    Origin and Mandate
      During the negotiations that led to South Africa's first elections on the basis of universal suffrage in April 1994 and the transition from a minority regime to a democratically elected government, much emphasis was placed on the need for new constitutional arrangements to ensure that the appalling human rights abuses of South Africa's past could not be repeated. The interim constitution, which was adopted in December 1993 and came into force following the elections, accordingly provided for the establishment of a range of bodies to monitor government compliance with human rights standards, including a national human rights commission. Legislation was drafted once the new government of national unity led by the African National Congress (ANC) took office, and President Nelson Mandela signed the Human Rights Commission Act, No. 54 of 1994, into law on November 24, 1994. The act came into force in September 1995 and the commission held its inaugural meeting in October 1995.
    Chapter 9 of the final constitution, which was drafted by the parliament elected in 1994 sitting as a constitutional assembly and came into force in February 1997, confirmed the position of the South African Human Rights Commission (SAHRC) as one of the "state institutions supporting constitutional democracy," along with the Commission on Gender Equality, the Public Protector, the Auditor-General, the Electoral Commission, the Commission for the Promotion and Protection of the Rights of Cultural, Religious and Linguistic Minorities, and the Independent Authority to Regulate Broadcasting.

    As much as half of South Africa's workforce participated in a 24-hour nation-wide general strike called by the 1.8 million strong Congress of South African Trade Unions (COSATU) on May 10th. According to COSATU's own estimates four million workers followed the call to strike. Support for the strike was stronger in the highly industrial region of Witwatersrand (which includes Johannesburg) with 90% of the workers participating and 150,000 marching through the streets of Johannesburg. Western and Eastern Cape registered between 70 and 75% of the workers following the strike, and in KwaZulu-Natal, Mpumalanga, Northern Province and Northern Cape the level of support was around 50%. In areas like Pietermaritzburg, Ladysmith, Newcastle, Durban and Empangeni and in companies like the South African Motor Company, DaimlerChrysler, half of the mines, Coca-Cola, etc. the support for the strike was almost total 90-100%). There were numerous marches all over the country with 50,000 in Pretoria and Cape Town, 20,000 in Port Elizabeth, 10,000 in Nelspruit, 5,000 in East London and Queenstown. The main reason for the strike was to protest against the massive destruction of jobs which in the last 10 years had totalled 1 million, half of them since the ANC government came to power in 1994. COSATU demanded "the amendment of the Labour Relations Act to make retrenchments a mandatory issue for negotiations with the union", the "change of the Insolvency Act to protect workers in cases of company liquidations", to "halt the unilateral restructuring (i.e. privatisation) of government or state-owned companies", and to "put an end to the accelerated tariff reduction programme to bring South Africa in line with our WTO commitments". Finally COSATU also called for a "thoroughgoing discussion amongst the key stakeholders in the economy in order to find long-term solutions to the structural problems which continue to bewild our economy".

    As we pointed out on Monday , the Nigerian government was threatening to use violent measures against the striking workers. This has been confirmed by the events that have taken place this week. Riot police fired into the crowds of protesting workers on several occasions killing at least four on Monday in Abuja, the capital of Nigeria, and seriously injuring many others. On Monday alone the police had arrested a total of 88 striking workers and demonstrators. Again in Abuja on Tuesday riot police attacked both union activists who were protesting and the journalists who were reporting on the event! Even the president of the Nigerian Labour Congress (NLC), Adams Oshiomole, was tear-gassed! Armed police actually occupied the union headquarters and cordoned it off. About 50 policemen blocked access to the union building to all the workers who were arriving to organise a rally. This kind of behaviour of the police has been repeated throughout the country. The response of the NLC leadership has been to lodge an official complaint and call on the police to behave in a manner that will not lead to unnecessary provocations and clashes. Oshiomole has called on the Chief of Police to investigate the individual policemen who carried out the shooting and the brutal beatings. This would indicate that Oshiomole believes it is a case of a few "rotten apples" and not a conscious decision taken right at the top.

The interim constitution provides for a Government of National Unity and for a five-year transition, during which the final constitution would be drafted by the Constitutional Assembly, consisting of the combined Senate and National Assembly. To understand fully the revolutionary nature of the new government and the direction that the political transition is likely to take in the long term, it is necessary to examine the evolution of the political system that was based on the principles and practices of apartheid.
    Historical Background
    The Union of South Africa became a self-governing dominion within the British Commonwealth on May 31, 1910, when four British dependencies were merged under the South Africa Act passed by the British Parliament in 1909. Unification was interpreted differently by British and by Afrikaner leaders, however. To the British, uniting the four dependencies was central to their imperialist philosophy of consolidating the empire; to many Afrikaners, unity represented a step toward weakening British imperial influence. Ironically, however, this act failed to unite South Africa in a real sense because by excluding the black majority from political participation, it fueled the discontent and the conflict that characterized the country's politics throughout the twentieth century.

    Government in South Africa South Africa is a constitutional democracy with a three-tier system of government and an independent judiciary. The national, provincial and local levels of government all have legislative and executive authority in their own spheres, and are defined in the Constitution as "distinctive, interdependent and interrelated". Operating at both national and provincial levels are advisory bodies drawn from South Africa's traditional leaders. It is a stated intention in the Constitution that the country be run on a system of co-operative governance.
