contact your State Veterinarian¹s office. For U.S. territories and foreign countries, contact the appropriate embassy, governmental agency, or consulate at least 4 weeks in advance. You may also contact a full-service travel agency for assistance. Additional airline requirements also exist for inter-national flights. These rules may require additional ventilation, labeling, and a shipper¹s certification. Contact your airline for information about these requirements.

    Fed Older Worker League, an Employee Formed Organization, Addresses
    the Issues of Growing Numbers of Older Federal Employees
    The Fed Older Worker League (Fed OWL) is a voluntary non-labor organization which targets issues of interest to all Federal employees but with an emphasis on issues impacting people who are forty or over. Membership is free and currently includes approximately 3,000 Federal employees from 12 different departments and agencies across the U.S. The organization’s membership is open to all individuals, regardless of age, race, color, religion, sex, national origin, or sexual orientation. Fed OWL Co-Founder and President, Alan Lewis, established the organization in March 1999. As a Federal employee, Alan felt, as did other colleagues, that there was an increased need for awareness among management and employees about issues impacting older employees. "I felt that the many issues that impact older Americans were not being addressed in the workplace: long term health care; elder care; life-long learning; continued opportunity to work in a non-hostile environment; and discrimination based on age. Employees needed to understand that these issues impact them so they can be supportive," said Alan. Alan was also concerned about what he called "a lack of inclusion." Instead of investing in the development of older workers, he felt the full focus was on recruiting younger workers. "We should be full partners in the new millennium. The continued opportunities for training, awards, promotions, and management positions should be just as plentiful for older employees," Alan said. "I also saw a lack of sensitivity in agencies about the value in retaining older workers. There is a need to challenge negative misconceptions about older workers."

Test papers completed by applicants which disclose the results of employment tests. The results of physical exams considered by the employer in connection with any personnel action.
