Extractions: WESTERN COAST OF CANADA WEDNESDAY, 3 MARCH 1999 CANADA, AUSTRALIA AND THE SPIRIT OF INDIGENOUS PEOPLE The Hon Justice Michael Kirby AC CMG INDIGENES AND SETTLERS Today the High Court of Australia had a visit from a distinguished judge of the Supreme Court of Appeal of the Republic of South Africa. In accordance with convention he sat with us for a time on the Bench and observed the rule of law at work in Australia. With the British came many of their own cultural norms and artefacts. We see some of these, still very much alive, in the courtrooms of this building. The wigs. The silken robes. Endless bowing and utterances of deferential respect. The secrets and traditions of the law, as taught to us by the British, are still an element of our culture, as much in Canada as in Australia. We share that legal culture. It is a good thing that, today, lawyers in Australia and elsewhere are turning to Canada for legal ideas. There is probably no country in the world which is so similar to Australia, from a legal point of view, as Canada. We are both common law federations, with multicultural policies, sharing the English language and boasting of a century of constitutionalism.

At least 2 500 environmental experts and scientists are attending the congress, currently under way at Durban's International Convention Centre, to forge the way forward to sustain the world's protected areas. The indigenous people's coalition, comprising representatives of communities from Africa, Latin America, Canada and Northern Europe, have also issued a declaration denouncing the forced expulsion and systematic exclusion of indigenous people from their territories through the creation of protected areas and parks. The declaration calls on conservation agencies and environmental organisations to respect the internationally recognised rights of these population groups, including their inherent right to self-determination.

Extractions: Sandra Stanton (used with permission) "Indigenous Peoples" has been the most difficult category to organize. Originally, I tried to keep everything based on geography. Thus, for example, the Maori were a subset under New Zealand. But they were the only subset (the mythology and sacred traditions of white New Zealanders are derived from Europe and I had no reason to give them their own section side by side with the Maori). As such examples grew, I realized that geographical categories were too awkward. So I decided to have a section called "Indigenous Peoples." I am aware that definitions of "indigenous" can be problematic and subject to hostile multi-cultural scrutiny. For the sake of simplicity, by "indigenous," I mean a still-surving people who were the original (or at least among the most ancient) inhabitants of a land before those lands were turned into colonies by peoples of another culture who invariably considered themselves "superior" to the "natives." By "indigenous," I also mean a people who still maintain some contact with their ancient ways, ceremonies, beliefs, arts, ways of healing, birthing, dying. Finally, by "indigenous," I mean a people who have generally been marginalized and oppressed by the newcomers, but who, despite this, sustain a larger visionary sense of their own worth in the web of life.

If the birds died, the miners quickly fled. Today, the world's 500 million indigenous peoples are the miners' canary; and the Earth particularly the tropical rainforests is the mine. That the canary is dying is a warning that the dominant cultures of the world have become toxic to the Earth. In this case, however, we cannot flee the mine."

Newsfront UNDP Administrator sees Mozambique's recovery from floods Wednesday, 5 September 2001: Mozambique's Gaza Province, hit hard by floods that drove 233,000 people from their homes last year and suffering more flood damage this year, is rebuilding with outside assistance, UNDP Administrator Mark Malloch Brown reported following a visit to the area last week. The Administrator, accompanied by Abdoulie Janneh, UN Assistant Secretary-General and UNDP Regional Director for Africa, met with President Joaquim Chissano and other leaders during his visit on 27 - 29 August. The Administrator said that the "overwhelming impression" from his visit to Gaza "is that normal life has been restored and sensible improvements have been made." The recovery efforts have moved many villages from flood-prone areas to higher ground, rebuilt government infrastructure and improved water supply systems. Mr. Malloch Brown co-chaired the donor conference in Rome in May 2000, where donors promised over US$ 450 million to support flood recovery. Thus far, $360 million has been disbursed. The donors' response to the 2000 floods "was remarkable and showed confidence in the country," he said.

Extractions: what does being Indigenous mean? Te Rua Winiata is an Indigenous person from Aotearoa-New Zealand. In July this year she was a participant in the WCC consultation "Indigenous Peoples, Knowledge and Identity" held in Quezon City, Philippines. The consultation was attended by Indigenous representatives from Australia, Canada, Norway, Burma, Taiwan, West Papua, Timor, Thailand, India, the Philippines as well as Aotearoa-New Zealand. After the meeting Te Rua wrote of her experience: Te Rua Winiata, Ainu. We all came under the label of "Indigenous Peoples". While we recognized some commonalities we recognized even more diversity. However the diversities were an enhancement to our relationships rather than being problematic. We talked about an indigenous way of life being holistic. Im still not sure what that meant. For me, as a Maori from Aotearoa, my understanding of an holistic approach to life, is the recognition that for my basic and total well-being there needs to be a balance between the taha wairua (spiritual), tinana (physical), te hinengaro (emotional) and te whanau (family/identity). There is a recognition of the relationship between the earth and the sky and all that comes between. I learn how I am part of the whole. Therefore I can say I belong to the earth. I do not own the land nor do I have dominion over the land. I understand that my relationship with creation means that I have a res-ponsibility to care for Papatuanuku (earth) who provides me with the resources I need for life. To needlessly destroy or take more than my share of the resources, is to walk the path of self-destruction.
