B When Ruby applied for a beer license in March 1961, he reported that he had been arrested "about four or five times" between 1947 and 1953. Between 1950 and 1963, he received 20 tickets for motor vehicle violations, paying four $10 fines and three of $3. In 1956 and 1959, Ruby was placed on 6 months' probation as a traffic violator. Ruby was also frequently suspended by the Texas Liquor Control Board. In August 1949, when he was operating the Silver Spur, he was suspended for 5 days on a charge of "Agents: Moral Turpitude." In 1953 Ruby received a 5-day suspension because of an obscene show, and, in 1954, a 10-day suspension for allowing a drunkard on his premises. On February 18, 1954, he was suspended for 5 days because of an obscene striptease act at the Silver Spur and for the consumption of alcoholic beverages during prohibited hours. On March 26, 1956. Ruby was suspended by the liquor board for 3 days because several of his checks were dishonored. On October 23, 1961, he received another 3-day suspension because an agent solicited the sale of alcoholic beverages for consumption on licensed premises. The Warren Commission Report , p. 800

The Ruby Ridge confrontation began aweek earlier when federal marshals tried to arrest Weaver forfailing to appear in court on weapons charges. At that time, a gunbattle erupted between marshals and Weaver's 14-year-old son,resulting in the deaths of Weaver's son and a marshal. The incident led to one of the most intensive internalreviews of an FBI investigation ever. Attorney General Janet Renoestablished a Justice Department task force to investigate theevents at Ruby Ridge. The task force concluded in a 1994 reportthat the FBI's Hostage Rescue Team overreacted to the threat ofviolence and instituted a shoot-on-sight policy that violatedbureau guidelines and Fourth Amendment restrictions on policepower. The FBI disciplined 12 agents and employees, includingLarry Potts, then the head of its criminal division and now itsdeputy director, for their roles in the operation. She died from a gunshot wound to the head a killing that has become a battle cry for militia groups. The Warren Commission stated it did not rely on this examination in drawing conclusions, although it did publish a transcript of the examination. The FBI in 1964 also expressed dissatisfaction with the test, based on the circumstances surrounding its administration. A panel of polygraph experts reviewed the examination for the committee and concluded that it was not validly conducted or interfered. Because there were numerous procedural errors made during the test, the committee's panel was unable to interpret the examination. The move comes barely a week after a federal appeals court ruled Horiuchi could be tried for manslaughter. "Based upon the entirety of the circumstances surrounding this criminal action, it is unlikely the state will be able to prove beyond a reasonable doubt the criminal act set forth in the information on file," Benson's office argued in court papers.
