PPLS argues that it needs the Does' identities to determine whether they are subject to a voluntary injunction preventing former sales associates who work for a competitor from revealing PPLS's trade secrets. The messages cited by PPLS, however, indicate only that the eight Does were critical of the company and how it treats its associates. EFF will argue that revealing the identity of these speakers will give PPLS the opportunity to punish its critics for speaking out against it. "Without proper safeguards on Doe subpoenas, a company can use a court as a detective agency to ferret out its critics," said EFF's Lee Tien. "We hope that the court will adopt a standard that protects anonymous speech against such subpoenas."

JPB: Well, our principle goal has always been to preserve freedom of expression in cyberspace, but in the process of trying to achieve this we found that it's not enough to assert those rights, we had to create mechanisms capable of ensuring them. Because one of the first things we wanted - being Americans and very narrowly defined in what we thought of as important - was to implement our ideal of the American freedom of speech. Then I hadn't been at this very long before I got some electronic mail from someone who was in, still nominally, the Soviet Union who said well that's wonderful that you're going to try to protect the first amendment in cyberspace but what about us who don't have a first amendment. From this I recognized that in cyberspace the first amendment was only a local ordinance. That in fact all the rights and regulations of the terrestrial world are local.

The story of the Civil Libertarians, though it partakes of all those other aspects, is profoundly and thoroughly *political.* In 1990, the obscure, long-simmering struggle over the ownership and nature of cyberspace became loudly and irretrievably public. People from some of the oddest corners of American society suddenly found themselves public figures. Some of these people found this situation much more than they had ever bargained for. They backpedalled, and tried to retreat back to the mandarin obscurity of their cozy subcultural niches. This was generally to prove a mistake. But the civil libertarians seized the day in 1990. They found themselves organizing, propagandizing, podium- pounding, persuading, touring, negotiating, posing for publicity photos, submitting to interviews, squinting in the limelight as they tried a tentative, but growingly sophisticated, buck-and-wing upon the public stage. It's not hard to see why the civil libertarians should have this competitive advantage.

Savvy users can use devices running on Symbian's Series 60 operating system (OS) to completely bypass a range of services that are normally charged for by their mobile operator, the UK-based consultancy warned on Monday. While the threat is currently minimal, the loophole has the potential to cause major headaches for operators. Open handsets let users choose their applications, which have to compete on pure value. Sure lock-in is nice for sellers until buyers bypass the locked-in route altogether.
