It's May, and the Blues are out of the playoffs yet again Curiously, fans, media, and even the team's players and management seem to be relatively satisfied following the Note's second-round loss to the Dallas Stars. Seems strange to me...a boast that your team is in the Elite Eight in the NHL?! What doesn't seem strange, though, is the annual April-May renewal of this viewer's fascination with NHL hockey. In fact, I think I've got it nowhockey gets interesting, to me, at about the same time that the US government gets interested in my moneyApril 15. Why is NHL playoff hockey so superior to the regular season dreck that passes for a major league sport? Here's a list of factors that reduce enjoyment of regular season NHL hockey
  • bad ice
  • endless expansion
  • meaningless shifts, periods, and nearly meaningless games
  • dispassionate fans
  • truly incomprehensible officiating
  • run-of-the-mill TV coverage
  • a World Wrestling Federation mentality
How many of these factors apply to the playoff variety of NHL hockey? Bad ice is bad ice.

It’s fitting in a twisted kind of way – Spawn is an undead character, and the Tony Twist v. Todd McFarlane case will not stay dead either. The Missouri Supreme Court has sided with Twist’s lawyers and ruled yesterday that faulty instructions were given to the jurors prior to beginning their deliberations. As such, it’s back to court for Twist and McFarlane. The Supreme Court sided with McFarlane’s successful appeal which overturned the original verdict in the case (Which granted Twist $24.5 million in damages) on virtually all counts, but found that when the jury was instructed in what they should and should not consider in their deliberations: The verdict director given by the court erroneously, though harmlessly, failed to include a requirement that the jury find that the defendants used Twist's identity as well as his name. The fatal flaw in the verdict director was its failure to instruct the jury properly on the commercial advantage element. It erroneously permitted the jury to render a verdict that could have found commercial advantage based on the mere incidental use of Twist's name rather than the intentional use of his name and identity to obtain a commercial advantage. Accordingly, the verdict must be set aside. According to CNN: “Twist's attorney, John Bardgett Sr., said he was pleased his client will get another day in court.”

Supreme Court considers Twist's case against comic book creator

As a professional hockey player, Tony Twist proudly served as a brawling "enforcer" on the ice. But when a comic book creator named a violent character after him, Twist fought back in court. The Missouri Supreme Court on Tuesday heard arguments on Twist's claim that the unauthorized use of his name in the "Spawn" comic book series hurt his image and cost him endorsements and other business. Three years ago, a St. Louis jury awarded Twist $24.5 million in his case against "Spawn" creator Todd McFarlane and other defendants. The trial judge later threw out the award, leading to Twist's appeal. Twist's 10-year National Hockey League career ended when his contract with the St. Louis Blues expired in June 1999. He had been one of the NHL's best-known enforcers, ready to fight to protect teammates against opponents' assaults.

WASHINGTON - The U.S. Supreme Court refused today to consider whether the government acted properly when it withheld names and other details about hundreds of foreigners detained in the months after the Sept. 11 terror attacks. The high court turned down a request to review the secrecy surrounding detainees, nearly all Arabs or Muslims, who were picked up in the United States immediately following the attacks on the World Trade Center and the Pentagon. Many if not most of the more than 700 detainees at issue in the case have since been deported. Some picked up after Sept. 11 were charged with crimes, and others were held as material witnesses. Only Zacarias Moussaoui, who was detained before the Sept. 11 attacks, is being prosecuted in connection with the Sept. 11 attacks.

By Patty McCormac Staff Writer Halloween seems to have been a fitting day for a judge to overturn the $24.5 million judgment against Ahwatukee Foothills resident and Spawn creator Todd McFarlane. "As I read this judgment, it was plain to me that the judge found the case lacked the credible evidence expected in a lawsuit of this magnitude," McFarlane said. "Mr. (Tony) Twist, with his contingency lawyer, spent nothing on this case, while I'm out a half-million dollars and two years of my life defending my name because I knew I was right." The original case was brought against McFarlane by former hockey player Tony Twist who played for the St. Louis Blues and the Canadian-based Nordiques. Twist charged that McFarlane used his name without his permission in the Spawn comic book series. Last July a jury awarded the $24.5 million judgment to Twist which was immediately appealed by McFarlane. On Oct. 31, Missouri Circuit Court Judge Robert H. Dierker threw out the judgment stating that the case lacked "credible evidence that McFarlane at any time intended to injure Twist's marketability to capitalize on the market recognition of the name Tony Twist, or in fact derived any ... benefit whatsoever." He added that when McFarlane first used the name "Antonio Twistelli" or "Tony Twist," the plaintiff had no market recognition and "was earning precisely zero income from endorsements."
