Chapter 3: The Moral Criterion
Speculative thought comes late in the history of mankind. Men act before they philosophize about their actions. They learned to talk, and developed language, ages before they developed any interest in grammar or linguistics. They worked and saved, planted crops, fashioned tools, built homes, owned, bartered, bought and sold, and developed money, long before they formulated any explicit theories of economics. They developed forms of government and law, and even judges and courts, before they formulated theories of politics or jurisprudence. And they acted implicitly in accordance with a code of morals, rewarded or punished, approved or disapproved of the actions of their fellows in adhering to or violating that code of morals, long before it even occurred to them to inquire into the rationale of what they were doing.
It would seem at first glance both natural and logical, therefore, to begin the study of ethics with an inquiry into the history or evolution of ethical practice and judgments. Certainly we should engage in such an inquiry at some time in the course of our study. Yet ethics is perhaps the one discipline where it seems more profitable to begin at the other end. For ethics is a "normative" science. It is not a science of

Jeremy Bentham
Jeremy Bentham was an English jurist and reformer, born at Houndsditch, London, 15 February, 1748; died in London 6 June, 1832, was of middle-class parentage. After passing through Westminster school he went to Oxford, where he took his Bachelor's degree in 1763 and his Master's degree in 1776. He qualified for the Bar, but soon, disgusted with what he called the "Demon of Chicane", he abandoned the practice of law and devoted himself to the study of philosophers then in favour, chiefly Locke Hume Montesquieu , Helvétius, Beccaria, and Barrington. Under the influence of these writers, he entered upon what proved to be a lifelong and fruitful career of speculation upon the principles of legislation and political government. Bentham's primary purpose was not the construction of theories or the establishment of abstract principles. He first attacked specific abuses in the English system of penal legislation. In tracing these abuses to their source he was led to investigate the ultimate principles of law; and subsequently he undertook to construct a complete science of legislation. In like manner, his efforts to lay bare the evils existing in the legislative machinery carried him on to assail the defects of the British Constitution itself.

In the influential essay in which he claimed that Jeremy Bentham was one of the "great seminal minds" of the age, John Stuart Mill described the characteristic intellectual approach deployed by this father of Utilitarianism . Although on the one hand Mill's presentation of Benthamite method makes it appear the very anthithesis of the poetic, on the other he shows that shares a characteristically Romantic emphasis an emphasis upon particularity, detail, and specific fact. According to Mill, Bentham's method may be shortly described as the method of detail; of treating wholes by separating them into their parts, abstractions by resolving them into Things, classes and generalities by distinguishing them into the individuals of which they are made up; and breaking every question into pieces before attempting to solve it. The precise amount of originality of this process, considered as a logical conception its degree of connexion with the methods of physical science, or with the previous labours of Bacon, Hobbes, or Locke is not an essential consideration in this place. Whatever originality there was in the method in the subjects he applied it to, and in the rigidity with which he adhered to it there was the greatest. Hence his interminable classifications. [220]

Jeremy Bentham (1748-1832)
It is helpful to see Bentham's moral philosophy in the context of his political philosophy, his attempt to find a rational approach to law and legislative action. He argued against "natural law" theory and thought that the classical theories of Plato and Aristotle as well as notions such as Kant's Categorical Imperative were too outdated, confusing and/or controversial to be of much help with society's ills and a program of social reform. He adopted what he took to be a simple and 'scientific' approach to the problems of law and morality and grounded his approach in the "Principle of Utility."

Career Bentham is remembered both as a pioneer of social science and as a tireless advocate of administarative, legal and praliamentary reform. He found in the principle of utility, and in particular in his notorious `felicific calculus', an exact standard by which questions of reform could be settled. The reforms he pressed for were directed towards his four ends of good government: subsistence, abundance, security and equality. He interpreted the economics of Adam Smith in the light of the search for abundance and advocated a state which provided guaranteed employment, minimum wages and a variety of social benefits. Much of his influence on ideas and legistation was through a small but enthusiastic circle of pupils and disciples, amongst whom were many economists, including Ricardo , and James and John Stuart Mill . Only a small portion of his vast literary output was publisched in his own lifetime, and a complete edition of his works projected in 36 volumes is still in preparation. Even his strictly economic writings, a small part of the whole, contain many remarkable contributions that have only come to be properly apprecitated in recent times.
